Brown Act, Calif. Government Code section 54953(e)(1)(C) and Resolution No. 22-063 C.S. CALL TO ORDER Chair Freeman called the meeting to order at 4:00 p.m. and Recording Secretary Cleary explained to the public how to participate and provide public comment during the meeting. 1. Meeting Procedures CONSENT ITEMS Approval of Minutes 2. May 10, 2022 ACTION: Approved as submitted. Consider 246 Anita Street and 251 Clay Street; Minor Subdivision SD 21-0159 of a 7,200- Square Foot Parcel (APN 001-373-010-000) Into Two Separate Parcels; Applicant/Owner Dorothy E. Massey; R-3-6 Zoning District; Medium Density Residential General Plan Designation; Exempt from CEQA Requirements, Article 19, Section 15315, Class 5 ACTION: Denied Minor Subdivision application SD-21-0159 of a 7,200-Square Foot Parcel (APN 001-373-010-000) into two separate parcels at 246 Anita Street and 251 Clay Street, pursuant to the recommendation from the Minor Subdivision Committee and findings presented in the Agenda Report Staff Presentation/Commissioner Questions Associate Planner Sabdo presented the Agenda Report and answered Commissioner questions. Community Development Director Cole was also present and answered Commissioner questions. Chair Freeman asked on what basis the denial was recommended. Ms. Sabdo explained the proposal meets Finding 1 because it is not consistent with the Old Town Area Plan. Commissioner Fletcher asked who was on the Minor Subdivision Committee referring the item to the Planning Commission. Ms. Sabdo stated that the May 19, 2022 Minor Subdivision Committee comprised of City Engineer Tom Harty and Planning Commission Vice Chair Hansen Reed. Commissioner Millich inquired about the basis of the Minor Subdivision Committee decision. Ms. Sabdo explained that the Committee agreed with Staff’s Agenda Report and added that the only inconsistency is with the Old Town Area Plan. Ms. Cole clarified that the proposed minor subdivision application was referred from the Minor Subdivision Committee to the Planning Commission because of a Municipal Code requirement suggesting they could not make the decision. Commissioner Latasa asked why Senate Bill Nine (SB9) does not apply to this site. Ms. Sabdo stated SB9 applies to single-family residential zones, but the site in question is multifamily, zoned R-3. Commissioner Latasa mentioned the Old Monterey Area Plan uses the word discouraged and asked why the section does not say prohibited. Ms. Sabdo suggested the word discouraged is up for interpretation by the Planning Commission and added that Staff did not hear back from the Old Town Neighborhood Association after reaching out regarding the project. Chair Freeman asked how the proposed layout arose. Ms. Sabdo explained many revisions took place for this proposal to meet the R-3 standards. Ms. Cole added there was a straight-line version that was reviewed by the Minor Subdivision Committee that required a Variance and Initial Study with a high project cost. Commissioner Fletcher suggested the unusual property line could create problems if the parcels are owned by different people. Chair Freeman agreed. Chair Freeman asked what currently separates the properties. Ms. Massey explained there is a fence between them. Chair Freeman asked if Ms. Massey would bring the straight-line proposal to the Planning Commission to review splitting the property into two regular-shaped lots. Ms. Massey agreed and said she would bring the other proposal forward. Public Comments None. Commissioner Comments Commissioner Fletcher and Chair Freeman asked clarifying questions regarding the site plan, setback requirements and calculations, and similar approved projects. Ms. Sabdo and Ms. Cole provided details. Chair Freeman inquired about sizes of other lots near the project site. Ms. Sabdo exhibited examples from the property information database. Commissioners Millich and Latasa shared concerns regarding difficulty approving a variance if proposed and agreed with Commissioner Fletcher’s concerns based on the unusual lot configuration and the Old Town Neighborhood Association Area Plan’s discouragement. Chair Freeman suggested each abnormal turn represents a potential future conflict and spoke in favor of denying the project because the Old Town Area Plan discourages substandard lot divisions. Commissioner Fletcher advised if the houses are removed the lot lines would remain and suggested this renders the substandard lot shape unacceptable and problematic. On a motion by Commissioner Latasa, seconded by Commissioner Fletcher and carried by the following vote, the Planning Commission denied Minor Subdivision application SD-21-0159 of a 7,200-Square Foot Parcel (APN 001-373-010-000) into two separate parcels at 246 Anita Street and 251 Clay Street, pursuant to the recommendation from the Minor Subdivision Committee and findings presented in the Agenda Report: AYES: 4 COMMISSIONERS: Freeman, Fletcher, Latasa, Millich NOES: 0 COMMISSIONERS: None ABSENT: 3 COMMISSIONERS: Reed, Brassfield, Dawson ABSTAIN: 0 COMMISSIONERS: None RECUSED: 0 COMMISSIONERS: None COMMISSIONER COMMENTS Chair Freeman asked if the Electric Bike Ordinance recently approved by City Council included only Class One bikes. Ms. Cole stated the Ordinance allows Class One and Class Two bikes. Planning Office Update ADJOURNMENT ADJOURNMENT — The general policy of the Planning Commission is that the Afternoon Session will end no later than 5:30 p.m. and the Evening Session will end no later than 11:00 p.m. Any public agenda items that have not been completed within the designated adjournment time may be formally extended by the Commission, or continued to the next regularly scheduled Planning Commission Meeting, or continued to a Special Meeting. Agenda packets may be reviewed by the public in the Monterey Public Library, in the Planning Office, or on the web at http://www.monterey.org beginning late Friday afternoon prior to the date of the meeting.
