Brown Act, Calif. Government Code section 54953(e)(1)(C) and Resolution No. 22-026 C.S. CALL TO ORDER Senior Associate Planner Schmidt, serving as Zoning Administrator, called the meeting to order at 3:04 p.m. and Administrative Assistant Cota explained to the public how to participate and provide public comment live during the meeting. PUBLIC COMMENTS None. CONSENT ITEMS Approval of Minutes 2. May 05, 2022 ACTION: Approved as submitted. Zoning Administrator Schmidt said the minutes state that, “Associate Planner Buggert presented the Agenda Report and answered Zoning Administrator questions” and approved the minutes with this sentence amended to reflect there were no questions for Staff. ***End of Consent Agenda*** PUBLIC HEARING 3. Consider 398 Fremont Street; Use Permit Application UP-22-0057 to Allow Mobile Food Vending Business “Farm Fresh Fruits” to Operate from 8:00am to 8:00pm on Private Property; Applicant Dustin Benton; Owner Gurdish Kumar; C-2 Zoning District; Commercial General Plan Land Use Designation; Exempt from CEQA per Article 19, Section 15301, Class 1 DocuSign Envelope ID: 88E7E612-49A7-4EAB-B9DB-C11AEE3503C8 Zoning Administrator Minutes Thursday May 5, 2022 ACTION: Approved Use Permit application UP-22-0057 to allow Mobile Food Vending business “Farm Fresh Fruits” to operate from 8:00 a.m. to 8:00 p.m. on private property at 398 Fremont Street Staff Presentation/Zoning Administrator Questions Associate Planner Buggert presented the Agenda Report. Applicant Applicant Dustin Benton provided details regarding the business structure and proposal and remained present to answer questions. Zoning Administrator Schmidt asked if the trailer would be moved offsite after hours when the fruit stand is closed. Mr. Benton explained it would stay onsite for the season and would be removed when the season ends. Zoning Administrator Schmidt advised coordinating with Bobalicious regarding trailer placement and asked if the dumpsters are located near Denny’s. Mr. Benton said most of the trash would be cardboard and would be taken directly to the Marina Dump. Zoning Administrator Schmidt stated that Bobalicious is located in a parking space and specified that the property owner would need to add parking spaces subject to the City’s parking requirements if either vendor wishes to operate in any parking space. Public Comments None. Zoning Administrator Comments Zoning Administrator Schmidt suggested this seemed like a good project and like the applicant understands their limitations in terms of parking. He recommended coordinating with the site owner to maintain the site and keep it clean as food truck owners are responsible for keeping their areas clean. Zoning Administrator Schmidt approved the proposal based on findings and Conditions of Approval presented by Staff and specified that a sign permit is required if signage is desired. The Zoning Administrator agenda may be reviewed by the public at the Planning Office, on the City Clerk’s bulletin board, or on the web at www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Zoning Administrator on any item on the Agenda.
