Staff Members Present: Associate Planner Sabdo serving as Zoning Administrator,
Senior Associate Planner Schmidt, Recording Secretary Cota
This meeting was held with a combination of in-person and teleconference attendance,
pursuant to the Ralph M. Brown Act, Calif. Government Code section 54953(e)(1)(C) and the
Monterey City Council’s Resolution authorizing virtual participation in public meetings given the
COVID-19 pandemic.
CALL TO ORDER
Associate Planner Sabdo, serving as Zoning Administrator, called the meeting to order at 3:00
p.m. and Recording Secretary Cota explained to the public how to participate and provide public
comment live during the meeting.
PUBLIC COMMENTS
Gabriel Sanders, Deputy Director of LandWatch Monterey County, stated that the Planning
Commission will have updates to zoning to accommodate RHNA units. Mr. Sanders stated that
LandWatch will support these efforts.

Zoning Administrator Sabdo approved the August 4, 2022 Minutes with the following
amendments: Move the first paragraph, under Zoning Administrator Comments, starting with
“Zoning Administrator Roveri stated”, as the second paragraph under “Staff Presentation/Zoning
Administrator Questions”, to reflect the flow of the meeting; Under “Zoning Administrator
Comments”, paragraph two, fourth line down, change amendments to amendment; On the fifth
line down, change amendments to amend to read “and amend Exhibit A”; Change the last line
in the same paragraph to Sunday instead of Sundays.

Existing Commercial Office Space to Seven Residential Units; Applicant Glenn E. Warner;
Property Owner Rezai Mohammad and Jayesh Desai; CO-ES Zoning District (Office and
Professional District with Emergency Shelter Overlay); Commercial General Plan Land
Use Designation; Exempt from CEQA Requirements per Article 19, Section 15332, Class
32 (Supersedes Resolution Z22-009)
ACTION: Approved Use Permit UP-21-0081 with a correction to Finding Two, sentence
three, to replace, “to construct seven new residential units” with “involves the
conversion of existing commercial office space to seven residential units”
Staff Presentation/Zoning Administrator Questions
Senior Associate Planner Schmidt presented the Agenda Report. Mr. Schmidt stated that the
project was heard last month and was approved, but there was an error on the notice that there
were six units, although seven are proposed.
Zoning Administrator Sabdo asked if in paragraph three of the Analysis the reference to building
three should say building two. Mr. Schmidt confirmed building two is correct.

Architect Glen Warner present to clarify the concerns about draining.
Public Comments
Gabriel Sanders commented that he’s glad that the housing project will move forward. Mr.
Sanders stated that there will be more water in the coming years. Mr. Sanders applauds the
developers and the City of Monterey for working on this project.

Zoning Administrator Sabdo approved Use Permit UP-21-0081 with a correction to Finding Two,
sentence three, to replace, “to construct seven new residential units” with “involves the
conversion of existing commercial office space to seven residential units”.

New Residential Units) at an Existing Commercial Office Building; Applicant Merritt
Hawley, MAP Architect; Property Owner Charles Hawley B. Trust Et Al; CO-ES Zoning
District (Commercial Office and Emergency Overlay); Commercial General Plan
Designation; Exempt from CEQA Requirements per Article 19, Section 15303, Class 3
ACTION: Approved Use Permit UP-22-0103 to allow two new residential units at an
existing commercial office building at 857 Cass Street with an amendment to
CEQA Finding, Exception F, Historical Resources, after, “constructed in 1986”,
to add a comma and state, “less than 50 years ago” and addition of Special
Condition One to state that, “two permanently assigned parking spaces shall
be maintained for each residential unit” (no covered parking for units is
required).

Zoning Administrator Sabdo commented that the Commercial Office District prohibits parking in
a front setback area and asked Mr. Schmidt if the parking is existing nonconforming. Mr. Schmidt
confirmed it is.

Merritt Hawley was present to answer questions. There were no questions for Ms. Hawley.

Zoning Administrator Sabdo stated that off-street parking standards for mixed use development
requires one permanently assigned parking space for each unit. She indicated she will approve
Use Permit UP-22-0103 to allow two new residential units at an existing commercial office
building at 857 Cass Street with one amendment to CEQA Finding, Exception F, Historical
Resources, after, “constructed in 1986”, to add a comma and state, “less than 50 years ago” and
addition of Special Condition One to state that, “two permanently assigned parking spaces shall
be maintained for each residential unit” (no covered parking for units is required).

ADJOURNMENT
ADJOURNMENT— The general policy of the Zoning Administrator is that the meeting will end no
later than 4:00 p.m. Any public agenda items that have not been completed within the designated
adjournment time may be formally extended by the Administrator, or continued to the next
regularly scheduled Zoning Administrator Meeting, or continued to a Special Meeting.
The Zoning Administrator agenda may be reviewed by the public at the Planning Office, on the
City Clerk’s bulletin board, or on the web at www.monterey.org beginning late Friday afternoon
prior to the date of the meeting.
Members of the public have the right to address the Zoning Administrator on any item on the
Agenda. The Zoning Administrator will formally open the floor for public comment on items listed
under “Public Hearings.”
Information distributed to the Zoning Administrator at the meeting becomes part of the public
record. A copy of written material, pictures, etc. should be provided to the Administrator for this
purpose.
Zoning Administrator decisions may be appealed within ten (10) days from the date of the decision
on forms available in the Planning Division during business hours. When the tenth day falls on a
weekend or a holiday, the appeal deadline date is the next working day following the holiday or
