CONSENT ITEMS Approval of Minutes 2. March 2, 2023 (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) ACTION: Approved as submitted. ***End of Consent Agenda*** PUBLIC COMMENTS None. PUBLIC HEARING 3. Consider 600-628 Wave Street; Use Permit Application UP-23-0040 to Conditionally Allow a Vehicle/Equipment Sales and Services (Commercial Parking Facility) Use; Applicant Arthur Eschbach; Property Owner Monterey Bay Aquarium Foundation (Robert Young); C-2 Zoning District (Community Commercial District); Commercial General Plan Designation; (Exempt from CEQA Requirements per Article 19, Section 15301, Class 1) ACTION: Approved Use Permit Application UP-23-0040 as submitted to conditionally allow a Vehicle/Equipment Sales and Services (commercial parking facility) Use at 600-628 Wave Street as presented with the following amendments:  Under Finding One, delete, “of which the site is currently blocked off to any public access for parking”.  Under Standard Condition Two after “permits required”, add, “as necessary, for the proposed use”. Staff Presentation/Zoning Administrator Questions Associate Planner Buggert presented the Agenda Report and answered the Zoning Administrator’s questions. Zoning Administrator Roveri asked if the larger facility is 601 Wave Street. Mr. Buggert mentioned there was a typo and the large parking structure was at 601 Wave Street. Zoning Administrator Roveri asked about the third sentence, Finding One in the agenda report and if the subject site was blocked off with no one using it. Mr. Buggert explained the site is not open to the public. Applicant Arthur Eschbach was present to answer questions. Public Comments None. Zoning Administrator Comments Zoning Administrator Roveri agreed the proposed use is consistent with the General Plan Land Use Designation and the Zoning Ordinance and that the proposed use would have no detriment to public health, safety, or welfare. Zoning Administrator Roveri approved the proposal as submitted with the following amendments:  Under Finding One, delete, “of which the site is currently blocked off to any public access for parking”.  Under Standard Condition Two after “permits required”, add, “as necessary, for the proposed use”.  Correct Standard Condition Four to say, “Zoning Administrator” instead of “Planning Commission”. The Zoning Administrator agenda may be reviewed by the public at the Planning Office, on the City Clerk’s bulletin board, or on the web at www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Zoning Administrator on any item on the Agenda. The Zoning Administrator will formally open the floor for public comment on items listed under “Public Hearings.” Information distributed to the Zoning Administrator at the meeting becomes part of the public record. A copy of written material, pictures, etc. should be provided to the Administrator for this purpose. Zoning Administrator decisions may be appealed within ten (10) days from the date of the decision on forms available in the Planning Division during business hours.
