CONSENT ITEMS Approval of Minutes 2. October 05, 2023 (Not a Project Under CEQA per Article 20, Section 15378 and Under General Rule Article 5, Section 15061) ACTION: Approved as amended. Zoning Administrator Buggert made corrections to the October 05, 2023 minutes. Packet page 6 item page 2. Zoning administrator comments should include “state applicant verbally agreed to request for a noise study” “and in addition to the submittal of an operation plan for the proposed dance events” ***End of Consent Agenda*** PUBLIC COMMENTS (MATTERS NOT ON THE AGENDA) None. Consider 2600 Sand Dunes Drive; Use Permit Application UP-23-0063 for a Change in Use from Meeting Room to Fitness Room at the Bayview Center at the Monterey Tides Hotel; Applicant Michael Stanton; Owner ACP Monterey Hotel LLC; VAF Zoning District; Commercial General Plan Land Use Designation; Exempt from CEQA per Article 19, Section 15301, Class 1 ACTION: Approved Use Permit Application UP-23-0063 with conditions for a change in use from meeting room to fitness room at the Bayview Center at the Monterey Tides Hotel DocuSign Envelope ID: 050EE837-171D-4F36-AFB3-EFB1C706E8BE Zoning Administrator Minutes Thursday November 02, 2023 Staff Presentation/Zoning Administrator Questions Senior Associate Planner Sabdo presented the Agenda Report and referred Zoning Administrator Buggert’s question regarding additional structural interior adjustments to the applicant. Applicant The applicant’s representative, Anthony Alegamaro, responded that there are no other interior structural changes proposed with the project. Public Comment None. Zoning Administrator Comments Zoning Administrator Buggert agreed with Staff’s recommendation and approved Use Permit Application UP-23-0063 for a Change in Use from Meeting Room to Fitness Room at the Bayview Center at the Monterey Tides Hotel, with an added Condition of Approval specifying that the occupancy maximum shall be limited to that allowed by the City’s Building and Fire Departments for the space. Meeting Procedures CONSENT ITEMS CONSENT ITEMS allow for a review of those items recommended for approval on consent or recommended to be continued, tabled or withdrawn, etc. Consent items consist of those items which are routine and for which a staff recommendation has been prepared. A member of the public or the Zoning Administrator may request that an item recommended for approval on consent be heard on the regular agenda for further discussion. If an item is pulled from the Consent Agenda for discussion, the Zoning Administrator will request that persons wishing to speak on topics that are not on the agenda line up at the podium or use the “raise hand” function in Zoom, to determine the number of persons interested in speaking. The amount of time for public comment will be determined based on the number of persons interested in speaking. The maximum time allotted for public comment is 15 minutes. In exceptional circumstances and when necessary to ensure full opportunity for public input, the Zoning Administrator may adjust the amount of time allowed for public input and/or the time allotted for each speaker. At this time, the public may speak for a maximum of three minutes on any subject which is within the jurisdiction of the Monterey Zoning Administrator and which is not on the agenda. The Zoning Administrator will request that persons wishing to speak on topics that are not on the agenda line up at the podium or use the “raise hand” function in Zoom, to determine the number of persons interested in speaking. The amount of time for public comment will be determined based on the number of persons interested in speaking. The maximum time allotted for public comment is 15 minutes. The Zoning Administrator agenda may be reviewed by the public at the Planning Office, on the City Clerk’s bulletin board, or on the web at www.monterey.org beginning late Friday afternoon prior to the date of the meeting. Members of the public have the right to address the Zoning Administrator on any item on the Agenda. The Zoning Administrator will formally open the floor for public comment on items listed under “Public Hearings.” Information distributed to the Zoning Administrator at the meeting becomes part of the public record.
