CALL TO ORDER
Principal Planner Roveri, serving as Zoning Administrator, called the meeting to order at 3:01
p.m. and Recording Secretary Barrera explained to the public how to participate in the meeting
virtually.
CONSENT ITEMS
No comments were made regarding the Consent Agenda.

3. Consider 469 Toyon Drive: Use Permit Application UP-24-0044 for a Retaining Wall Over
6 Feet in Height (8.5 feet Proposed); Applicant Jack C. Camp, PE, Central Coast Civil and
Structural Engineering Inc.; Owner Larry Burkett; R-1-8 Zoning District (Residential
Single-Family); Low Density Residential General Plan Land Use Designation; Exempt
from CEQA per Article 19, Section 15303, Class 3
ACTION: Tabled Use Permit Application UP-24-0044 for a Retaining Wall Over 6 Feet in
Height (8.5 feet Proposed) at 469 Toyon Drive to a date uncertain.

Associate Planner Buggert presented the Agenda Report and answered the Zoning
Administrator’s questions whether an archaeological report was prepared.

Applicant Jack Camp provided additional details on the scope of the project and stated the
property is in jeopardy without the retaining wall.
Zoning Administrator Roveri asked if the erosion during the rainy season exposed the clay area.
Camp responded that the issue was with groundwater in the hillside that undermined the
property and backyard.

Zoning Administrator Comments
Roveri stated every action by a city of Monterey decision maker is required to go through the
California Environmental Quality Act process (CEQA). Staff’s recommendation was that the
project is exempt from CEQA, and the Staff report says the project was not within an
archaeological sensitive location. Roveri stated that the lower half of this site is in an
archaeologically sensitive location and therefore may not be exempt from CEQA. Roveri stated
that the potential environmental impacts haven’t all been evaluated. Because these potential
effects have not been studied, ZA cannot make a decision and tabled the item to a date
uncertain.
4. Consider 2 Upper Ragsdale Drive: Use Permit Application UP-24-0062 to Allow Mobile
Food Vending on Private Property Exceeding 2 Hours; Applicant Bret Silvestri; Owner
Community Hospital Properties; I-R-150-D2-ES Zoning District (Industrial,
Administration, and Research District with Development Control and Emergency Shelter
Overlays); Industrial General Plan Land Use Designation; Exempt from CEQA per Article
19, Section 15301, Class 1
ACTION: Approved Use Permit Application UP-24-0062 to Allow Mobile Food Vending
on Private Property Exceeding 2 Hours at 2 Upper Ragsdale Drive

Associate Planner Buggert presented the Agenda Report and answered the Zoning
Administrator’s question regarding the restroom facilities.

PUBLIC COMMENT PROCEDURES AND TIME LIMITS:
The total amount of time allocated for public comment on a particular issue and for each
individual speaker is generally as follows:
1. Up to three minutes per speaker.
2. For regular Zoning Administrator meetings, there is one 15-minute public comment period
for items not on the agenda.
3. The total time allocated for public comment:
a. Items pulled from the consent agenda – 15 minutes each item
b. Public Appearance items – 30 minutes each item
c. Public Hearing items – 30 minutes each item
At the time an item is considered, the Zoning Administrator will ask those attending the meeting
in person to line up at the podium or raise their hands, and for remote participants to use *9 on
the telephone or the “raise hand” function in Zoom, if they wish to address the Zoning
Administrator. The maximum amount of time for each person to speak and the total amount of
time allotted for each item will be determined based on the number of people indicating an
interest in speaking and the amount of business to be conducted on the agenda. In exceptional
circumstances and when necessary to ensure a full opportunity for public input, the Chair may
adjust the amount of time allowed for public input and/or the time allotted for each speaker.
