Action: Commissioner Hepburn moved to excuse Commissioner Schmig. Seconded by Commissioner Roderick, motion carried unanimously. Consent Agenda: A. Minutes for November 7, 2019 Action: Commissioner Hepburn moved to approve the consent agenda. Seconded by Commissioner Eck, motion carried unanimously. 2019 Comprehensive Plan Amendments – Public Hearing Community development director, Kris Robbins spoke about a few issues regarding some deficiencies in the comprehensive plan. She spoke about the items on the agenda and their respective requests. Items opened to public hearing. Planning Commission Minutes November 21, 2019 Page 1 Presentation by Proponent: Hansen Request: Donna S. (#30) spoke about how changing the zone would not be as simple as it sounds. It is considered a “wet zone”, she is confused as this parcel is marsh and property values will go down. She does not think this should happen at all. Janice L. (#18) also spoke on behalf of the homeowner’s association. She was told the land was protected and would remain in its natural state. She explained her interest in enjoying the wildlife and vegetation. Mick Hansen spoke about the need to explain a few things. The parcel is in private hands and his intentions are that a marina is in there. He reassured the audience that the view won’t be changed as it is wetlands. Cox Rezone: No comments PIA Rezone: Pete Torkhill (Owen Rd): Would like to make it clear this his sons own 15 acres to the west of property. They are pro-growth and has the following 3 points: 1) Referred to letter sent to residents and a posted a sign on property that has raised concern. (referred to photo) Intentions to build a multi-family complex project. The city was unaware of the sign and believes it is misleading. This is a C-2 change in zoning. The residents need to be informed and not misled. He wants the signed pulled down. 2) The comp plan is way past due. The existing comp plan has zoned that for R-3. Before the property is changed, he thinks we should wait until the comp plan comes out to see what is suggested. 3) Moses Lake Municipal Code in Title 18 states that after meetings City Council makes a decision and if it is beneficial, then the zoning can be changed. Reason why this was in comp plan is the intention of residential growth. Commercial access would be on Loring according to his application, but there is no right of access from Loring. Access would be on Harris Rd and a lot of residents will be affected. Robert Herring (housing area): Industrial access would be horrible. There is only one entrance in and out of there, he doesn’t think that would fit there at all. Don Temple (Harris Rd): What is the definition of commercial? Auto shop? Battery place? He has lived there 20 years and wants to know who is going to pay the LID. That road will not withstand heavy traffic. It barely sustains the garbage truck. It is not an asphalt road. If they pay the repairs of the whole road then maybe we would be ok with it. Jim Thayer(Jean Rd): The roads will not sustain heavy traffic. We enjoy a quiet area and very few crimes go on there. If it is opened up the crime will come through. Agrees with Pete that the request does not fit that particular zone. Planning Commission Minutes November 21, 2019 Page 2 Kathy Thayer (Jean Rd) Concerned about the crime rate, what will happen with only one road? She doesn’t want to see higher crime rates due to industrial. Central Terminals: Gil Alvarado (J.4 NE): For clarification – my role as a Representative of Central Terminal I am here to support the application that was put forward and add support of what the comp plan includes. The application is straight forward. Current comp plan – Ch 3 Policy 1 – D states that urban government services should be provided. Sec 3.11 – provide employment in the area. This request falls in line within the goals of the city comp plan. Based on this criteria, this fits into the recommendation. Bob F (Frontage Rd E): It is important as the port needs places to go. Dune Lakes: Kevin Richards (Hunter Place) Currently a PUD south part of town. 1400 loose lots. Devep agreement take place with sewer and water. Disappointed by the pushback they are experiencing. Just want to hook into sewer and water. Side note- large devel to bring water to it – impact and need help subsidize the need for water and availability for cash. A lot of good can come from this. If vacant ground maybe sell res unit- diff matter. This expansion has already been accounted for. Motion to table the public hearing. Moved and seconded until next meeting. Motion passes. Administrative Report: Community Development Director, Kris Robbins talked about title 17.Cacasde valley area – portion within city limits- does not have public water, sewer, etc. Staff has been working together on opportunity to fix some deficiencies and move things forward for them. We are looking for some solutions and trying to put a policy together for the lots that are platted in that area. Planning Commission Questions and Comment Chair Nofziger asked about buying a tanker and setting it up there. Kris Robbins mentioned that they are IN city limits and this has been sitting here for 13 years. We need to check the boxes and have something in place. Chair Nofziger: Can they have setbacks that can be far enough apart? Maybe there is a way to have a lower residential zone? We can bring in Dune Lakes to the UGA but the city would never get there. City Council has the power to deal with most of the issues. Can you start mailing these again? Are these 2 kids here on a date or was it punishment? Vivian: If it’s 50 pages do you still want it emailed? Yes that is fine. Kris: During the time that apps are due, we’ve been trying to get comp plan updates moving forward. Most of my day was spent on the phone with Department of Commerce. We need to all sit in the same room and have that conversation. Commissioners spoke about the release of the 3 commissioners. Kris mentioned that staff was out of the loop. Can they get a plaque or something for their service? 20 and 16 years Planning Commission Minutes November 21, 2019 Page 3 is a long time for a volunteer service. If you are absent you are saying something against the other commissioners, it is an insult to us all. If your life changes, there is nothing wrong with that. It is ok, you can step down. I am not comfortable with only having five commissioners. It wouldn’t be too bad to have a couple alternates. Planning Commission Minutes November 7, 2019 Page 1 Beautiful Minds Academy – Conditional Use Permit – Public Hearing Associate Planner, Lori Witters presented the staff report. Mireya Ceja has leased to occupy an existing 1680 square foot building to be used as a private pre-school. City Code allows for schools in a C-2 general commercial zone with a conditional use permit. The property is located at 819 E. Penn Street. Given the research and findings, Staff recommended approval of the conditional use permit with conditions provided in the staff report. Presentation by Proponent: Ms. Ceja addressed the Planning Commission regarding her request for the conditional use permit. Chair Nofiziger opened the public hearing. There being no public input, the public hearing was closed. Action: Commissioner Hepburn moved to approve the Beautiful Minds Academy conditional use permit with staff recommendations and findings of fact as presented. Seconded by Commissioner Mann, motion carried unanimously. . Administrative Report: Community Development Director, Kris Robbins talked about parks and park fees and the continuing discussion on revising title 17. The Plan may be amended no more than once per year. The City of Moses Lake adopted a GMA-compliant Comprehensive Plan in 2001 and has amended it periodically. Attached are the proposed amendments for 2019, consisting of five site- specific land use designation changes requested by property owners. SEPA: A Determination of Non-Significance (DNS) was issued November 5, 2019, under the State Environmental Policy Act Rules (WAC 197-11). The comment and appeal period on the DNS ends at 5:00 pm on November 20, 2019. Any comments received will be presented at the November 21, 2019 public hearing. Process: The Planning Commission has previously reviewed the proposed amendments. Now the Commission will hold a public hearing and make a recommendation to the City Council on each proposed amendment. The City Council will be presented the recommendation at the first of two meetings and final proposal of adoption by ordinance #2934 on December 20. 2019. Public Hearing: A public hearing has been scheduled. Public notices were published in the local newspaper and posted at Civic Center and on the City’s website. Property owners and residents within 500' of the five Land Use Designation changes were notified by mail. The Commission should open the public hearing and take testimony on the proposed Comprehensive Plan amendments. Action: The Planning Commission should consider each proposed Comprehensive Plan amendment, and make a recommendation to the City Council on each proposed amendment. Over the last few years the City has had conversations about how to deal with the situation of the land being in the City Limits without having access to utilities. Over the last little bit, staff has been working together to establish a means of allowing development to occur on those platted lots. The reason the City is hesitant about allowing building is because these parcels need to have fire protection services and suppression as well as domestic water and sewer. Within our existing code, the City has a provision to allow platted lots that are currently not meeting City standards to be deemed an insufficient plat. What this entails is for covenants or agreements to be required on the each lot to be built upon, understanding that at a later date they will be required to connect to services when available, pay their share of the road improvements, etc. Additionally, the Building Department has requirements as well. Such as at the time of permitting, each lot is required to have fire protection available to the site if combustibles (building materials) are stored on the site. That requires our fire department to protect the site and it does not have the ability to protect. So there are special provision necessary for this area. Staff has been working diligently with landowners to figure out a way or what the requirements would be to allow development. The suggestions are attached to this report and are available for conversation. We are working on establishing a policy to assist these properties to be built upon and would apply to existing platted lots within the Cascade Valley annexed area. Page 1 of 4 Background A large portion a property was purchased by a developer with the intent to bring water and sewer lines across the lake to their property. During this conversation, there's additional and surrounding properties that wanted to benefit from the City utilities as well. However, some of these properties had already been approved through the county platting process allowing development with wells and septic systems. At some point during this process and due to the downturn in the economy, the developer of the large parcel chose not to do the development and the City did not extend utility lines across the lake. However, the annexation proceeded or was previously completed before this decision was made, and this left this portion of property inside City Limits without urban services. This causes a bit of an issue as the properties do not have fire protection. Additionally, our code requires urban services, waivers, or a deferral to connect to the system for properties to obtain a building permit. All new residential structures up to 3600 square feet must have approved NFPA 13D fire sprinkler systems, with a minimum of a 400 gallon reservoir / pump system similar to the one in the attached photo. 2. Outbuildings / detached garages would be limited to 600 square feet or less and require a minimum of 20 feet of spacing between them and other structures. 3. All structures would require a minimum of 20 feet eave to eave spacing. 4. Any new structure greater than 3600 square feet total would be required to undergo individual review for approval as 3600 square feet would exceed the alternative flow we could reasonably expect to provide using Tenders. 5. Only single and two family residences could be constructed with the fire flow issues present, and two family residences must be separated by a minimum of a one hour wall and be equipped with sprinkler systems as stated in number 1 above.
