CITY OF MOSES LAKE PLANNING COMMISSION MEETING MINUTES
OF October 5, 2023
Commissioners Present: Nathan Nofziger (Chair), Charles Hepburn (Vice Chair), Gary
Mann, Adam Weber(remote)
Commissioners Absent: Susan Tao
Staff Present: Community Development Director Kirsten Peterson, Planning Manager
Vivian Ramsey, Senior Planner Nathan Pate, and Planning Technician Michelene
Torrey
The meeting was called to order at 6:00 p.m. Attendance was called by Secretary
Michelene Torrey. Commissioner Tao was absent. Vice Chair Hepburn moved to
excuse Commissioner Tao’s absence; the motion was seconded by Commissioner
Mann. Passed unanimously.
Item # 1- Approval of Minutes from September 28th Meeting
Vice Chair Hepburn moved to approve the minutes for the September 28, 2023,
meeting, seconded by Commissioner Mann.
Chair Nofziger recused himself from the public hearing due to a conflict of interest.
Item #2- Public Hearing NCBR Railroad- Senior Planner Nathan Pate presented the
staff report for the NCBR Railroad Shoreline Substantial Development Permit and
Shoreline Conditional Use Permit. The railroad proposes a new segment of rail that will
cross over a portion of Crab Creek. Vice Chair Hepburn asked the commission if they
had any questions or concerns for Mr. Pate prior to opening the Public Hearing portion
of the meeting, the commission did not have any questions and the public hearing was
opened with no members of the public present. Jacobs Engineering as well as Milt Miller
with the Port of Moses Lake gave brief testimony on the project, giving the commission
a bit of background information and timelines of the project. The public hearing was
closed by Vice Chair Hepburn and the commission deliberated on the conditions of
approval and findings of fact. Commissioner Mann motioned to approve the Shoreline
Conditional Use Permit, seconded by Commissioner Weber. Commissioner Mann
motioned to approve the Shoreline Substantial Development Permit with the words “or
as approved by the City of Moses Lake” to Condition #17 of the Conditions of Approval,
the motion was seconded by Commissioner Weber. Commissioner Mann moved to
approve the Findings of Fact, seconded by Commissioner Weber. Passed Unanimously.
Item #4 Staff/Commission Questions and Comments:
Staff and the commission discussed the upcoming meetings in regard to the code update
as well as the holidays.

Columbia Basin Railroad
Shoreline Conditional Use Permit
An application for a Shoreline Conditional Use Permit and a Shoreline Substantial
Development Permit for the construction of the Northern Columbia Basin Railroad
(NCBR) Project within the Shoreline Jurisdiction of Crab Creek and associated
wetlands is proposed. The proposal includes the construction of two new rail line
segments (Segment 1 and Segment 2) and acquisition and refurbishment of an
existing rail line (Segment 3) that connects Segments 1 and 2. All jurisdictional
wetlands and waterbodies occur along Segment 1. The entire proposed route will
extend approximately 11.5 miles, primarily in the city of Moses Lake and in
unincorporated portions of Grant County. Segment 1 of the Project includes
construction of a new bridge over Crab Creek and construction of approximately 4.6
miles of new track.
Location: The NCBR Segment 1 Project is in Central Washington, approximately 8.5
miles north of Interstate 90, and lies partially in the city of Moses Lake and partially
in unincorporated areas of Grant County. Assessor’s Parcel No. NCBR Segment 1
from east to west: 110069480, 091121632, 091121635, 110069492, 190479000, 313169000,
313167000, 190483000, 190484000, 191325416, 191325426, 091325406, 110077135,
110005006 (Wetland A), 110007005 (Wetland B), 110007007 (Wetland C), 110007066
(Wetland E), and 110007008. The property is located within a portion of Sections 19,
and 20, Township 19 North, Range 29 East Willamette Meridian, and Sections 13, 14,
and 24, Township 19 North, Range 28 East Willamette Meridian and in City of
Moses Lake, Grant County, Washington.
