TOWN OF MOUNT PLEASANT, SOUTH CAROLINA BOARD OF ZONING APPEALS MARCH 29, 2021 MINUTES STAFF REPORT Present: Barry Wolff, Chair, Julian Hopkins, Beth Santilli, Elliott Barrow, Stephen Wood, Stephen Duke, Megan Stevens. Staff: Michael Robertson, Lynnette Lynes Mr. Wolff called the meeting to order at 6:00 pm. A. Approval of Agenda Mr. Duke moved for approval of the agenda. Ms. Stevens seconded the motion. All in favor. B. Approval of Minutes Mr. Duke moved for approval of the minutes. Mr. Wood seconded the motion. All in favor. C. Public Comment There being no comments, Mr. Wolff continued with the agenda. D. General Correspondence All correspondence received was distributed to the Board and linked to the agenda. E. Explanation of Procedures Mr. Wolff reviewed the procedures with the Board. F. Administration of Oath Mr. Wolff administered the oath to those speaking. Case V-7-2021, 648 McCants Drive, TMS# 532-06-00-018, Request for relief from the strict application of§156.007 Definitions, Building Line, to all application of front and rear setbacks on the longer dimensions of the lot and side setbacks based on shorter dimensions of lot. The ordinance establishes front and rear based on the shorter dimension and side setbacks based on the longer dimension. Mr. Robertson reviewed staff comments with the Board. Ms. Elizabeth Drake, representatives for the owner, reviewed the request with the Board. There being no comments, Mr. Wolff closed public comments. Mr. Barrow moved for approval based on the findings of the testimony at the meeting, particularly that the addition encroaching on the setback was approved by the Town of Mount Pleasant causing an illegal structure, that there are extraordinary conditions and are unique to this property and do not apply to property in general vicinity, application of the ordinance would unreasonably restrict the property as the building is currently illegal, and approval would not be a detriment to adjacent property, public good or character of the district. Mr. Duke seconded the motion. All in favor. 2. Case V-8-2021, 706 Adluh Street, TMS# 532-06-00-056. Request for relief from the strict application of §156.007 Definitions, Building Line, to all application of front and rear setbacks on the longer dimensions of the lot and side setbacks based on shorter dimensions of lot. The ordinance establishes front and rear based on the shorter dimension and side setbacks based on the longer dimension. Mr. Robertson reviewed staff comments with the Board. Mr. Rodger Tully, owner, reviewed the request with the Board. There being no comments, Mr. Wolff closed the public hearing. Board of Zoning Appeals March 29, 2021 Page 3 of 3 Ms. Stevens moved for approval based on the findings that the house faces Adluh, and that the trees will be protected with this orientation and has met all criteria to grant a variance. Mr. Hopkins seconded the motion. All in favor. H. Approval of Final Orders The Board signed final orders. There being no further business, the meeting adjourned at 6:35 pm. Submitted by, L.
