STAFF REPORT
Present: Louisa Montgomery, Chair, Gene Gallogly, Robert Crosland,
Anne Shaw, Corey Barber.
Staff: Kate Miller, Kristen Forbus, Joe Juan, Aaron Bennett,
Jane Yager-Baumrind
Ms. Montgomery called the meeting to order 5:00 pm.
I. Approval of Agenda
Mr. Crosland moved to approve the agenda. Mr. Gallogly seconded the motion.
All in favor.
II. Approval of Minutes July 11, 2022 Meeting
Mr. Crosland moved to approve the minutes. Mr. Gallogly seconded the motion.
All in favor.
III. Correspondence
All correspondence received was linked to the agenda and distributed to the
Commission.
IV. General Public Comment
There being no public comment, Ms. Montgomery continued with the agenda.
V. Consent Motions
Mr. Crosland moved for consent approval of the following items:
➢ 305 Pitt Street – Survey 5921/ Historic (TMS 532-05-00-005) Applicant is
seeking final approval for new/replacement windows.
➢ 231 Bennett Street – Survey 6137/ Historic (TMS 532-01-00-012) Applicant is
seeking final approval for alterations to previously approved fence.
Ms. Shaw seconded the motion. All in favor.

VI. Business
A. 101 Middle Street - Survey 6019/ Non-Historic (TMS 532-09-00-001)
Applicant is seeking final approval for addition, pool, hardscaping, and
fencing.
Ms. Miller reviewed staff comments with the Commission.
Mr. Steven D’Amato, Remark Studio, reviewed the request with the
Commission.
Mr. Crosland moved for approval with approval by staff for pool utilities.
Mr. Gallogly seconded the motion. All in favor.
B. 975 Pitt Street – No Survey / Non-Historic (TMS 532-13-00-033)
Applicant is seeking final approval for paint color.
Ms. Miller reviewed staff comments with the Commission.
Ms. Nicole Vieth, Bill Huey & Associates, reviewed the request with the
Commission.
There being no comment, Ms. Montgomery moved Commission questions.
Mr. Crosland moved to approve as presented with the IPE remaining
unfinished and IPE approved for the deck and stairs as well. Mr. Gallogly
seconded the motion. All in favor.
C. 305 Pitt Street – Survey 5921/ Historic (TMS 532-05-00-005) Applicant is
seeking final approval for new/replacement windows.
This item was approved by a consent motion.
D. 111 Hyer Street – Survey 6077/ Non-Historic (TMS 532-09-00-059)
Applicant is seeking preliminary comment for demolition, new
construction, hardscaping, accessory structure, and pool.
This item was removed from the agenda due to an ordinance compliance
issue.

E. 101 Mary Street – Survey 6256/ Non-Historic (TMS 517-15-00-067)
Applicant is seeking preliminary comment for partial demolition,
alteration, addition, and hardscaping.
Ms. Forbus reviewed the staff comments with the Commission.
Ms. Nicole Vieth, Bill Huey & Associates, reviewed the request with the
Commission.
There being no public comment, Ms. Montgomery moved to Commission
questions.
The Commission provided comments.
F. 926 Pitt Street – Survey 5973/ Non-Historic (TMS 532-13-00-051)
Applicant is seeking alterations to previously approved plans.
Ms. Forbus reviewed the agenda item with the Commission.
Mr. Phil Clark, Clark Designs, reviewed the request with the Commission.
There being no comments, Ms. Montgomery moved to Commission
questions.
Mr. Crosland moved for denial of the alterations. Mr. Barber seconded the
motion. All in favor.
G. 302 Bank Street – Survey 6270/ Non-Historic (TMS 532-05-00-203)
Applicant is seeking final approval for hardscaping and fencing.
Ms. Forbus reviewed the staff comments with the Commission.
Mr. Steven D’Amato, Remark Studio, reviewed the request with the
Commission.
There being no comments, Ms. Montgomery moved to Commission
questions.

Mr. D’Amato provided his rebuttal for the Commission.
Mr. Crosland moved for conditional approval of the request excluding the
front yard, kitchen, dining, and firepit hardscaping areas per design guidelines,
Sidewalks, Driveway, and Streets #5. Ms. Shaw seconded the motion. All in
favor.
H. 231 Bennett Street – Survey 6137/ Historic (TMS 532-01-00-012)
Applicant is seeking final approval for alterations to previously
approved fence.
This item was approved by a consent motion.
I. 235 Haddrell Street – Survey 6259/ Non-Historic (TMS 517-15-00-110)
Applicant is seeking final approval for home alteration, addition, and pool
Ms. Forbus reviewed staff comments with the Commission.
Mr. Ryan Smith, Beau Clowney Architects, reviewed the request with the
Commission.
There being no comments, Ms. Montgomery moved to Commission questions.
Mr. Crosland moved for approval as presented subject to the fence meeting
the guidelines and approved by staff. Ms. Shaw seconded the motion. All in
favor.
Mr. Barber left at this time (6:45 pm).
J. 208 McCormick Street – No Survey / Non-Historic (532-09-00-263)
Applicant is seeking final approval for fencing.
Ms. Miller reviewed staff comments with the Commission.
Mr. Brian Maiden reviewed the request with the Commission.
There being no comments, Ms. Montgomery moved to Commission
questions.

Mr. Crosland moved for approval of option 1 with the fence and posts being
painted and plantings added between the two fences, or option 3 contingent
upon the Town removing the chain link fence. Ms. Montgomery seconded the
motion. All in favor.
VII. Staff Approvals
Ms. Miller reviewed the staff approvals with the Commission as follows:
a. 108 Beach Street – No Survey / Non-Historic (TMS 517-15-00-131) Adjust
pool design to meet setback.
VIII. Discussion and Action of Changes to Bylaws
Kate Miller reviewed the bylaw changes with the Commission.
Mr. Gallogly moved for approval to the bylaws as presented. Mr. Crosland
seconded the motion. All in favor.
IX. Discussion and Action of Changes to Design Guidelines
Ms. Miller reviewed the changes to design guidelines.
The Commission agreed that the following items should be included in the
guidelines:
➢ Add IPE or an equivalent material to materials list
➢ Clarify where contractor signs are allowed
Mr. Crosland moved to defer approval of the design guidelines to the next
meeting. Mr. Gallogly seconded the motion. All in favor.
X. Discussion of Items for Next Agenda
No other items were considered for next month’s agenda.
There being no further business, the meeting adjourned at 7:12 pm.
