Mr. Bustos called the meeting to order at 2:33 pm.
1. Approval of Minutes from the July 1, 2019 meeting
Mr. O’Rourke moved for approval of the minutes. Mr. Brimmer seconded the
motion. All in favor.
2. Public Comments
Mr. Larry Murray, Executive Director for Patriots Point Development Authority,
spoke regarding items regarding Patriots Annex project. He suggested that this
project is needed for Patriots Point to bring in additional revenue. He asked that
the request be approved.
Mr. James Wilson, representative for Patriots Annex, referred to the items
regarding the Patriots Annex project. He stated that this project would provide
access for the public to the water. He stated that in regard to the requested height,
they have amended their request in response to the Planning Commission
concerns. He stated that this project would create a destination for the citizens
and visitors and would generate revenue for the Town.
Mr. Scott Shellhaas, applicant for 1228 Melvin Bennett, stated that he would like
to withdraw the request to be included in the overlay district. He asked that the
request be approved for him to have his business office on the property.
Mr. Michael Carmody, 614 Palisades Drive, and representative for Walt Miller
estate, stated that the site has been marketed as having 80 foot height and would
like to keep the height for the property at 80 feet.

Mr. George Bixler, 144 3rd Ave, referred to short-term rentals and the fire that was
reported at the last Town Council meeting was started because of short-term rental
use. He stated that he wanted to clarify that the fire report indicated that the fire
was due to an electrical issue and not short-term renter.
Mr. Zach Moore, 1041 Marsh Court Lane, spoke regarding short-term rentals and
section 5B.2 of the ordinance. He suggested that this should be reviewed and
stricken from the ordinance as it is a violation of property rights. He also suggested
that in section 3A.1-3 and 3B.1-2 states that documentation should be kept and
suggested that electronic records should be considered and clarified in the
ordinance as well.
Mr. Walter Brown, III, 437 Venning St, expressed concern with the water tower. He
stated that they have been working with Mount Pleasant Waterworks (MPW) to
preserve the water tower. He asked that the Town and Committee deny the
request for installation of a 170 foot monopole cell tower.
Ms. Pat Sullivan, 1002 Plantation Court, spoke regarding item 6C (Halls Pond Road).
She suggested that the property is currently being used for businesses and has
outdoor storage, which is a violation of county ordinances. She asked that this
request be denied.
Ms. Pam Ireland, 820 Fiddlers Point Lane, spoke regarding the Miller Cadillac site.
She stated that she is opposed to 80 foot height within the Town, particularly near
the Wingo Way area. She suggested that a step up in height as was done with
Moultrie Shopping center should be considered.
Ms. Jane Direline, 1018 Lakeview drive, spoke regarding the Patriots Annex project
and stated that she is opposed to the rezoning request and inclusion in the Gateway
overlay district. She suggested that this property should be considered for
development as a state park and not utilized for hotels. She stated that she is
opposed to the height request of 80 feet as well. She expressed concern that this
project would increase traffic on Coleman Blvd.
Ms. Mary Ricozzi, 615 Bay Tree Court, spoke regarding short-term rentals and the
proposed fees. She suggested that short-term rentals are a home-based business

and fees should be assessed for and commiserate with all other home-based
businesses.
Ms. Lucy Gordon, 1551 Ben Sawyer, spoke regarding short-term rentals and
suggested that the penalty section should be reviewed and that violations should
be cumulative throughout each rental period and not count as one event. She
expressed concern with renewal of short-term rentals and that the use should not
be extended for a new owner if they apply within 60 days. She also expressed
concern with 80 foot building heights within the Town and asked that this be
reviewed and lowered.
Ms. Wendy Bauerschmidt, 1320 Woodlake Court, spoke regarding Patriots Annex
and that workforce housing should be considered for this project as it is much
needed in the Town. She suggested that without a plan for workforce housing at
the beginning of the project, workforce housing would not come to fruition. She
suggested that the height should be considered in trying to accommodate
workforce housing.
Mr. Thomas Donaldson, 1649 Lauda Drive, spoke regarding short-term rentals and
that the 1% cap should be reconsidered. He suggested that the cap would be very
restrictive and could affect needed additional income for citizens. He suggested
that if the 1% cap remains in effect, it should only apply where currently permitted.
He suggested that how applications are received should be considered as well.
Ms. Leigh Rowe, 105 Friend St, spoke regarding 125 Pitt Street and is in favor of
having this property designated as a historic property.
Ms. Louisa Montgomery, 404 Church St, spoke regarding designation of 125 Pitt
Street as a historic property and asked that this be approved.
Mr. Todd Richardson, 1200 Cutler Lane, spoke regarding item 6B. He suggested
that this should be approved. He suggested that the reduction of required canopy
trees and allowing up to 20% of the tree mitigation to be paid to the Tree Bank
would allow for more of these areas.
Ms. Alicia Lockwood, 316 Lapwing Lane, spoke regarding short-term rentals. She
suggested that a new application should not be required for renewal of a short-
term rental permit. She suggested that it would be beneficial to have a logo and

permit number included with the permit that could be posted. She suggested that
the fees are too high and that separate fees should be considered for whole house
or single room rentals. She also suggested that posting of the Town ordinances is
too onerous.
3. Annexations
a. A-10-19: Rifle Range Road. Request to annex an approximately 0.017 acre
tract of land located on Rifle Range Road, identified as being a part of TMS
No. 578-00-00-801 and depicted as New Right-Of-Way Parcels #2 and #3 on
a plat recorded by Charleston County ROD Office in Plat Book L18, Page
0411.
Mr. Ulma reviewed the request with the Committee.
Mr. Brimmer moved to recommend to Town Council approval of the
annexation. Mr. O’Rourke seconded the motion. All in favor.
4. Review of Planning Commission recommendations from the July 24, 2019
meeting
a. R-19-19: 1228 Melvin Bennett Road. Request to rezone one parcel from R-
1, Low Density Residential District, to OP, Office Professional District. Also
request to include subject parcel in the BOD, Boulevard Overlay District.

Mr. Ulma reviewed the request with the Committee. He stated that the
applicant has withdrawn the request to be included in the Boulevard Overlay
District. He stated that the Planning Commission recommended denial.
Mr. Brimmer moved to recommend to Town Council denial of the request.
Ms. Whitley seconded the motion. All in favor.
b. R-20-19: 1218-1220 Schirmer Avenue. Request to rezone one parcel from
NC, Neighborhood Commercial District, to R-1, Low Density Residential
District. Subject parcel is proposed to remain in the BOD, Boulevard
Overlay District. TMS No. 532-07-00-142
Mr. Ulma stated that the applicant has requested deferral.

Mr. Brimmer moved to defer the request to the next meeting. Mr. O’Rourke
seconded the motion. All in favor.
c. R-18-19: Patriots Point Road. Request to rezone from PD, Planned
Development District Ordinance, to WG-C, Cooper River Waterfront
Gateway District, a 30.32 acre portion of a larger 162.86 acre tract of land
and amend the official building height Plan map to allow up to 80 feet in
building height. TMS No. 517-00-00-001
d. Request approval of an impact assessment and conceptual plan of a 30.32
acre portion of a larger 162.86 acre tract of land, located on Patriots Point
Road, known as Patriots Annex. TMS No. 517-00-00-001
5. Review and potential action regarding a proposed Development Agreement
for Patriots Annex
Ms. Canon reviewed the request with the Committee. She stated that the
Planning Commission recommended approval of the zoning and impact
assessment, with denial of the height request.
Mr. O’Rourke moved to recommend to Town Council approval of the rezoning
request. Mr. Brimmer seconded the motion. All in favor.
Ms. Canon reviewed the height amendment request with the Committee. She
stated that based on concerns raised during the Planning Commission meeting, the
applicant has revised the height request and showed the graduated height change
on the map for the Committee.
Ms. Canon and Mr. Morrison reviewed the Impact Assessment with the
Committee. The Committee discussed traffic in the Patriots Point development,
particularly with this proposed project and the proposed National Medal of Honor
Heritage Center project and if the shared parking being proposed would be
sufficient. They also discussed the proposed height and if the request for 80 feet is
appropriate for this area.
Ms. Whitley moved to recommend to Town Council denial of the height request
for 80 feet. Mr. Bustos seconded the motion. Motion passed on a 3 to 1 motion
with Mr. Brimmer, Ms. Whitley, and Mr. Bustos in favor; Mr. O’Rourke opposed.

Mr. Brimmer moved to recommend to Town Council approval of the height map
with the change to allow 80 foot height for the resort and resort pool areas only to
achieve a step down in height. Motion failed due to the lack of a second.
Mr. O’Rourke moved to recommend to Town Council deferral of the Impact
Assessment and Development Agreement back to the Planning Committee for
discussion at their next meeting. Ms. Whitley seconded the motion.
Mr. Wilson noted that deferral would impact the lease agreement with the Patriots
Point Development Authority (PPDA). He stated that the applicant is willing to
meet to answer any questions or concerns prior to Town Council in order to not
delay the project.
Mr. O’Rourke withdrew his motion and Ms. Whitley withdrew her second.
Ms. Whitley moved to forward the Impact Assessment and Development
Agreement to Town Council with no Committee recommendation. Mr. Bustos
seconded the motion. All in favor.
6. Referred from Town Council back to Planning Committee
a. An Ordinance to amend Chapter 156, Zoning Code, of the Mount Pleasant
Code of Ordinances by adding a new section entitled Short Term Rentals.
The purpose of this new section is to define and regulate the use of
residential units as short term rentals in order to protect the integrity and
character of the Town’s existing neighborhood, as well as the health and
safety of occupants of Short Term Rental Units. (Ord. No. 19048)
Ms. Canon reviewed the request with the Committee. She stated that it was
referred back to the Committee in order to review some of the procedures, fees,
and parking requirements. She reviewed staff’s recommendations with the
Committee.
The Committee agreed that the draft ordinance should remain as approved at
first reading with the following changes:
➢ Include a tentative November 1st effective date
➢ Application fee should be reduced to $250
➢ Short-term rental permit will not transfer in the event of a change in home
ownership.

b. An Ordinance to amend Chapter 156 of the Mount Pleasant Code of
Ordinances by adding language in Section 156.225(E) to allow payment into
the Tree Bank in lieu of planting when the amount cannot be adequately
accommodated on site. (Ord. No. 19051)
Mr. Ulma reviewed the request with the Committee.
The Committee agreed not to change the 160 inches of trees per acre
requirement in place and allow payment of up to 20% of the 160 inch
requirement into the Tree Bank in lieu of planting.
c. An Ordinance to amend the Town of Mount Pleasant Comprehensive Plan
2009-2019 (2014 Update) Future Land Use Map pertaining to an
approximately 1.84 acre tract of land comprised of three parcels, located
at 1729 Halls Pond Road and 1740 and 1724 LaCannon Lane and depicted
on a plat recorded by the Charleston County ROD Office in Plat Book S19,
Page 0029 and Book W, Page 145, by changing the land use
recommendation from Community Conservation to Commercial. (Ord.
No. 19021)
Mr. Ulma reviewed the request with the Committee.
Ms. Whitley moved to recommend to Town Council denial of the request.
Mr. Bustos seconded the motion. All in favor.
7. Continued discussion of building heights in the Johnnie Dodds and Chuck
Dawley portions of the Boulevard Overlay District
Mr. Bustos stated that he requested this discussion. He suggested that the
height should be amended to be 45 feet at curb with a 55 foot step back for all
properties in Boulevard Overlay District. The Committee discussed whether 65 feet
might be more appropriate as opposed to moving from 80 feet to 55 feet.
The Committee agreed that the height should be transitioned from 80 feet to 65
feet and then 55 feet with staff bringing back a recommendation at next month’s
meeting.

8. Adoption: A Resolution providing for the addition of 125 Pitt Street to the List
of Historic Properties and Structures located in the Old Village Historic District
(OVHD) (Staff Report)
Mr. Ulma reviewed the request with the Committee. He stated that the Old
Village Historic District Commission (OVHDC) recommended approval.
Mr. O’Rourke moved to recommend to Town Council approval of the request.
Ms. Whitley seconded the motion. All in favor.
9. Update on Building Permit Allocation System (BPAS)
Mr. Ulma reviewed the request with the Committee.
Mr. Brimmer moved to recommend to Town Council that the number of
Accessory Dwelling Unit (ADU) permits be increased to an allocation of 25 permits
with the 15 additional permits taken from the single family allocation. Mr.
O’Rourke seconded the motion. All in favor.
There being no further business, the meeting adjourned at 4:52 pm.

a. An Ordinance to amend Chapter 156, Zoning Code, of the Mount
Pleasant Code of Ordinances by adding a new section entitled Short
Term Rentals. The purpose of this new section is to define and
regulate the use of residential units as short term rentals in order to
protect the integrity and character of the Town’s existing
neighborhood, as well as the health and safety of occupants of Short
Term Rental Units. (Ord. No. 19048)
b. An Ordinance to amend Chapter 156 of the Mount Pleasant Code of
Ordinances by adding language in Section 156.225(E) to allow
payment into the Tree Bank in lieu of planting when the amount
cannot be adequately accommodated on site. (Ord. No. 19051)
c. An Ordinance to amend the Town of Mount Pleasant Comprehensive
Plan 2009-2019 (2014 Update) Future Land Use Map pertaining to an
approximately 1.84 acre tract of land comprised of three parcels,
located at 1729 Halls Pond Road and 1740 and 1724 LaCannon Lane
and depicted on a plat recorded by the Charleston County ROD
Office in Plat Book S19, Page 0029 and Book W, Page 145, by
changing the land use recommendation from Community
