TOWN OF MOUNT PLEASANT, SOUTH CAROLINA PLANNING COMMITTEE APRIL 4, 2022 MINUTES Municipal Complex, Council Chambers PowerPoint Presentation Dominion Energy Presentation Present: Guang Ming Whitley, Chair, Howard Chapman, Laura Hyatt, Brenda Corley. Staff: Eric DeMoura, David Pagliarini, Michele Reed Ms. Whitley called the meeting to order at 3:30 pm. 1. Approval of Minutes from the February 28, 2022 meeting and the February 28, 2022 special meeting Mr. Chapman moved for approval of the minutes. Ms. Corley seconded the motion. All in favor. 2. Public Comments Ms. Jenitza Laguna, 1179 Camellia Drive, asked that the number of persons allowed for an ADU be increased to four persons when there are two bedrooms. Ms. Laurie Bixler, 144 3rd Ave, spoke regarding short-term rentals. She stated that she appreciates the Town having regulations in place for short-term rentals. She asked that the Committee continue to consider what is good for the Town and those that currently have short-term rentals. 3. Presentation by Dominion Energy on upcoming tree trimming projects in Mount Pleasant Ms. Jennifer Hightower, Mark Branham, and Clay Chaplain, Dominion Energy, reviewed current and future projects with the Committee. Mr. Branham stated that they have just started project H19 section A. He stated that they do notify the residents when they are starting the project that includes the customer service number to contact with any concerns or questions. Mr. Chaplain reviewed the specifications for trimming around the power lines with the Committee. Planning Committee April 4, 2022 Page 2 of 5 The Committee discussed how to better educate the public on these projects and what is appropriate tree trimming. Mr. Branham suggested that a community meeting or workshop could be scheduled. The Committee also discussed having the HOAs notified and that holding neighborhood meetings could be beneficial. 4. Budget Review FY 2023 a. Planning, Land Use and Neighborhoods General Fund operating expenditures b. Planning, Land Use and Neighborhoods Capital Fund projects and maintenance expenditures Mr. DeMoura reviewed the PLAN Department budget with the Committee. The Committee discussed code enforcement and if more staff is needed. Ms. Reed stated that a livability task force has been established that would allow for better coordination between the various departments and better address enforcement issues. Mr. Chapman moved to recommend to the Budget Committee approval of the Planning, Land Use, and Neighborhoods departmental budget for FY 2023. Ms. Corley seconded the motion. All in favor. 5. Discussion and possible action related to amendments to the Town’s parking requirements Ms. Reed and Mr. Pagliarini reviewed the request with the Committee. Mr. Chapman moved for businesses to delineate parking for customers only. Ms. Hyatt seconded the motion. Motion failed on a 2 to 2 vote with Mr. Chapman and Ms. Hyatt in favor; Ms. Corley and Ms. Whitley opposed. 6. Annexations a. A-06-22. 2173 Annie Laura Lane. Request to annex a parcel located at 2173 Annie Laura Lane, identified by TMS No. 558-00-00-248 and depicted as Lot 2B on a plat recorded by the Charleston County ROD Office in Plat Book BW, Page 018. b. A-07-22. 2175 Annie Laura Lane. Request to annex a parcel located at 2175 Annie Laura Lane, identified by TMS No. 558-00-00-327 and depicted as Lot Planning Committee April 4, 2022 Page 3 of 5 2A on a plat recorded by the Charleston County ROD Office in Plat Book BW, Page 018. Mr. Chapman moved to recommend to Town Council approval of annexations for 2173 and 2175 Annie Laura Lane. Ms. Corley seconded the motion. All in favor. c. A-08-22. Crystal Drive. Request to annex an approximately 1.54-acre tract of land located between Crystal Drive and Billy Swails Boulevard, identified by TMS No. 578-00-00-163 and depicted as Lot 4 on a plat recorded by the Charleston County ROD in Plat Book M, Page 053. Ms. Reed reviewed the request with the Committee. Ms. Hyatt moved to recommend to Town Council approval of the annexation request. Mr. Chapman seconded the motion. All in favor. 7. Review of Planning Commission Recommendation from March 23, 2022, meeting a. R-06-22. Request to rezone from R-1, Low Density Residential District, to RC-2, Rural Conservation -2 District, an approximately 2.51-acre tract of land located at 1490 Old Rosebud Trail and identified by TMS No. 615-00- 00-025. Parcel is not incorporated in the Pepper Plantation PD, Planned Development, there is no request to do so at this time. Planning Commission recommended approval (8-0) Ms. Reed reviewed the request with the Committee. Ms. Corley moved to recommend to Town Council approval of the request. Mr. Chapman seconded the motion. All in favor. 8. Discussion and possible action regarding the Town’s definitions for Family and Single-Family Dwelling Mr. Chapman stated that he asked for this to be included on the agenda. Ms. Reed reviewed the request with the Committee. Planning Committee April 4, 2022 Page 4 of 5 The Committee discussed if the definition should be amended. The Committee agreed that this should be further addressed during the code rewrite. 9. Discussion and Possible action regarding the Town’s maximum occupancy for an Accessory Dwelling Unit Ms. Reed reviewed the request with the Committee. Mr. Iacofano stated that changing the number to 2 per bedroom to allow for more affordable housing within the Town. Ms. Corley moved to recommend to Town Council amending the number of persons allowed for an ADU to up to four. Ms. Whitley seconded the motion. Motion failed on a 2 to 2 vote with Ms. Corley and Ms. Whitley in favor; Mr. Chapman and Ms. Hyatt opposed. 10. Discussion and Possible action regarding the Town’s Short Term Rental Program Ms. Reed reviewed the request with the Committee. The Committee discussed whether a deadline date for resubmittal of applications for a permit should be considered. Mr. Chapman moved to refer this issue to the Planning Commission for a public hearing. Ms. Hyatt seconded the motion. All in favor. 11. Discussion and possible action regarding the Town’s current residential density in Commercial zoning districts Ms. Hyatt stated that she asked for this discussion. She suggested that this should be considered ahead of completing the code rewrite. Ms. Reed reviewed the zoning requirements with the Committee. The Committee discussed the density currently allowed and if it should be further reduced. Planning Committee April 4, 2022 Page 5 of 5 Ms. Corley moved to send this issue to Town Council for discussion. Ms. Hyatt seconded the motion. Motion failed on a 2 to 2 vote with Ms. Corley and Ms. Hyatt in favor; Ms. Whitley and Mr. Chapman opposed. 12. Executive session - Discussion and the receipt of legal advice relating to pending litigation entitled CKC Properties, LLC vs. Town of Mount Pleasant, et al, 2021CP1004416, 2021CP1004761, and 2021CP1005211 Mr. Chapman moved to enter into executive session for legal advice. Ms. Corley seconded the motion. All in favor. The Committee convened into executive session at 4:48 pm. and reconvened at 5:16 pm. No action taken while in executive session. 13. Post Executive Session Mr. Chapman to recommend to Town Council the course of action as discussed in executive session. Ms. Corley seconded the motion. All in favor.
