TOWN OF MOUNT PLEASANT, SOUTH CAROLINA PLANNING COMMITTEE SEPTEMBER 6, 2022 MINUTES Municipal Complex, Council Chambers PowerPoint Presentation Present: Guang Ming Whitley, Chair, Laura Hyatt, Howard Chapman, Brenda Corley. Staff: Eric DeMoura, Michele Reed, David Pagliarini 1. Call to order Ms. Whitley called the meeting to order at 1:31 pm. 2. Approval of Minutes from the August 1, 2022 meeting Mr. Chapman moved for approval of the minutes. Ms. Corley seconded the motion. All in favor. 3. Public Comments Mr. Trey Sedalik, Mr. Gregg Minton, and Mr. Mike Johnson, stated that they are here for any questions on the Holliday Farms Impact Assessment request. Ms. Laurie Bixler, 144 3rd Ave, spoke regarding short-term rentals and suggested that there are several items she would like to bring to the Committee’s attention for consideration: ➢ Limit each parcel to one permit ➢ Change permit type to either owner on-site and owner not on-site, with the owner on-site being charged $250 and an owner not on-site being charged $500. ➢ Consider regulations similar to what Atlanta, GA has implemented where a permit is only issued for a homeowner’s primary residence. ➢ Form an advisory committee made up of STR operators Ms. Michelle Whitbeck, 712 Hibbens Grant Blvd, spoke regarding short-term rentals. She asked that the Committee consider the following items: ➢ Change verbiage regarding 6% property tax to only require documentation for up to three years Planning Committee September 6, 2022 Page 2 of 4 ➢ Delinquency of any taxes or fees would be considered a violation. This should be clarified as to when a violation would be issued, such as if one payment is missed, several missed, etc. Also, the property and accommodation taxes are administered and tracked by Charleston County. ➢ Revocation of permits if the STR permit and business license permit numbers are not included in all advertisement. It should be clarified when revocation would occur and if any notice is provided to correct the issue. Ms. Mary Ricozi, 136 Heritage Circle, spoke regarding the increase in fees for a short-term rental permit and suggested that the program should pay for itself. She suggested that the penalties should be reviewed as well and should be included in revenue generated through this program. 4. Annexations A. Request to annex five parcels located on Rifle Range Road and Willow Pond Road, identified by TMS Nos. 578-00-00-057, -060, -061, -318, and -319, and depicted on a plat recorded by the Charleston County ROD Office in Plat Book CF, Page 99 and Plat Book S, Page 130. Mr. Chapman moved to recommend to Town Council approval of the annexation request. Ms. Corley seconded the motion. All in favor. 5. Review of Planning Commission recommendations from August 24, 2022 A. R-17-22. 1619 Highway 41. Request to rezone from R-1, Low Density Residential District, to CC, Community Conservation District, an approximately 1.0-acre tract of land located at 1619 Highway 41, identified by TMS No. 583-00-00-109, and depicted on a plat recorded by the Charleston County ROD Office in Plat Book AB, Page 043. Planning Commission recommended approval Ms. Reed reviewed the request with the Committee. Ms. Hyatt moved to recommend to Town Council approval of the request. Ms. Corley seconded the motion. All in favor. B. Short Term Rental Text Amendment. Proposal to amend Sections 156.340 - 156.345 of Chapter 156, Zoning Code, of the Mount Pleasant Code of Ordinances, pertaining to Short Term Rentals. Proposed is to Planning Committee September 6, 2022 Page 3 of 4 amend the ordinance to create two separate permits, one that is Part- time and rents between 15 and 72 days per year, and one that is Full- time and rents more than 72 days a year. Also proposed is to consider a fee increase for those operating Full-time, as well as enhanced parking requirements. Planning Commission recommended approval Ms. Reed reviewed the request with the Committee. Mr. Chapman moved to recommend to Town Council approval of the amendments as recommended by the Planning Commission including consideration of posing civil penalties of $1,000 per violation with the addition of limiting the issuance of a permit to one permit per parcel. Ms. Hyatt seconded the motion. All in favor. C. Holliday Farms Impact Assessment/Conceptual Plan. Request to approve Impact Assessment and associated Conceptual Plan for the properties located at 2233 and 2237 North Highway 17 (Between Home Depot and Christ Church Episcopal.) Proposed is to develop an approximately 8.48-acre shopping center and gas station. Property is further Identified by TMS Nos. 558-00-00-146 and 558-00-00-927. All parcels are zoned AB-2, Areawide Business-2 District. Planning Commission recommended approval Ms. Reed reviewed the request with the Committee. Mr. Chapman moved to recommend to Town Council approval of the impact assessment and conceptual plan as recommended by the Planning Commission with the following addition: ➢ Similar buffer as required by Christ Church and Home Depot with a masonry wall and plantings on the Primus tract side of the wall. Ms. Corley seconded the motion. All in favor. 6. Discussion and recommendation regarding the Town’s current residential density in commercial districts Ms. Reed reviewed the request with the Committee. Planning Committee September 6, 2022 Page 4 of 4 Ms. Hyatt moved to recommend to Town Council changing the density for residential uses in commercial districts to 4 units per acre with an additional 4 units per acre allowed if those additional units are workforce housing. Ms. Corley seconded the motion. Motion passed on a 3 to 1 vote with Ms. Corley, Ms. Whitley, and M. Hyatt in favor; Mr. Chapman opposed. 7. Discussion regarding Workforce Housing Terms of Affordability and possible incentives Ms. Reed reviewed the request with the Committee. She stated that the change in the number of years the workforce housing must remain in place would go to the September Planning Commission as a public hearing. The Committee received this as information. 8. Update on Zoning Code Rewrite Ms. Reed provided an update on the zoning code rewrite. The Committee received this as information and agreed that a special Planning Committee meeting should be held in November to review the draft zoning code. 9. Comprehensive Plan Implementation - Public Input Matters Ms. Reed updated the Committee on the upcoming PIM meetings. The Committee received this as information. 10.
