POLICE, JUDICIAL & LEGAL COMMITTEE Tuesday, September 7, 2021 Municipal Complex, Council Chambers 100 Ann Edwards Lane, Mount Pleasant, SC 29464 Minutes Members Present: Mayor Will Haynie, Chair, Jake Rambo, GM Whitley, Laura Hyatt Staff Present: Eric DeMoura, Chief Arnold, Deputy Tyrone Simmons, Laurie Wilson, David Pagliarini, General Counsel 1. Call to order Mayor Haynie called the meeting to order at 11:15 am. 2. Approval of Minutes from the July 6,2021 meeting Mayor Haynie asked that the minutes from July 6,2021 meeting be approved. Ms. Hyatt made the motion for approval of the minutes; seconded by Ms. Whitley. Motion carried unanimously. 3. Public Comments No Public Comments. 4. Police matters a. Employee years of service recognition Chief Arnold stated that all employees to be recognized were unavailable and would be recognized in house at a later date. b. Discussion and possible action regarding Mount Pleasant Code of Ordinances Chapter 94, Parades, Demonstrations, Public Assemblies and Picketing Police, Judicial & Legal Committee September 7, 2021 Page 2 of 2 Mr. Pagliarini stated the changes had been made from first reading but there were 2 issues that are in the forefront that needed considered before second reading. Discussion followed. It was decided that no motion needed to be made at this time. 5. Judicial matters No Agenda Items 6. Legal matters No Agenda Items 7. Review of Planning Commission recommendations from the August 18, 2021, meeting a. Proposal to amend Chapter 156, Zoning Code, of the Mount Pleasant Code of Ordinances, by adding a new section establishing Shem Creek Waterfront District, amendments pertain to establishing boundaries, permitted uses and the provision of development standards for this District. Affected code sections include 156.007, 156.326, 156.310, 156.318, 156.314, 156.328. b. Request to amend the ION PD. Planned Development District Ordinance, (Ordinance No. 97010, as amended) by revising Neighborhood Standards. Specifically requested is to amend Telephone (843) 884-8517 - Fax (843) 856-2180 www.tompsc.com Item 1 in the PD referencing Outbuildings to exclude roof overhangs and eaves from counting toward Maximum Footprint calculations of 625 square feet. c. Oyster Park Impact Assessment and Planned Development Ordinance. Planning Commission Recommended Amendments. Includes two (2) separate requests related the 13.57-acre Mixed- Use Development known as Oyster Park, located off Ben Sawyer Boulevard between Rifle Range Road and New Parish Way. First is to rezone the entire development from AB, Areawide Business District, to PD, Planned Development District. Second is to approve an Impact Assessment and associated Conceptual Plan. d. Proposal to amend Zoning Code Section 156.075 Building Permit Allocation System. Amendment pertains to the provision regulating the allocation timeline to accurately reflect the intended six-month allocation period, specifically for the second half of the cycle to be made available on July 1 of each year, as opposed to the currently adopted date of June 1. e. Proposal to amend Zoning Code Section 156.107 Modifications of Yard Regulations. Amendment would allow for administrative relief from the ordinance provision establishing the front yard setback on lots where structures were legally constructed prior to ordinance adopted August 13,1979. 7. Discussion and action as well as a review of Planning Commission recommendations regarding the Town’s definition for hotels, parking requirements, and their appropriateness in the NC, Neighborhood Commercial Zoning District. 8.
