TOWN OF MOUNT PLEASANT, SOUTH CAROLINA POLICE, JUDICIAL & LEGAL COMMITTEE Monday, April 4, 2022 12:45 p.m. Municipal Complex, Council Chambers 100 Ann Edwards Lane, Mount Pleasant, SC 29464 Minutes Present: Mayor Will Haynie, Chair, Howard Chapman, G.M. Whitley Absent: Carl Ritchie Staff: Eric DeMoura, Chief Mark Arnold, Laurie Wilson, David Pagliarini, General Counsel 1. Call to order Mayor Haynie called the meeting to order at 12:51 pm. 2. Approval of Minutes from the February 28, 2022 meeting Mayor Haynie called for a motion to approve the minutes from February 28, 2022. Mr. Chapman made the motion to approve the minutes; seconded by Ms. Whitley. Motion carried unanimously. 3. Public Comments Christopher Coleman of 118 Pitt St spoke about the 65 decibel levels. He asked to give the citizens a chance to produce a better ordinance. Debbie Nuttall (no address given) asked to seriously consider the noise ordinance which has greatly impacted her life. She would like to sit on her porch in quiet. Harold Wilkin of 2605 Turbin Pl. spoke about his concerns about speed bumps in the Planters Point neighborhood. Mike Tinkey of 208 Venning St. spoke about his objection to the new noise ordinance and stated that the old one was better. He stated that the 65-decibel level is way too high. He encouraged committee to defer. Louisa Montgomery of 404 Church St. expressed her concern about Kent Prause and his expertise to discern decibel levels. Eric Fornell of 256 Magwood spoke about his concern that the decibel levels are going up. He is protective of his hearing and its getting out of hand for him. Lewis Horton of 138 Live Oak Dr. discussed his concern about the 65 decibel levels and stated it was a real problem. 4. Police matters a.Budget Review FY 2023 i.Police Department General Fund operating expenditures ii.Police Department Capital Fund projects and maintenance expenditures Mr. DeMoura discussed the proposed Police Department Budget. Discussion followed. Mayor Haynie recommended that the Police Budget go to full Council for approval. Motion made by Ms. Whitley and seconded by Mr. Chapman. Motion passes unanimously. 5. Judicial matters a.Budget Review FY 2023 i.Court Administration General Fund operating expenditures ii.Court Administration Capital Fund projects and maintenance expenditures Mr. DeMoura discussed the proposed Judicial Department Budget. Discussion followed. Mr. Chapman recommended that the Judicial Department Budget go to full Council for approval. Motion made by Mr. Chapman and seconded by Ms. Whitley. Motion passes unanimously. 6. Legal matters a.Budget Review FY 2023 i.Legal Department General Fund operating expenditures Mr. DeMoura discussed the proposed Legal Department Budget. Discussion followed. Ms. Whitley moved to recommend to full Council the approval of the Legal Department budget. Motion seconded by Mr. Chapman. Motion passes unanimously. b. Update and possible action on ordinance to repeal and replace Section 132.03 titled Noise of the Mount Pleasant Code of Ordinances Revised ordinance with edits Revised ordinance clean version Continued discussion of the noise ordinance was summarized by Ms. Whitley moving to recommend to full Council a 3-month pilot program with a decibel level of 55 measured from the compliant s property and gather data before processing with a noise ordinance. Mr. Chapman seconded the motion. Mr. Pagliarini recommended submitting to full Council a draft ordinance. This would be a Committee action item and not listed under Council action ordinances. Motion passes unanimously. c. Executive Session - legal advice related to potential litigation concerning sewer service Ms. Whitley moved to go into executive session. Seconded by Mr. Chapman. Motion passes unanimously. Committee entered executive session at 1:36 pm. d.Post Executive Session Committee reconvened at 1:54pm. Committee may take action on any item, including any subsection of any section, listed on an executive session agenda or discussed in an executive session during a properly noticed meeting. 7.Adjourn There being no further business, the meeting was adjourned at 1:54 pm.
