TOWN OF MOUNT PLEASANT, SOUTH CAROLINA POLICE, JUDICIAL & LEGAL COMMITTEE Monday, May 2, 2022 11:15 a.m. Municipal Complex, Council Chambers 100 Ann Edwards Lane, Mount Pleasant, SC 29464 Minutes Members Present: Mayor Will Haynie, Chair, Carl Ritchie, GM Whitley, Howard Chapman Staff Present: Eric DeMoura, Christiane Farrell, Chief Arnold, Deputy Chief Tyrone Simmons, Laurie Wilson, David Pagliarini, General Counsel Also: William DeFord, Marcy Cotov 1. Call to order Mayor Haynie called the meeting to order at 11:37 am. 2. Approval of Minutes from the April 4, 2022 meeting Mayor Haynie asked that the minutes from the April 4, 2022 meeting be approved. Mr. Chapman made the motion for approval of the minutes; seconded by Mr. Ritchie. Motion carried unanimously. 3. Public Comments Perry Rourk of 2004 Brick Kiln Parkway was present today in reference to item 6 b & c in regard to public comments during public meetings. Mr. Rourk wanted to reiterate that he is in full support of people being allowed the full 3 minutes as per Town ordinance. 4. Police matters a. Employee years of service recognition Police, Judicial & Legal Committee May 2, 2022 2 Chief Arnold stated that he would like to recognize 4 officers for their years of service. He recognized Officers Baxter and Mathewes for five years and Officers Calabrese and Plyler for 15 years. 5. Judicial matters No agenda items 6. Legal matters a. Discussion and possible action regarding an amendment to Section 30.34 of the Mount Pleasant Code of Ordinances entitled Executive Session Mayor Haynie state that the HR committee had just discussed this in length and the outcome was that it would go back to HR next month. Mr. Pagliarini stated his thoughts were to take comments from the PJL and HR committees, aggregate them and bring them back in a more coherent ordinance that may be ready for Council next month. Discussion followed. b. Discussion and possible action related to public comment and allotted time during public meetings Mr. Pagliarini stated that items b & c were fairly similar in nature being related to public comments and actions and stated he would set up the big picture with both of those included. Discussion followed. Police, Judicial & Legal Committee May 2, 2022 3 c. Discussion and possible action on a proposed ordinance regarding decorum during public meetings d. Discussion and possible action regarding an amendment to Section 51.092 of the Mount Pleasant Code of Ordinances entitled Annexation for Sewer Service Mayor Haynie introduced Mr. Allan Clum, General Manager of Mount Pleasant Waterworks and asked him to frame the issue of what is possible involving Waterworks getting ARPA grant funding through the State to extend some sewer lines. Discussion followed. Mr. Chapman moved to recommend to full Council this additional ordinance. Mayor Haynie asked for some advice on the “as of” date for this so it could be referred to Council as well. Discussion followed. Mr. Ritchie seconded the motion. Further discussion followed. Ms. Whitley moved to amend the motion to say one residential equivalent unit per existing septic system as of the date of the passage of the ordinance not limited to individual parcels. Mr. Ritchie seconded the amended motion. All present were in favor of the motion as amended. Police, Judicial & Legal Committee May 2, 2022 4 e. Executive session for the receipt of legal advice related to the proposed amendment of Section 51.092 of the Mount Pleasant Code of Ordinances entitled Annexation for Sewer Service. It was decided by the committee that no Executive Session was necessary at this time. f. Post Executive Session Committee may take action on any item, including any subsection of any section, listed on an executive session agenda or discussed in an executive session during a properly noticed meeting. 7.
