TOWN OF MOUNT PLEASANT, SOUTH CAROLINA POLICE, JUDICIAL & LEGAL COMMITTEE Monday, June 6, 2022 11:15 a.m. Municipal Complex, Council Chambers 100 Ann Edwards Lane, Mount Pleasant, SC 29464 Minutes Members Present: Mayor Haynie, Chair, GM Whitley, Howard Chapman, Members Absent: Carl Ritchie Staff Present: Eric DeMoura, Christiane Farrell, Chief Mark Arnold, Deputy Chief Tyrone Simmons, Laurie Wilson, David Pagliarini, General Counsel 1. Call to order Mayor called the meeting to order at 11:15 am. 2. Approval of Minutes from the May 2, 2022 meeting Mayor Haynie asked that the minutes from the May 2, 2022, meeting be approved. Mr. Chapman made the motion for approval of the minutes; seconded by Ms. Whitley. Motion carried unanimously. 3. Public Comment Kevin Cunnane of 3032 River Vista Way discussed protected free speech and the alleged abuses thereof. Will Haynie of 316 Mallard Court introduced documents from a police report from the Town of Mount Pleasant and a newspaper report to minutes that were approved by our legal counsel. Employee years of service recognition Chief Arnold stated that the employees to be recognized are out of town and they will be recognized internally. 5. Judicial matters a. Employee years of service recognition Laurie Wilson recognized Kimberly Gaillard for 15 years of service. 6. Legal matters a. Update on Noise Ordinance Pilot Program Chief Arnold discussed the data collection of the Noise Ordinance Pilot Program. This is a 90-day program which started on May 1st. It may be extended if Council wishes. b. Discussion and possible action related to public comment and allotted time during public meetings David Pagliarini, General Counsel, discussed the allotted time for public comments during public meetings. Discussions continued regarding individuals who sign up for public comment on items on the agenda having preference to speak first. Those who sign up and would like to speak on items that are not on the agenda are invited to speak afterward. Ms. Whitley made a motion to recommend the adoption of this change to full council; seconded by Mr. Chapman. Motion carried unanimously. Discussion and possible action on a proposed ordinance regarding decorum during public meetings David Pagliarini discussed review of other ordinances that address disturbances on public property. Mr. Pagliarini stated that two ordinances are in place and can be extended to include Public Officials. Mayor Haynie would like to see it extended to town property as well. Discussions followed. Mayor Haynie recommended that this discussion be brought back next month this revised. Ms. Whitley made the motion to revisit this next month, seconded by Mr. Chapman. Motion carried unanimously. d. Executive Session - Receipt of legal advice relating to pending litigation entitled CKC Properties, LLC vs. Town of Mount Pleasant, et al, 2021CP1004416, 2021CP1004761, and 2021CP1005211 Ms. Whitley moved to go into executive session. Seconded by Mr. Chapman. Motion passes unanimously. Committee entered executive session at 11:39 am. e. Post Executive Session Committee reconvened at 12:11 pm. No action taken. No votes were cast. Committee may take action on any item, including any subsection of any section, listed on an executive session agenda or discussed in an executive session during a properly noticed meeting. 7.
