TOWN OF MOUNT PLEASANT, SOUTH CAROLINA POLICE, JUDICIAL & LEGAL COMMITTEE Tuesday, January 3, 2023 11:15 a.m. Municipal Complex, Council Chambers 100 Ann Edwards Lane, Mount Pleasant, SC 29464 MINUTES Members Present: Mayor Will Haynie, Chair, Howard Chapmen, GM Whitley and Carl Ritchie Staff Present: Eric DeMoura, Chief Arnold, Deputy Chief Simmons, Laurie Wilson, David Pagliarini, General Counsel 1. Call to order Mayor Haynie called the meeting to order at 11:15 am 2. Approval of Minutes from the December 5, 2022 meeting Mayor Haynie asked that the minutes from the December 5, 2022, meeting be approved. Mr. Chapman made the motion for approval of the Minutes; seconded by Ms. Whitley. Motion carried unanimously. 3. Public Comments Kevin Cunnane of Mount Pleasant spoke in reference to the Mayor Pro Tem position and some concerns he has with the position being rotational. 4. Police matters a. Employee years of service recognition Chief Arnold recognized Kenneth Clark for his 5 years of service. 5. Judicial matters No agenda item Police, Judicial & Legal Committee January 3, 2023 2 6. Legal matters a. Employee years of service recognition David Pagliarini recognized Trisha Hughey for her 30 years of service. b. Discussion and possible action regarding the annual rotation of the Mayor Pro Tem position Mr. Pagliarini gave a description of the responsibilities and duties of the Mayor Pro Tem. Discussion followed. Mr. Chapman moved to revise the current ordinance to have an annual election of the Mayor Pro Tem position prepared for presentation to full council. Mr. Ritchie seconded the motion. All were in favor. c. Continued discussion and possible action regarding An Ordinance to enact Section 43.02 titled Memorials and Monuments Policy of the Mount Pleasant Code of Ordinances (Ord. No. 22065) and discussion and possible action regarding pending memorials on Town property Mayor Haynie stated that this ordinance has passed first reading and was asked to come back to this committee for revisions. Discussion followed. Mr. Ritchie moved to create an exemption carving out the 3 projects discussed: 9/11 Memorial, Captain Magwood Memorial and the Officer Vaughn Kee Memorial so that they continue in the process they are already in. Mr. Chapman seconded the motion. Discussion followed. Police, Judicial & Legal Committee January 3, 2023 3 The vote was taken, and all were in favor. d. Continued discussion and possible action regarding an ordinance to repeal and replace Section 132.03 titled Noise of the Mount Pleasant Code of Ordinances (Ord. No. 22049) Mayor Haynie stated that encouraged anyone on Committee who had not gone out with a decibel reader to do so. He stated that he feels that it is understood now that one size does not necessarily fit all and delineation would need to be made between those within residential districts and those that are not. He added that the Committee would be hearing from some community groups today. Discussion followed. e. Executive Session – update on pending litigation entitled CKC Properties, LLC vs. Town of Mount Pleasant, et al (2021- CP-10-4416; 2021-CP-10-4761; and 2021-CP-10-5211), WIN515, LLC vs. Town of Mount Pleasant, et al (2021-CP-10-5653), Justin O’Toole Lucey vs. Town of Mount Pleasant and WIN515, LLC (2022-CP-10-3328), Craig Thomas vs. Town of Mount Pleasant, et al (2022-CP-10-1837 and 2022-CP-10-2041), Dominion Energy South Carolina, Inc., et al vs. Town of Mount Pleasant (2022-CP-10-2725), Jennifer P. Strauss, et al vs. Town of Mount Pleasant, et al (2022-CP-10-4490), and Shem Creek Development Group, LLC v. Town of Mount Pleasant (2017-CP- 10-5493) Ms. Whitley moved that the Committee go into executive session. Mr. Chapman seconded the motion. All present were in favor. f. Post Executive Session Committee may take action on any item, including any subsection of any section, listed on an executive session agenda or discussed in an executive session during a properly noticed meeting. Review of Planning Commission recommendations from December 14, 2022, meeting A. R-21-22. Wilson Tract PD Amendment. Request to amend the Wilson Tract PD, Planned Development District Ordinance, specifically Sweetgrass Phase III Amenity Area, to allow for an expansion of the HOA amenity parcels that serves as boat storage for the neighborhood. Planning Commission recommended approval C. Text Amendment – Conditions on Residential Density. Proposal to amend Section 156.326, of Chapter 156, Zoning Code, of the Mount Pleasant Code of Ordinances, pertaining to Principal Use Conditions. Proposed is to amend the condition associated with density for residential uses in commercial districts, specifically to lower the maximum density from 12 units per acre to 4 units per acre but allow up to 8 units per acre if the additional 4 units are dedicated to attainable housing. Planning Commission recommended approval with a modifications D. Text Amendment – Environmental Guidelines for Land Development. Proposal to amend Chapters 155 and 156, of the Mount Pleasant Code of Ordinances, pertaining to the creation of a new environmental program to encourage low impact development (LID) techniques for multi-family, mixed use, industrial and commercial development. Proposed is to establish a point system to ensure meaningful LID techniques are incorporated into each design. More specifically, amendments are proposed for LDR 155.054 Greenspace Preservation and Protection Plan to create a new sub-title of 155.054 Residential Greenspace Preservation and Protection Plan, and Environmental Guidelines for Land Development, and adding (5) to 156.201(I) Bufferyards, and modifying 156.173 Area and Paving Requirements. Planning Commission recommended approval 6. Continued discussion and possible action regarding outstanding short-term rental ordinance amendments 7.
