PLAN COMMISSION MEETING MINUTES
September 20th at 1:00 PM
Village Hall, Ebe Auditorium

Staff Present: Community Development Director Sam Schultz, Planner II Robin Palm, Project Director Claude Lois,
Parks & Recreation Manager George Baumgardt and Community Development Intern Emily Wagner.
A. CALL TO ORDER
Chairperson Driver called the meeting to order at 1:02 PM.
B. ROLL CALL
Director Schultz performed roll call. Chairperson Driver, Trustee Washburn, Trustee Bhatia, Commissioner
Maier, Commissioner Bozinovski, Commissioner VanBeckum and Commissioner Risler were present.
C. MEETING MINUTES
1. Meeting of August 23rd, 2023
Motion by Trustee Bhatia to approve the minutes of August 23rd, 2023. Motion seconded by Commissioner
Maier. On voice vote, motion carried.
D. OLD BUSINESS
2. Ordinance 19-2023: Amending Code of Ordinances §90-510: Common Procedures, §90-620.50: Terms
Beginning with A, and §74-11.2: Specific Words and Phrases
R. Palm discussed how after the Zoning Ordinance Update of 2020, the village staff continue to update it
semiannually. The staff propose these updates to:
1. Keep up date with changes in state law;
2. Reflect any new village priorities;
3. Consider revision requests from the community;
4. Run quality assurance to catch errors and oversights; and
5. Run performance evaluations to see if certain ordinances are working as intended.
This batch of code updates stems from WI Act 16 and quality assurance revisions. They clarify the
Community Development Director’s revision authority on completed applications. They remove mention
of a newspaper of record, since the Village does not have one named, nor does it need one. It defines
the term “aggrieved” per the definition provided in Act 16 to clarify who can file an appeal of a zoning
decision, either to the Board of Zoning Appeals or to Circuit Court. It also references this definition
addition in Chapter 74. Village staff recommend the Plan Commission move to recommend approval of
Ordinance 19-2023. Motion by Trustee Washburn to approve Ordinance 19-2023. Motion seconded by
Commissioner VanBeckum. On voice vote, motion carried.
E. NEW BUSINESS
3. Pike River Crossing Final Plat FSP-23-4
Director Schultz discussed how Bear Development, LLC applied to plat the first phase of a mixed-use
neighborhood with 96 moderate-density lots intended for 60 detached homes and 36 twinhomes. The
Village Board approved the Final Plat in 2023; however, the applicant revised some lots on the north end
of the plat due to stormwater design. The subject parcels are 44.58 acres are zoned RM-2, B-3, and MX.
The properties lie within TID 6. The village staff and the Plan Commission recommend the Village Board
moves to approve the Pike River Crossing Final Plat FSP-23-4 subject to the recommended conditions.
Motion by Trustee Washburn to approve Pike River Crossing Final Plat FSP-23-4. Motion seconded by
Trustee Bhatia. On voice vote, motion carried.

4. 4930 90th Street Site Plan Review SP-23-20
Director Schultz discussed how on behalf of Microsoft, Duane Thomas (Dewberry) applied to update the
approved site plan for the first phase of the Microsoft data center development. Village approval of this
application, in coordination with approved building permits, will allow Microsoft to begin footings and
foundations construction across the approximately 215-acre southern portion of the property. Per the
applicant’s narrative, they will likely return to the Plan Commission and Village Board with updates to
aspects of the site plan as they continue the design and construction process. The Village staff recommend
that the Plan Commission moves to approves the 4930 90th Street Site Plan Review SP-23-20 subject to
the conditions for approval. Motion by Trustee Washburn to recommend approval of the 4930 90th Street
Site Plan Review SP-23-20 subject to the recommended conditions for approval. Motion seconded by
Commissioner Maier. On voice vote, motion carried.
5. Hansche Road Certified Survey Map; CSM-23-12
Director Schultz detailed how Edward Possing applied to create three new lots along Hansche Road. Lot
1 is proposed to be .225 acres, Lot 2 is proposed to be .272 acres, and Lot 3 is proposed to be .289 acres
to total .787 acres in land area. On the eastern side of these lots is the Union Pacific Railroad.
The village staff recommend the Plan Commission moves to approve the Hansche Road Certified
Survey Map; CSM-23-12 subject to the recommended condition. Motion by Trustee Bhatia to
recommend approval of the Hansche Road Certified Survey Map; CSM-23-12 subject to the
recommended conditions for approval. Motion seconded by Commissioner Risler. On voice vote,
motion carried.
6. Amendments Introduced

b. Discussion regarding draft zoning text amendments for §90-320.80(f)(1)(a), §90-540.100: Appeals
c. Discussion regarding draft zoning text amendment Division 90-550: Conditional Uses
d. Discussion regarding draft zoning text amendments Division 90-570: Appeals of Administrative
Decisions
Director Schultz detailed amendments he proposes to Ordinance 18-2023 regarding floor protection and
terminology. R. Palk discussed three draft zoning text amendments regarding appeals, conditional uses,
and appeals of administrative decisions. These amendments were all introduced today and therefore
will be voted upon in next month’s Plan Commission meeting. There were no votes to account for on
items a through d.
F. STAFF REPORTS
1. George Baumgardt, Parks and Recreation Manager
a. Campus Park Spring 2023 update
G. Baumgardt provided a quarterly update for the Parks and Recreation Department. 800
households signed up for the new software the department launched this last quarter. The
department also saw a 16% increase in participation in its parks program. The Trunk or Treat event
held by the Parks and Recreation Department will be held at Campus Park on October 21st. Last
weekend, a pickleball tournament was permitted at Campus Park, and the park’s most popular
feature through summer was the new splashpad.
2. Robin Palm, Planner II
a. Quarterly Planning Report
R. Palm discussed the municipal complaints accounted for over the last quarter, detailing notes
regarding completed and active complaints indicating record specifics as well as overall tallies. Progress
made regarding municipal cases that are pending court action as well as additional hearings were also
discussed. Lastly, active and completed planning records were discussed in detail with associated tallies
summarized.

Motion by Commissioner Maier to adjourn the meeting at 2:35 pm. Commissioner Risler seconded the
