PLANNING BOARD, ZONING BOARD OF APPEALS,
AND ARCHITECTURAL REVIEW BOARD.
WHEREAS, by letter dated December 14, 2021 tlie Mayor of tlie City of
Mount Vernon has requested legislation tliat membersliip on tlie tliree Land Use
Boards: the Plax'uying Board, Zoning Board, and Arcliitectural Review Board, shall
enumerate a residency requirement and require certification of said residency yearly;
and
WHEREAS, New York State Public Officers Law Article Two Section Tl'iree
states:, Qualifications for liolding office. "1. No person sliall be capable of holding
a civil office who shall not...be a citizen of tlie United States, a resident of tlie state,
and if, it is a local office, a resident of tl'ie political subdivision or municipal
corporation of the state for wliicli lie or slie shall be cliosen...;" NOW,
THEREFORE,

:'I'lie City of Mount Veriion, in City Coruicil, convened, does liereby ordain
and enact:
Section 1. Any person wlio is appointed to a position on the Planning
Board, Zoning Board of Appeals, or Arcliitectural Review Board (i) sliall be a
resident of tlie City of Mount Vei-non on tl'ie date tliat tliey enter service and (ii) sliall
after tliat maintain city residence as a condition of membersliip. Failure to maintain
city residence as required by this section sliall constitute a forfeiture of membersliip
on said Board; provided, liowever, tliat before dismissal for failure to maintain city
residency and said person shall be given notice of and tlie opportunity to contest the
cliarge tliat tlieir residence is outside tlie city.
. Section 2. Any person appointed to a position on tlie Planning Board,
Zoning Board of Appeals, or Arcliitectural Review Board sliall certify residency
yearly on a fori'n designated by tl'ie Corporation Corinsel within 30 days of the start
of a new year. Tlie oiiginal residency certification fonn sliall be submitted to the
City Clerk witli copies sent to tlie Mayor and tlie Corporation Counsel.

road and sidewalk conditions; and
WHEREAS, Street Scan operates like "Google Maps", as tlie device is
liooked to tlie veliicle and driven city-wide the imaging capabilities will capture
images of road conditions tliat it encoruiters along tlie way, potlioles will liave 3D
imaging for deptli and volru'iie. The Street Scan device will record all defects along
tlie roadway as yori drive and wl'ien all imagining is complete, it's uploaded in real-
time to Street Logix. Tlie sidewalk areas are traveled via Scan Cart, wliicl'i caphires
2D imaging of cracks and defects along tlie sidewalk; NOW, THEREFORE,
Tlie City of Moruit Vex-non, in City Council convened, does liereby ordain
and enact:
Section 1. Tlie Mayor is liereby aritliorized to enter into an agreement
witli SHI Intei-i'iational Cotp. / StreetScan, Inc. for scanning devices tliat have the

WHEREAS, 011 April 18, 2019, NFS LEASING filed a Notice of Claim
seeking tlie sum
of $1.3 million against the City of Mount Veinon for property
damage to claimant's property on June 1, 2018, wl'iich was allegedly damaged and
dismantled by tlie City; and
WHEREAS, tlie City of Mount Venion was served witli a suminons and
complaint on August 6, 2019; and
WHEREAS, tlie Corporation Counsel liereby recommends that the Board of
Estimate and Contract approve tlie settlement of the aforesaid claim in tlie amount
of $532,500.00; and
WHEREAS, tlie aforesaid settlement will be payable in three (3) equal
installments of $177,500.00 eacli witli tlie first payment made in January 2022,
second installment in Januai-y 2023 and tlie tliird and final payi'nent
in Januaty 2024;
NOW, THEREFORE, be it
RESOLVED, that tlie aforesaid claim of NFS LEASING be settled for the
sum of $532,500.00 and tliat said settlement be and the same hereby is approved;

WHEREAS, on Januat'y 13, 2021, DEERE CREDIT FINANCIAL CORP.
filed a lawsuit alleging a breach of contract against the City of Mount seeking the
sum of over $150,125.75; and
WHEREAS, tlie City entered into a lease agreement witli Deere Credit
Financial, Inc. for a piece of l'ieavy equipment known as a loader. The City stopped

a result of the City's failure to pay, the City was sued by Deere Credit. The Courts
detert'nined that the City was liable for tlie breacli of tlie lease; and
WHEREAS, tlie Cotporation Counsel hereby recommends that the Board of
Estimate and Contract approvetlie settlement of the aforesaid claim in the amount
of $120,125.75; NOW, THEREFORE, be it
RESOLVED, tliat DEERE CREDIT FINANCIAL CORP. be settled for the
sum of $120,125.75 and tliat said settlement be and tl'ie same hereby is approved;
and be it furtlier
RESOLVED, tliat said sum be paid out of Code A1930.494 (Judgi'nents &
Settlements), Law Depaitment 2021 Budget.
