Mayor DEC2 8 2021 WHEREAS, 011 April 18, 2019, NFS LEASING filed a Notice of Claim seeking tlie sum of $1.3 million against the City of Mount Veinon for property damage to claimant's property on June 1, 2018, wl'iich was allegedly damaged and dismantled by tlie City; and WHEREAS, tlie City of Mount Venion was served witli a suminons and complaint on August 6, 2019; and WHEREAS, tlie Corporation Counsel liereby recommends that the Board of Estimate and Contract approve tlie settlement of the aforesaid claim in tlie amount of $532,500.00; and WHEREAS, tlie aforesaid settlement will be payable in three (3) equal installments of $177,500.00 eacli witli tlie first payment made in January 2022, second installment in Januai-y 2023 and tlie tliird and final payi'nent in Januaty 2024; NOW, THEREFORE, be it RESOLVED, that tlie aforesaid claim of NFS LEASING be settled for the sum of $532,500.00 and tliat said settlement be and the same hereby is approved; and be it furtlier RESOLVED, tliat said sum be paid out of Code A1910.469 (Insurance Claims), 2021 Budget. I, Clerk DEC2 8 2021 WHEREAS, on Januat'y 13, 2021, DEERE CREDIT FINANCIAL CORP. filed a lawsuit alleging a breach of contract against the City of Mount seeking the sum of over $150,125.75; and WHEREAS, tlie City entered into a lease agreement witli Deere Credit Financial, Inc. for a piece of l'ieavy equipment known as a loader. The City stopped making the agi-eed upon payments as per its lease agreement witli Deere Credit. As a result of the City's failure to pay, the City was sued by Deere Credit. The Courts detert'nined that the City was liable for tlie breacli of tlie lease; and WHEREAS, tlie Cotporation Counsel hereby recommends that the Board of Estimate and Contract approvetlie settlement of the aforesaid claim in the amount of $120,125.75; NOW, THEREFORE, be it RESOLVED, tliat DEERE CREDIT FINANCIAL CORP. be settled for the sum of $120,125.75 and tliat said settlement be and tl'ie same hereby is approved; and be it furtlier RESOLVED, tliat said sum be paid out of Code A1930.494 (Judgi'nents & Settlements), Law Depaitment 2021 Budget.
