WHEREAS, by letter dated May 25, 2021, the Commissioner of the Department of Public Works has requested legislation authorizing permission for the City of Mount Vernon to take supervision of newly installed streetlights for a project located at 525 North MacQuesten Parkway; and WHEREAS, the Mount Vernon Planning Board approved the aforesaid project located at 525 North MacQuesten Parkway tliat include overhead power lines that have been buried and lower street lights have been installed; and WHEREAS, in order for Con Edison to remove the street poles along with the a older City-owned streetlights affixed to these poles, the City must take management of, the newly installed lights; and WHEREAS, the Department of Public Works is hereby designated as the agency to oversee the maintenance of the aforesaid streetlights; NOW, THEREFORE, The City of Mount Vernon, in City Council convened does hereby ordain and ' enact: Section 1. WHEREAS, by Ietter dated May 25, 2021, Councilwomai'i Janice Duarte has requested legislation authorizing tlie City Council to establish ari Investigative ' Committee and liost Legislative Hearings regarding "Memorial Field Escrow Account" in the amount of $3 million dollars; and WHEREAS, on December 1, 2020, during a Board of Estimate & Contract meeting, the City Comptroller stated on the record that "We don't have a Memoriai Field Escrow Account." This statement contradicts advice received from the Comptroller on August 14, 2019, aavising the City Council that the Office of the Comptroller establish a "Memorial Field Escrow Account" in the amount of $3 miIlion dollars; and WHEREAS, Tully Environmental, the awardee of the Memorial Field remediation project, has indicated their intentions to place a lien on Memorial Field witl'i the County for lack of final payment by the Comptroller; and WHEREAS, the Department of Public Works has submitted the required vcucher and supporting documents for payment to Tully Environmental, which the' Comptroller has not accepted; and IX'HEREAS, by contradictory statements by the Comptroller, the outstanding invoices, and lack of accounting is unacceptable to the people of Mont Vernon; and WHEREAS, the Mount Vernon City Council has continued to request an accounting of the escrow account and still has not received information. Third Street (Tax Lot 169.21-3014-21) ("Project"); and WHEREAS, the Zoning Petition has been forwarded to the Planning Board for a Recommendation to tlie City Council pursuant to Section 267-56 of the Zoning Code; and WHEREAS, upon review of the Zoning Petition by the City's Planning Staff and Plai'uiing and Legal Consultants, it was determined that the Applicant's proposal to allow self-storage facilities as a pennitted use throughout all of the CB Districts would not adequately ensure tl'ieir appropriate development or protect the surrounding neigliborhoods; and WHEREAS, the City's Planning and Legal Consultants have proposed to properly regulate self-storage facilities by establisliing them as a peri'nitted principal use in the I - Industrial and LI-7.5 Landscape Industrial Zoning Districts, and as a Special Perinit Use in tlie CB District, pursuant to certain requirements; and WHEREAS, the proposed Special Use Perinit criteria are designed to ensure that any self-storage facility is consistent with tlie design and intent of the CB District, and the character of the surrounding neighborhood; and WHEREAS, tlie Planning Board believes that any self-storage facility should activate the ground-level streetscape with high-quality retail use(s); and WHEREAS, the Applicant lias submitted a Market Study which, based upon the City's Planning and Legal Consultants' review, illustrates a demand for the proposed use; aiid WHEREAS, tlie Planning Board needs to ensure tliat the design of any self- storage facility, including its height and arcliitecture, is compatible with surrounding structures, including residences; and WHEREAS, the Planning Board has reviewed tlie enclosed recommended Text Amendment, and approves and endorses its creation; NOW, THEREFORE, BE IT RESOLVED, that upon full consideration of the above, the Planning Board of the City of Mount Vernon provides a recommendation in support of a -proposed Text Ai'nendment, whicli would add the following new language in the City of Mount Vernon Zoning Code: Proposed Zoning Text Ai'nendment §267-28M.: Self-storage facilities sl'iall be pennitted as a Special Permit Use in the I - Industrial Zoning District, the LI-7.5 Landscape Industrial Zoning District and the Commercial Business Zoning District, subject to the following requirements: (1) The site for a self-storage facility shall have a minimum area of 20,000 square feet. JUN 9 20xi (2) Tlie maximum height of the self-storage facility shall be four stories, unless excepted herein. (a) The maximum lieiglit of tlie self-storage facility may be increased to five stoi-ies if a minimum of 75% of tlie frontage of tlie building along the primary street level is occupied by a peri'nissible retail use. (b) Perinissible retail uses on tlie ground level include: banks, retail bakers, restaurants, or stores and shops for sales at retail or the perfon'nance of customary personal services. (3) Tl'ie self-storage use is limited to individual storage units or compaitments. (4) Storage units sliall be a minimum of 50 square feet and shall not exceed 300 square feet. (5) 1 off-street parking space sliall be provided for every 25 storage units (or fraction tliereof). (6) 1 ti-uck loading space shall be provided for every self-storage facility, and 1 additional truck loading space for every 150 storage units (or fraction tl'iereof) above tlie first 100 storage units. (7) Storage units sliall not be used for the manufacture, fabrication, processing, veliicle or equipment repair, or similar activities, or to conduct retails sales of any kind or any other comi'nercial activity. (8) No outside storage shall be pen'nitted. (9) No more than 5% of the individual storage units shall be pet-mitted to contain electrical outlets. (10) Tlie building shall be designed to liave an arcliitectural character that is han'nonious witli and enhances the surrounding neighborhood, and minimizes the histoiically negative appearance of sucli facilities. Tliis includes, among other elements deemed satisfactory to the Plai'uiing and Architectural Review Boards, appropriate setbacks and massing as necessary to ensure han'nony witli the sutrounding neighborhood. Building colors shall be neutral or earth-tone, and shall not call attention to the use. Exterior walls visible from a public street shall not include metal as the piimary material. (11) Sufficient landscaping shall be provided on the site. (12) Lighting shall not cause a nuisance for surrounding uses. (13) All self-storage facilities sliall include continuous video surveillance of all indoor and outdoor common areas. (14) Tl'ie liours of access to a self-storage facility shall be restiicted to between 6:00 AM and 10:00 PM. (15) No more tlian 25% of all garage or roll up doors serving individual storage units shall be located parallel to the public street upon which tlie site has frontage, to minimize visual impacts. (16) No less tlian 40% of tlie building fagade along a public street, sliall consist of a non-reflecting glazing material. (17) No less than 75% of the ground-level fagade along a public street shall consist of transparent windows. (18) No ground level building wall along a public street shall have a dimension greater tlian 20' witliout windows or functional entries. (19) Any ground-level retail must liave a floor-to-ceiling heiglit of 11 feet. (20) Aiiy ground-level retail must have a minimum square footage of 1,000 feet. (21) Where windows are provided along the storage space, the interior space visible from tlie public perspective shall be treated so as to present a neutral coini'nercial appearance (and not visible storage units). (22) Fencing sliall be masoiuy, wrought iron, steel, wood, or aluminum and shall be painted or vinyl coated witli colors that complement the building. High- security fencing, razor ribbon, or similar mateiials is prohibited. (23) All multi-story self-storage facilities shall liave elevators. (24) No more than 10% of individual storage units sl'iall be directly accessible from tlie exteiior of the building. 90% of all units sliall only be accessible from the interior of tlie building. This day now serves as the occasion to commemorate and to celebrate the traditions and heritage of the Portuguese people within their communities around the globe; and WHEREAS, the roots of the Luso-American community are clearly traceable back to the middle of the seventeenth century; and WHEREAS, three of eighteen elected delegates to the Constitutional Convention of the United States were Portuguese; and WHEREAS, Portugal was the first neutral nation to establish diplomatic ties with the post Revolutionary United States; and WHEREAS, today, approximately two million citizens and residents of the United States know themselves to be heirs of Portugal's unique civilization; and WHEREAS, Portuguese Americans harbor a deep commitment to family and community, an enduring work ethic, and a perseverance to succeed and contribute to society; and WHEREAS, Portuguese Americans have contributed to the advancement of early American society from manning whaling ships in New England;introduction of grape cultivation in Georgia and Early settlement of Hawaii in I 894; and WHEREAS, Portuguese Americans have been leaders in elected governrnent positions; and WHEREAS, in 1979, Peter "Tony" Coelho of California was elected to the House of Representatives, becoming the first Portuguese American to serve in Congress; and WHEREAS, Portuguese Americans have served in the highest positions of the National Government, the most notable of whom is nuclear physicist and former Secretary of Energy, Ernest Moniz; and WHEREAS, Portuguese Americans have served with distinction and proudly in the United States military; and WHEREAS, Portuguese Americans have made lasting contributions to American culture in various ways, such as introducing the ukulele to American music and John Philip Sousa, the "March King", composing the "Stars and Stripes Forever" march for the United States Navy; and /3 JUN 9 202 r? WHEREAS, Portuguese Americans, and particularly emigrants from the Azores Archipelago, have built bridges of cooperation and iru'iovation that have strengthened transatlantic relations through local and international Portuguese-American associations such as PALCUS and the New York Portuguese American Leadership Conference (NYPALC); and WHEREAS, "Portugal Day in New York" shall be celebrated on June 10, 2021; NOW, THEREFORE, BE IT RESOLVED, that the City Council of Mount Vernon, New York does hereby proclaim by a unanimous vote of its Councilmembers: Council President Marcus A.
