This request is based on a comprehensive evaluation of our operational needs and staffing requirements considering the evolving demands on our public works infrastructure within said department; and WHEREAS, over the past few years, our city changes, has undergone various including advancements in sewer system maintenance technologies and practices. These developments have led to greater efficiencies in our operations, enabling us to achieve the same level of service with a more streamlined workforce. As a result, we find ourselves in a situation where the current niunber of Assistant Sewer Maintainer positions would be more beneficial to the operational requirements of the department as Laborer; and WHEREAS, converting these excess Sewer Maintainer Assistant positions into Laborer positions would not only align our staffing with the actual workload but also allow us to allocate resources more effectively. Laborers are a versatile asset to our team, contributing to a wide range of tasks beyond sewer maintenance, including road repairs, park upkeep, and other comrniu'iity projects. This flexibility would enable us to enhance the overall maintenance and beautification of our city while optimizing our workforce. Mayor  AU6 i 4 aik'EC AN ORDINANCE REQUESTING PERMISSION TO HOLD THE PORTUGUESE AMERICAN CULTURAL FESTIV AL WHEREAS, by letter dated July 11, 2023, the Portuguese American Club of Mount Vernon has requested legislation authorizing them to hold a Portuguese - American Cultural Festival Block Party on Siu'iday, September 10, 2023 (rain date: Sunday, September 17, 2023) on Portugal Place (between East Prospect Avenue and Elm Street), from 8:00 a.m. to 10:00 p.m.; NOW, THEREFORE, The City of Mount Vernon, in City Council convened, does hereby ordain and enact: Section 1. Permission is hereby granted to the PORTUGUESE AMERICAN CLUB ("PAC") to hold a Portuguese - American Cultural Festival Block Party on Sunday, September 10, 2023 (rain date: Sunday, September 17, 2023) on Portugal Place (between East Prospect Avenue and Elm Street), from 8:00 a.m. to 10:00 p.m. Section 2. The City of Mount Vernon Fire Department requests the following prior to granting the permit to the PAC (they have been made aware): (i) Fire Prevention Bureau ("FPB") will inspect the site one day before and usually the first due companies will inspect a few times on the day during the event; (ii) at a minimum, three (3) ABC 51b extinguishers are required, as approved by the FPB officer and (iv) it is imperative that the proper setback from the building is always maintained - 3 feet minimum on open flame and 10 feet from any window for cooking smoke. Section 3. A site visit will be conducted at least three (3) hours prior to event opening. The purpose of this inspection is to inspect all the fire extinguishers, electrical connections, egress paths and any trip hazards that may be present. Also, a site plan (drawing) one week prior to the event opening. As per NYS 2020 Fire Code Section 403.I2.3.I, not fewer than two trained crowd managers and not fewer than one trained crowd manager for each 250 persons or portion thereof, shall be provided for the gathering. Section 4. In the application, the applicant specified that food will be served. Therefore, both an inspection and permit are necessary for any open flames or warming units before the event. Applicant specified there will be NO grills under the tent and the BBQ grills (charcoal) set up 15ft+ away from the tent & building and safety measures, such as fire extinguishers, etc., will be placed throughout the event. Section 5. In the event that personnel are needed to direct traffic and provide for the safety of persons and property at said block party, the PORTUGUESE AMERICAN CLUB shall reimburse the City for the overtime costs of the number of police officers determined to be necessary for these purposes at the sole discretion of the Commissioner of Public Safety. The Commissioner of Public Safety shall exercise his/her sole discretion in determining the number of police officers necessary. Section 6. The use of Portugal Place between East Prospect Avenue and Elm Street for the aforesaid purposes shall be under the supervision of the Department of Public Works. During ;he use of Portugal Place, the aforesaid shall be maintained, cleaned, and kept in good condition by said PORTUGUESE AMERICAN CLUB at its own expense. Parking for the attendees shall be limited to the municipal lot locatedone block west of the club. The permission hereby granted is always conditioned uponthe AUO l't2023 in the event of SPECiA maintenance of access to such street at all times for emergency services necessity therefor. Section 7. The Department of Public Works is hereby authorized and directed to close Portugal Place between East Prospect Avenue and Elm Street to vehicular traffic by providing and removing barricades for street closure twenty-four (24) hours in advance of the event on the aforesaid dates during the holding of the "Portuguese American Cultural Festival (Block Party)." The Parking Bureau will place "No Parking Signs" at least seventy-two (72) hours prior to the event. Section 8. Sidewalks are to remain open to pedestrians and proper signage must be visible in place. The Police Department will determine whether police presence is needed as well as how many officers are required. The event organizers are responsible for the salary for each officer needed, 72 hours in advance. It is up to the Police Department to determine if Auxiliary Police can be used. Also, if you are requesting to use private security, each person must have a NYS Security License and show proof of being bonded. Proof for each security guard's license must be submitted 72 hours before the event. Pursuant to City Code §191-1 1, no alcohol use is permitted on city property for neither sale nor consiunption. Section 9. The forgoing permission is granted upon the express condition that the said PORTUGUESE AMERICAN CLUB shall assui'ne all liability for and will indemnify and hold the City of Mount Vernon harmless of and from any and all damages that occur to persons or property by reason of the holding of said "Portuguese - American Cultural Festival (Block Party)," before acting upon this ordinance, shall file with the City Clerk and to be approved by the Corporation Counsel, a public liability policy covering the City of Mount Vernon as an additional insured with policy limits of at least $1,000,000.00 per occurrence for each event. Section 10. In the case of additional Emergency Ambulance services, notice in advance of 96 hours is required. Section 11. The first decretal paragraph, the second paragraph, Sections l and 2 of Ordinance No. 6, adopted by the City Council on August 10, 2022, entitled "AN ORDINANCE AUTHORIZING THE MAYOR TO AMEND THE ORIGINAL ARCADIS OF NEW YORK AGREEMENT" for an additional $1 000 000 is hereby amended as follows: WHEREAS, by letter dated [July 28, 2022'j August 7, 2023, the Commissioner of the Department of Public Works has requested legislation authorizing the Mayor to amend the original contract executed on December 21, 2021 with Arcadis of New York, Inc. ("Arcadis") to provide engineering services by completing outfall sampling and analysis, an Illicit Discharge Action Plan ("IDAP"), a Stormwater Management Program Plan ("SWMP Plan"), and Sewer System Evaluation Survey ("SSES") Workplan. The proposed one-year Contract Amendment Period would cornrnence on August 10, 2022, through August 9, 2023; and WHEREAS, on June 16, 2022, Mayor Shawyn Patterson-Howard declared a state of emergency due to the existence of an environmental water emergency within the sanitary and storm sewer systems posing an imtnediate health and safety threat to humans and the environment and preventing compliance with the U.S. Clean Water Act. The City of Mount Vernon ("City") is currently in a State of Emergency for the current public health and safety crisis that is being caused by the deterioration of the sanitary and storm sewers. Problems include sanitary sewer overflows, sewer backups into homes, flooding, illicit discharges and pipe WHEREAS, Arcadis has been providing engineerinz services for the investigation and rehabilitation of the City sewer system. Some of these services include grant assistance, technical guidance, GIS development, bid document development, water sampling, consent order review, developing sewer system evaluation documents, MS4 program assistance; and WHEREAS, the current agreement manages crisis, the engineering services will focus on assisting the City with sanitary and stormwater sewer investigations, maintenance and repairs. Arcadis has agreed to also provide assistance in the implementation of the lead service line replacement program to include the following deliverables: Task 1- Meetings and correspondences Task 2 - Grant and Financing Assistance Task 3 - Program Management Task 4 - Outfall 24 Sewer Investigation Field Services Task 5 - Sewer Investigation and Rehabilitation Recommendations Task 6 - 2024/2025 Phase 2 - Sewer Inspection and Rehabilitation RFB's Task 7 - As needed Engineering Services WHEREAS, Arcadis has provided a proposal to amend their original contract for one (1) year and extend the scope of services to include: Meetings and Correspondences, Grant and Financial Assistance, Contractor On-Call services, Program Management, and As-Needed Engineering Services. Prior to the issuance of a pennit lierein, the applicant shall be required to make a deposit by casli, ceitified check or money order witli the City Clerk in an amount to be determined by tlie Commissioner of Public Works. Said deposit sliall be utilized by tlie City to reimburse tlie City for tl"ie costs it incurs in the cleaning aiid sanitation at and aborit the location of such filming. Tlie Commissioner of %blic Works sliall certify to the City Clerk the total amount of the costs incurred by the City in the cleaning and sanitation at and about the location of such filming, which costs sl'iall be deducted from such deposit and paid to the City. The notes wiII have a term of one year, at which point the City will have the option to renew the principal amount for an additional year or convert to long-term bonds, after paying interest on the maturing notes,, and WHEREAS, while the loss of our credit rating limits our options to access the capital market, it does not eliminate the possibility. Typically, the City would finance its debt through a "competitive sale" process and closed auction bidding. However, due to the lack of recent audited financial statements, the City has limited access to the capital markets. With the "negotiated sale" process that is being proposed, the underwriter is selected ahead of time and assists the City directly with the sale of the debt,whichwillnotberated.
