Mount Vernon City Council Regular Meeting Minutes November 12, 2014 The meeting was called to order by Mayor Boudreau at 7:00 p.m. Present: Mayor Boudreau, Councilmembers Hulst, Lindquist, Ragan, Fiedler, Urban, Quam and Molenaar Absent: None Staff Present: Fire Chief Hari, Library Director Soneda, Finance Director Huschka, City Attorney Rogerson, Human Resources Director Bartlett, Community Planner Lowell, Public Works Director Bell, Assistant Public Works Director Love Citizens Present: Twenty Five APPROVAL OF MINUTES A. Approval of October 15, 2014 Study Session Minutes: Councilmember Fiedler moved to approve the October 15, 2014 Study Session minutes. Motion seconded by Councilmember Ragan. Motion carried 7-0. B. Approval of October 22, 2014 Regular Council Meeting Minutes: Councilmember Quam moved to approve the October 22, 2014 Regular Council Meeting minutes. Motion seconded by Councilmember Molenaar. Motion carried 7-0. C. Approval of Agreement #3041: Councilmember Fiedler moved to approve Agreement #3041. Motion seconded by Councilmember Hulst. Motion carried 7-0. APPROVAL OF CLAIMS AND PAYROLL A. Approval of November 12, 2014 claims numbered 137132, 137137-137138, 137144, 137146- 137402 in the amount of $847,894.71. Councilmember Hulst moved to approve the November 12, 2014 claims as stated above. Motion seconded by Councilmember Lindquist. Approval of October 31, 2014 payroll checks numbered 103525-103581, direct deposit checks numbered 48332-48537, and wire transfers numbered 493 & 494 in the amount of $898,151.59. Councilmember Molenaar moved to approve the October 31, 2014 payroll as stated above. Motion seconded by Councilmember Lindquist. Motion carried 7-0. REPORTS A. Committees: 1. Public Works – for details see Committee minutes. B. Community Comments: None C. Councilmember Comments:  Councilmember Ragan said that the Law and Justice Council met. Certain parcels for the jail site have been purchased by the County.  Councilmember Fiedler said that elected officials are looking to the city for input and he encouraged other Councilmembers to bring forward issues. D. Mayor’s Report: Mayor Boudreau stated:  Budget discussions are taking place and the preliminary budget will be posted to the city website on November 13, 2014.  Ongoing budget meetings are taking place, she encourages the public to come and listen.  Public hearing to consider adoption of the budget will be November 25, 2014 at 6:00 pm.  Thanked individuals for coming to the Veterans Day Celebration.  Library Tours – Councilmembers, library board members and staff have toured various libraries in Seattle.  Mayor’s coffee dates are: Saturday, November 15th at 10:00am in the City Library and Friday, November 21st at 10am at the Stonebridge Condo Association Club House, 512 Shady Lane. E. Committee Agenda Requests: Mayor Boudreau requested discussion of the Cedardale Road roundabout project at a future committee meeting for any improvements that can be made. She also requested discussion of the downtown restroom project. Councilmember Fiedler requested discussion of a Veterans Memorial. UNFINISHED BUSINESS None Mount Vernon City Council November 12, 2014 Page 3 of 4 NEW BUSINESS Open Record Public Hearing – Amending the City’s Development Regulations for Marijuana uses in the Commercial- Limited Industrial Zone: Community Planner Rebecca Lowell presented the background for this item. Ms. Lowell also indicated that the Planning Commission held a public hearing on November 4, 2014 and their recommendation was to allow medical marijuana collective gardens and recreational marijuana producers and processors in the existing neighborhoods that staff had identified. Since this recommendation differs from staff’s recommendation there will need to be an additional public hearing set for December 3, 2014. Staff informed Council that they will need to postpone their decision on the staff proposed ordinance to limit medical and recreational marijuana uses within existing residential neighborhoods in the Commercial-Limited Industrial zoning district, until after the public hearing that will occur on December 3, 2014. Mayor Boudreau opened the public hearing:  Chris Cody from Seattle stated he wouldn’t want to open a store in a residential area. He would want to open a retail outlet. Retail doesn’t have use of dangerous chemicals. He requests that when Council votes to keep in mind that retail is not the same as producing or processing.  Darlene Tagethoff from Mount Vernon said she chose to live in the Evergreen Mobile Park with other seniors, not to have marijuana produced next door. She stated she does not want this type of business in her neighborhood.  Tim Walsh from Mount Vernon urged Council to upgrade the water line to support commercial business in those areas versus residential.  Earl Sunberg from Mount Vernon agrees with no marijuana use in the mobile park areas. He doesn’t believe that there is enough space for producers and that it will reduce the value of their homes.  Sharon Hunnington from Mount Vernon does not want marijuana in the park.  Jack Wright from Mount Vernon stated he does not agree with letting producers or sellers into the parks.  Claurice Traylor from Mount Vernon asked why the planning commission said this should be allowed. Ms. Lowell supplied her with minutes from the planning commission meeting. There being no further comments Mayor Boudreau closed the public hearing. Councilmember Fiedler moved to continue discussion to December 3, 2014. Motion seconded by Councilmember Hulst. Motion carried 7-0. A. Presentation on Phase II Construction and Completion of the Downtown Flood Protection Project: Assistant Public Works Director Mike Love gave a presentation on the Downtown Flood Protection Project from the beginning of construction to the opening of the Phase II boardwalk and plaza. B.
