Mount Vernon City Council Regular Meeting Minutes February 11, 2015 The meeting was called to order by Mayor Boudreau at 7:00 p.m. Present: Mayor Boudreau, Councilmembers Fiedler, Hulst, Lindquist, Molenaar, Quam, Ragan and Urban. Staff Present: Public Works Director Bell, Police Chief Dodd, Community Development Director Hyde, Fire Chief Hari, Finance Director Huschka, Assistant Public Works Director Love, Senior Planner Lowell, City Attorney Rogerson, Library Director Soneda, Special Projects Administrator Stendal Citizens Present: 12 Approval of Minutes A. Approval of January 28, 2015 Regular Council Meeting minutes. Councilmember Quam moved to approve the January 28, 2015 Regular Council Meeting minutes. Motion seconded by Councilmember Fiedler. Motion carried 7- 0. Approval of Claims and Payroll A. Approval of February 11, 2015 claims numbered 138460-138464 and 138467-138662 in the amount of $495,387.19 Councilmember Lindquist moved to approve the February 11, 2015 claims numbered 138460-138464 and 138467-138662 in the amount of $495,387.19. Motion seconded by Councilmember Hulst. Motion carried 7-0. B. Approval of January 31, 2015 payroll checks numbered 103831-103883, direct deposit checks numbered 49550-49748, and wire transfers numbered 505 and 506 in the amount of $924,704.18 Councilmember Ragan moved to approve the January 31, 2015 payroll checks numbered 103831-103883, direct deposit checks numbered 49550-49748, and wire transfers numbered 505 and 506 in the amount of $924,704.18. Community Comments- None C. Councilmember Comments: Councilmember Ragan spoke about the Law and Justice meeting that he and Police Chief Dodd attended. D. Mayors Report: Mayor Boudreau recognized the new Development Services Director Bob Hyde. She also reminded everyone about the Mayors coffee coming up 2/13/15 at the Skagit County PUD. E. Committee Agenda request: Councilmember Fiedler requested that the union contracts presentation be presented to Councilmembers. Councilmember Lindquist requested information on the research regarding the intersection at 30th Street and College Way. UNFINISHED BUSINESS None NEW BUSINESS A. Open Record Public Hearing- Proposed Annexation: Ms. Lowell presented Council with a proposed annexation of the area located southwest of SR 536 (Memorial Highway), north of McLean Road, and east of Sunset Lane. The Skagit County Assessor has certified that the owners of real property consisting of at least sixty percent of the assessed valuation of the area proposed to be annexed have signed the required annexation petitions. Mayor Boudreau opened the public hearing: Robert Sward, Mount Vernon- expressed concern on the additional traffic, noise level and the drainage issue. Chip Kennah, Mount Vernon- stated his concern about the traffic and runoff water. John Watson, Mount Vernon- said the property adjoins a 39 acre parcel, and expressed concern about the noise level and about the runoff water issue. Barbara Ferguson, Mount Vernon- is concerned about the water runoff and mosquito issue. Mike Holmstrom, Mount Vernon- is concerned about the water runoff and drainage issue. John Semrau, Mount Vernon- contractor for the owners of the property, spoke about improvements that the owners plan on making to the property if it is annexed. Sandy Holmstrom, Mount Vernon- expressed concern about the traffic route. Mayor Boudreau closed the public hearing. Councilmember Fiedler discussed the initial concerns brought up with the applicant regarding water, noise and traffic. He further explained the process. Mount Vernon City Council February 11, 2015 Page 3 of 5 Councilmember Quam asked how much the improvements will cost the City. Ms. Lowell answered that the developer will incur all those costs. Councilmember Hulst clarified the purpose of the Proposed Annexation. Councilmember Molenaar asked about the report from the boundary review board. Councilmember Urban asked about the differences between Skagit County drainage improvements and the City of Mount Vernon’s drainage improvements. Councilmember Hulst moved to approve Ordinance 3647 finalizing the 39 acre Food Services annexation. Motion seconded by Councilmember Lindquist. Motion carried 5-2 (Councilmembers Ragan and Quam opposed). B. Ordinance Amending Chapter 10.20 of the City’s Parking Code: Mr. Rogerson presented Council with a proposed amendment to Chapter 10.20 of the City’s parking code regarding parking large commercial vehicles within the City’s right of way. Public Comment: Jack Polsing, Mount Vernon- stated that he is a truck driver and that he utilizes the parking along Urban Avenue. He stated that to follow the proposed two hour limit is not fair as DOT requires them to rest for 34 hours. He believes this ordinance is very harmful to small businesses, owner operators and hoped that Council will not pass this ordinance. Councilmember Urban moved to approve Ordinance 3648 amending Chapter 10.20 of the City’s parking code. Motion seconded by Councilmember Lindquist. Motion carried 7-0. C. Critical Area Monitoring/Maintenance Requirements for the Digby Heights Plat: Ms. Lowell presented Council with a resolution allowing the security deposit for Digby Heights Plat be paid to the City as the monitoring, maintenance and performance standards agreement that was in place for this Plat were not met. Councilmember Lindquist moved to adopt Resolution 882. Motion seconded by Councilmember Ragan. Motion carried 7-0. D. Bid Award- College Way and LaVenture Road Safety Improvements and Citywide Safety Improvements: Mr. Love presented Council with the contract for construction of Project 12-12, College Way and Laventure Road Safety Improvements and Citywide Safety Improvements and requested that it be awarded to Sail Electric, Inc. for the bid amount of $388,220.00. Councilmember Fiedler moved to award the contract for construction of Project 12-12 to Sail Electric, Inc. for the bid amount of $388,220.00. Motion seconded by Councilmember Molenaar. Motion carried 7-0. E. Interlocal Cooperative Agreement with Skagit Public Hospital District No. 1: Mr. Love presented Council with an Interlocal Cooperative Agreement between the City of Mount Vernon and the Skagit County Public Hospital District No. 1. Mount Vernon City Council February 11, 2015 Page 4 of 5 Councilmember Lindquist moved to approve the Interlocal Agreement with the Skagit County Public Hospital District No. 1 and authorize the Mayor to execute said agreement. Motion seconded by Councilmember Urban. Motion carried 7-0. F. Consultant Services Contract Approval: Mr. Love presented Council with a professional services agreement with Reichhardt and Ebe Engineering, Inc. for preparation of plans, specifications, estimates, for construction of a roundabout and signal improvements on LaVenture Road not to exceed $58,975. Councilmember Fiedler moved to authorize the Mayor to enter into a professional services agreement with Reichhardt and Ebe Engineering, Inc. Motion seconded by Councilmember Ragan. Motion carried 7-0. G. Purchase of Vehicles – Police Department: Police Chief Dodd requested that Council authorize the purchase of four 2015 Ford Police Interceptor vehicles in the amount of $143,674.00 Councilmember Urban moved to authorize the purchase of four 2015 Ford Police Interceptor vehicles in the amount of $143,674.00. Motion seconded by Councilmember Hulst. Motion carried 7-0. H. Interlocal Agreement with Skagit County: Fire Chief Hari requested that Council authorize the Mayor to enter into an Interlocal Agreement with Skagit County EMS Commission to enable the City to be reimbursed for our BLS supply usage. Councilmember Ragan moved to authorize the Mayor to enter into an Interlocal Agreement with Skagit County EMS. Motion seconded by Councilmember Lindquist. Motion carried 7-0. I. Agreement with YMCA: Mr. Rogerson requested that Council authorize the Mayor to enter into the proposed amendment to the lease agreement with the YMCA. Councilmember Hulst moved to authorize the Mayor to enter into the proposed amendment to the lease agreement with the YMCA. Motion seconded by Councilmember Molenaar. Motion carried 7-0. J. Agreement with Department of Ecology: Mr. Chesterfield presented to Council an Interagency Agreement with the Washington State Department of Ecology to have the Washington Conservation Corps (WCC) perform vegetation maintenance on drainage facilities. The agreement would be up to eight weeks of WCC crew time with costs not to exceed $37,600.00. Councilmember Molenaar moved to authorize the Mayor to enter into an interagency agreement with the Washington State Department of Ecology. Motion seconded by Councilmember Urban. Agreement with Databar: Ms. Huschka presented Council with an agreement with Databar for form production services to process, print, collate and mail monthly utility billing invoices. Councilmember Hulst moved to authorize the Mayor to enter into an agreement with Databar. Motion seconded by Councilmember Quam. Motion carried 7-0. The meeting was convened into executive session at 9:02 p.m. and was estimated to last 60 minutes. L. Executive Session: Pending litigation and potential real estate purchase.
