Mount Vernon City Council Regular Meeting Minutes December 9, 2015 The meeting was called to order by Mayor Boudreau at 7:00 p.m. Present: Mayor Boudreau, Councilmembers Hulst, Lindquist, Molenaar, Quam, Ragan and Urban Excused: Councilmember Fiedler Staff Present: Public Works Director Bell, Police Chief Dodd, Finance Director Huschka, City Attorney Rogerson, Library Director Soneda, Public Works Assistant Director Love, CED Director Hyde, Fire Chief Hari, Special Projects Administrator Stendal Citizens Present: 18 Approval of Minutes A. Approval of November 18, 2015 Regular Council Meeting Minutes. Councilmember Urban moved to approve the November 18, 2015 Regular Council meeting minutes. Motion seconded by Councilmember Quam. Motion carried 6-0. B. Approval of November 24, 2015 Regular Council Meeting Minutes. Councilmember Molenaar moved to approve the November 24, 2015 Regular Council meeting minutes. Motion seconded by Councilmember Lindquist. Motion carried 6-0. Approval of Claims and Payroll A. Approval of December 9, 2015 claims numbered 142581-142740 in the amount of $1,120,211.65. Councilmember Ragan moved to approve the December 9, 2015 claims numbered 142581-142740 in the amount of $1,120,211.65. Motion seconded by Councilmember Urban. Motion carried 6-0. B. Approval of November 30, 2015 payroll checks numbered 104907-104962, direct deposit checks numbered 53576-53780, and wire transfers numbered 545-546 in the amount of $967,537.40. Community Comments: • Joan Penney, resident of Mount Vernon invited Council to the Housing Summit on January 22, 2016. Also on December 22, 2015 is a vigil for Homelessness on the Skagit County Courthouse steps. C. Councilmember Comments: • Councilmember Ragan gave an update of the monthly Skagit County Law and Justice Council meeting. • Councilmember Molenaar commented on the downtown Christmas parade and activities. D. Mayor’s Report • Thanked local attorney Gary Jones for his work in the Community, and wished him well in his retirement. • Updated Council and the public on meetings, participants, topics discussed and next steps regarding Vagrancy and Street Homelessness in Mount Vernon. E. Committee Agenda request: None NEW BUSINESS A. Recognition of Outgoing Library Board of Trustee Members: Mr. Soneda recognized retiring Library Board of Trustee Members Marija Anderson and Carrie Odlin. B. Closed Record Public Hearing- Skagit Highlands Division 2A Final Plat Approval: Ms. Lowell presented Council with a request to authorize the Mayor to sign the accompanying Resolution and the final plat maps for the Skagit Highlands Division 2A plat. Mayor Boudreau opened the Closed Record Public Hearing. Hearing no comment Mayor Boudreau closed the Closed Record Public Hearing. Councilmember Lindquist moved to authorize the Mayor to sign the accompanying Resolution 898. Motion seconded by Councilmember Urban. Motion carried 6-0. C. Closed Record Public Hearing- Expansion of a Non-Conforming Building: Ms. Lowell presented Council with a request to authorize the Mayor to sign the accompanying Resolution that will approve the subject expansion of a non-conforming building. Mayor Boudreau opened the Closed Record Public Hearing. Hearing no comment Mayor Boudreau closed the Closed Record Public Hearing. Councilmember Urban moved to authorize the Mayor to sign the accompanying Resolution 899. Motion seconded by Councilmember Molenaar. Interlocal Agreement for Defense Program Assistant Services: Mr. Stendal presented a request to authorize the Mayor to enter into an agreement with the City of Burlington for Defense Program Assistant Services. Councilmember Lindquist moved to authorize the Mayor to enter into an agreement with the City of Burlington. Motion seconded by Councilmember Hulst. Motion carried 6-0. E. Interlocal Agreement for Mobile Wireless Services: Mr. Kleppe presented a request to authorize the Mayor to enter into an agreement with Fire District 14 allowing the District access through mobile wireless to Skagit County Spillman Fire Mobile Software. Councilmember Urban moved to authorize the Mayor to enter into an agreement with Fire District 14. Motion seconded by Councilmember Quam. Motion carried 6-0. F. Interlocal Agreement for Production Services: Mr. Kleppe presented a request to authorize the Mayor to enter into agreements with various local agencies for TV production services. The agreements are with Skagit Valley Hospital, Mount Vernon School District, Skagit County, Skagit Valley College and Skagit County Community Action Agency. Councilmember Molenaar moved to authorize the Mayor to enter into the agreements with the agencies noted above for TV production services. Motion seconded by Councilmember Quam. Motion carried 6-0. G. Project Acceptance- Downtown Flood Protection Project, Phase 2 Construction Contract: Mr. Love presented a request to Council to accept the downtown construction performed by Strider Construction Company, Inc for the construction of the Downtown Flood Protection Project Phase 2. Motion seconded by Councilmember Ragan. Motion carried 6-0. H. Professional Services Contract for Design and Right of Way for the College Way Widening at I-5 Lane Capacity Improvements Project: Mr. Love presented a request to Council to authorize the Mayor to enter into a professional services agreement contract with Reichardt & Ebe Engineering, Inc. for preparation of plans, specifications, estimates and ROW acquisition for the College Way Widening Project at I-5. Councilmember Hulst moved to authorize the Mayor to enter into a professional services agreement contract with Reichardt & Ebe Engineering, Inc. Motion seconded by Councilmember Molenaar. Motion carried 6-0. I. Agreement with Washington State Department of Ecology: Mr. Chesterfield presented a request to Council to authorize the Mayor to sign the FY2015-17 Water Quality Stormwater Capacity Grant Agreement with the Washington State Department of Ecology for the implementation of Phase II Municipal Stormwater NPDES permit. Councilmember Quam moved to authorize the Mayor to sign the FY2015-17 Water Quality Stormwater Capacity Grant Agreement with the Washington State Department of Ecology. Motion seconded by Councilmember Lindquist. Motion carried 6-0. Mount Vernon City Council December 9, 2015 Page 4 of 4 J. Proposed Amendment to the Utility Tax on Sewer Services: Ms. Huschka presented a request to Council to adopt an ordinance to amend the utility tax rate on sewer services to be effective January 1, 2016, increasing the rate from 7% to 8.5% with a provision that the tax will be adjusted to 7% effective January 1, 2017. Councilmember Hulst moved to adopt ordinance 3670 to amend the utility tax rate on sewer services to be effective January 1, 2016, increasing the rate from 7% to 8.5% with a provision that the tax will be adjusted to 7% effective January 1, 2017. Motion seconded by Councilmember Lindquist. Motion carried 6-0. K. Executive Session: Real Estate and Potential Litigation estimated to last 15 minutes The meeting was reconvened at 8:10 pm.
