Mount Vernon City Council Regular Meeting Minutes May 24, 2017 The meeting was called to order by Mayor Boudreau at 7:07 p.m. Present: Councilmembers Fiedler, Hudson, Hulst, Lindquist, Molenaar, Quam and Ragan Staff Present: Police Chief Dodd, Project Development Manager Donovan, Parks and Enrichment Services Director King, Assistant Public Works Director Love, Development Services Director Phillips, Fire Marshall Riggs, City Attorney Rogerson, and Finance Director Volesky Citizens Present: 6 CONSENT AGENDA A. Approval of May 10, 2017 Regular Council Meeting Minutes B. Approval of May 15, 2017 payroll checks numbered 106963 - 107011, direct deposit checks numbered 60697 - 60900, and wire transfers numbered 615 - 616 in the amount of $760,386.64 C. Approval of May 24, 2017 Claims numbered 149728 – 149917 in the amount of $4,103,242.12 D. Agreement No. 3467 Councilmember Lindquist moved to approve consent agenda items A-D. Motion seconded by Councilmember Molenaar. Motion carried 7-0. REPORTS A. Committee Reports: • Finance Committee – for details see Committee minutes. • Development Services Committee – for details see Committee minutes. B. Community Comments • Scott Correa came forward to comment on communications possibilities for coordinating traffic routes during various festival events or during an emergency. • Dan Mitzel came forward to comment that he noted that the City has a parcel for sale located on Division Street and he would like to see that property made available for affordable/low income housing. He would encourage wetland banking mitigation tools to make that more useable. C. Mayor’s Report • The Mayor thanked the Chamber of commerce for the opportunity to deliver a state of the City address at their most recent meeting. This was recorded and is available on the City’s website. • Mayor Boudreau reviewed Mayor’s Coffee Hours. D. Committee Agenda Requests. Councilmember Ragan would like to have the Outreach Coordinator from the Police Department present a report on her progress. Mount Vernon City Council May 24, 2017 Page 2 of 4 NEW BUSINESS A. Public Hearing – Adoption of Permanent Regulations for Adult Entertainment Uses: Ms. Lowell presented background on information on proposed code amendments related to adult business licenses, employees and adult entertainment uses. The proposed code amendments involve Mount Vernon Municipal Code Chapters 5.13, 5.06 and Title 17. On October 26, 2016 the Council adopted interim regulations for adult entertainment uses by passing Ordinance 3698. An Adult Entertainment Zoning and Licensing Committee was created to study and make recommendations to the City on permanent regulations for adult entertainment uses. The Committee evaluated negative secondary impacts, geographic areas that would be sensitive to this type of business as well determining where adult entertainment uses should be limited to. Ms. Lowell asked that Council add as Exhibit 24 to Legislative Record the illustrations and add the new public comment to Exhibit 23. Mayor Boudreau opened the public hearing. • Bill Craig came before Council to express his appreciation for the diligence that has been paid to this topic. • Scott Correa came before Council to express his agreement with the final proposed ordinance, but does have questions regarding any changes of the map of the area. There being no further testimony Mayor Boudreau closed the public hearing. The Council expressed their appreciation for staff and the committee’s time and diligence on this topic. Councilmember Lindquist moved to adopt Ordinance 3714 amending Mount Vernon Municipal Code Chapters 5.13, 5.06 and title 17 adding the above mention records. Motion seconded by Councilmember Hulst. Motion carried 7-0. B. Fireworks Stands in Mount Vernon: Fire Marshall Riggs presented Council with a request for approval of the retail firework stand applications received for the sale of fireworks from June 28, 2016 – July 4, 2017. The stands will be located at Haggen, Walmart and Safeway parking lots Councilmember Quam moved to approve the 2017 Fireworks Stands. Motion seconded by Councilmember Hudson. Motion carried 7-0. C. Fireworks Display at Edgewater Park: Fire Marshall Riggs presented Council with a request for approval of a fireworks display permit at Edgewater Park on July 4, 2017 at approximately 10:00 p.m. This display is a public viewing display which occurs every year and this year the display will be put on by Western Display Fireworks. Councilmember Ragan moved to authorize a July 4, 2017 Fireworks display. Motion seconded by Councilmember Molenaar. Motion carried 7-0. D. Change Order No. 2 of Professional Services Agreement for Safe Routes to School Project: Mr. Love presented Council with a request to authorize the Mayor to enter into Change Order No. 2 with Reichhardt & Ebe Engineering, Inc. for additional services to be provided during construction of signal improvements at Section and LaVenture Roads, not to exceed $81,000. This change order includes field inspection, material testing, surveying, project administration and construction engineering services. Councilmember Hulst moved to authorize the Mayor to execute change order No. 2 of an agreement with Reichhardt & Ebe Engineering, Inc. for Safe Routes to Schools Project. Mount Vernon City Council May 24, 2017 Page 3 of 4 Motion seconded by Councilmember Hudson. Motion carried 7-0. E. Business License Ordinance: Mr. Volesky presented Council with a request for approval of an ordinance updating Chapter 5.04 of the Mount Vernon Municipal Code, Business Licensing, to update fees, adult entertainment regulations and partnering with the Department of Revenue, Business Licensing Service. Councilmember Fiedler moved to approve Ordinance 3715 amending Mount Vernon Municipal code Chapter 5.04, Business Licensing. Motion seconded by Councilmember Lindquist. Motion carried 7-0. F. Franchise Lease Agreement: Mr. Rogerson presented Council with a request for approval of an ordinance granting a franchise agreement with Cascade Natural Gas. This is a one year extension during which a new agreement is being negotiated Councilmember Lindquist moved to approve Ordinance 3716 granting a franchise agreement with Cascade Natural Gas. Motion seconded by Councilmember Quam. Motion carried 7-0. G. Franchise Lease Agreement: Mr. Rogerson presented Council with a request for approval an ordinance granting a franchise agreement with Astound Broadband, LLC. This will provide fiber optic telecommunications network. Councilmember Hudson moved to approve Ordinance 3717 granting a franchise agreement with Astound Broadband, LLC. Motion seconded by Councilmember Hulst. Motion carried 7-0. The meeting was convened into executive session at 8:03 p.m. and was estimated to last 15 minutes. H. Executive Session: Potential litigation and real estate The meeting reconvened at 8:18 p.m. I. Fire District No.1 Agreement: Council had an open discussion regarding ongoing negotiations with Fire District No. 1 including bringing the City’s last, best offering forward at the next Council meeting for action.
