Mount Vernon City Council Regular Meeting Minutes April 11, 2018 The meeting was called to order by Mayor Boudreau at 7:06 p.m. Present: Councilmembers Beaton, Brocksmith, Carías, Hudson, Hulst, Lindquist and Molenaar Staff Present: Public Works Director Bell, Police Chief Dodd, Fire Chief Brice, Project Development Manager Donovan, Library Director Huffman, Parks Operations Supervisor Weppler, City Attorney Rogerson and Finance Director Volesky Citizens Present: 7 Consent Agenda A. Approval of March 28, 2018 Regular Council Meeting Minutes. B. Approval of April 5, 2018 payroll checks numbered 108134-108171, direct deposit checks numbered 65155-65372 and wire transfers numbered 665-666 in the amount of $941,602.17. C. Approval of April 11, 2018 claims numbered 154318-154320 and 154320-15437 in the amount of $722,610.57. D. Approval of Agreement No. 3613 Councilmember Hulst moved to approve the consent agenda as presented. Motion seconded by Councilmember Hudson. Motion carried 7-0. REPORTS A. Committee Reports:  Public Works/Library Committee – for details see Committee minutes. B. Community Comments:  Chief Dodd wished Mayor Boudreau a Happy Birthday! C. Councilmember Comments:  Councilmember Brocksmith invited the public to the Kiwanis Salmon BBQ and to the Tulip Festival Street Fair. There is also an Earth Day event at Edgewater Park at 10 am, April 21st. D. Mayor’s Report:  Letter of Map Revision (LOMR) has been submitted to FEMA.  Go Mobile with City’s new mobile app! See website for details.  Little Mountain Wellness Walk, Saturday April 14 at 10:00am; meet at the top of Little Mountain  Mayor’s Coffee hours were reviewed. E. Open Record Public Hearing- Community Development Block Grant (CDBG): Mr. Donovan indicated that CDBG requires that Council hold a public hearing prior to the development of a draft CDBG 2018 Action Plan. This is the second Open Record Public Hearing. Mayor Boudreau opened the public hearing. Hearing no comment, Mayor Boudreau closed the public hearing. B. Review of City’s Public Defense System: Mr. Donovan introduced Jennifer Rancourt, Public Defense Auditor. Ms. Rancourt presented Council with an annual review of the City’s Public Defense System. C. Approval of Police Non-Commission Collective Bargaining Agreement: Ms. Bartlett presented Council a request to authorize the Mayor to sign the Collective Bargaining Agreement with the Police Non-Commissioned employees. Councilmember Lindquist moved to authorize the Mayor to execute the Collective Bargaining Agreement with the Police Non-Commissioned employees. Motion seconded by Councilmember Hulst. Motion carried 7-0. D. Re-Confirmation of Engagement Agreement with Cynthia Weed, K&L Gates, LLP for Bond Counsel: Mr. Volesky presented Council with a request to authorize the Mayor to enter into a Re- Confirmation of Engagement Agreement for legal services from K&L Gates in the amount of $24,200. K&L Gates will be the City’s bond counsel for unlimited tax general obligation bonds. Councilmember Hudson moved to authorize the Mayor to enter into a Re-Confirmation of Engagement Agreement for legal services from K&L Gates in the amount of $24,200. Motion seconded by Councilmember Beaton. Motion carried 7-0. E. 2018 Budget Amendment Establishing Assistant Finance Director and Associated Budget: Mr. Volesky presented Council with a request to adopt an ordinance amending the 2018 budget to add the position of Assistant Finance Director and associated budget. Councilmember Hulst moved to adopt Ordinance 3747, amending the 2018 budget to add the position of Assistant Finance Director and associated budget. Motion seconded by Councilmember Molenaar. Motion carried 7-0. F. Recreation and Conservation Office (RCO) Grant Authorization: Mr. Weppler presented a resolution authorizing the Mayor to enter into a grant application through the Washington State Recreation and Conservation Office. The grant is for the Little Mountain Skills Park and Trails. Councilmember Lindquist moved to approve Resolution 948, authorizing the Mayor to enter into a grant application through the Washington State Recreation and Conservation Office. Approval of Land Agency Agreement with Washington State Department of Transportation (WSDOT): Mr. Bell presented Council with a request to authorize the Mayor to enter into a Local Agency Agreement with WSDOT to authorize Preliminary Engineering for the N. 4th Street/Riverside Drive BNSF Railroad Crossing Improvement Project in the amount of $223,000. The project was selected by WSDOT Rail Safety Office with a total award amount of $1,447,947 to improve this rail crossing. Councilmember Lindquist moved to authorize the Mayor to enter into a Local Agency Agreement with WSDOT to authorize Preliminary Engineering for the N. 4th Street/Riverside Drive BNSF Railroad Crossing Improvement Project in the amount of $223,000. Motion seconded by Councilmember Hulst. Motion carried 7-0. The meeting was convened into executive session at 8:00 p.m. and was estimated to last 10 minutes. A. Executive Session: Potential Litigation and Real Estate Acquisition.
