Mount Vernon City Council Regular Meeting Minutes December 12, 2018 The meeting was called to order by Mayor Boudreau at 7:00 p.m. Present: Councilmembers Beaton, Brocksmith, Carías, Hudson, Hulst, Lindquist and Molenaar Staff Present: Fire Chief Brice, Police Chief Dodd, Library Services Director Huffman, Project Development Manager Donovan, City Attorney Rogerson, and Finance Director Volesky, Wastewater Manager Duranceau, Development Services Director Phillips and Senior Planner Lowell Citizens Present: 14 CONSENT AGENDA A. Approval of November 14, 2018 Regular Council Meeting Minutes B. Approval of November 28, 2018 Regular Council Meeting Minutes C. Approval of December 5, 2018 payroll checks numbered 108824-108859 direct deposit checks numbered 68681-68907, and wire transfers numbered 697-698 in the amount of $892,626.74. D. Approval of November 28, 2018 claims numbered 1408-1412 and 1416-1576 in the amount of $654,534.74. Councilmember Hulst moved to approve the consent agenda items A-D. Motion seconded by Councilmember Hudson. Motion carried 7-0. REPORTS A. Committee Reports:  Public Works/Library Committee: for details see Committee minutes B. Community Comments:  Dale Ragan, Mount Vernon- Expressed concern with the thoroughness of the research for the Fire Bond.  Scott Correa, Mount Vernon- Thanked the Mayor and Council for the expedient service of the Animal Control officer attending to a cat issue in his neighborhood. He also believes that if the fire bond passes that Fire District 1 should pay more for our services. He also suggested that the City of Mount Vernon buy a smaller ladder truck to provide fire protection for the downtown area.  Skye Reichendifer, Mount Vernon- Thanked the Mayor and Council for support of the Celtic Arts Foundation. He presented Council and the Mayor with the 2018 Year Book for the Celtic Arts Center. C. Councilmember Comments: None D. Mayor’s Report:  Updated the community on the Library/Community Center Project. Committee Agenda Requests: Councilmember Hulst moved to table Item G- Bond for Fire Facilities to the December 19, 2018 Study Session. Motion seconded by Councilmember Hudson. Motion carried 7-0.  Councilmember Lindquist would like further discussion on the insurance bureau rating. Councilmember Hudson moved to add EMS Update to the agenda as Item B. Motion seconded by Councilmember Beaton. Motion carried 7-0. NEW BUSINESS A. Open Record Public Hearing- 2018 Site Specific Comprehensive Plan Amendments: Ms. Lowell presented information regarding three (3) Comprehensive Plan amendments processed in 2018 by the department as follows: 1. MV28 LLC; City File No: PL18-032 2. Barnet; City File No: PL18-034 3. Corner 9 Properties LLC; City File No: PL18-035 These type of amendments are subject to the rules of the Growth Management Act which prescribes the timing and process by which Comprehensive Plan amendments can be considered by jurisdictions subject to the act. These type of amendments are not considered more frequently than once every year so the cumulative effects are taken into account. a) Mayor Boudreau opened the public hearing for the MV28 LLC; City File No. PL18-032 1717 Freeway Drive. The applicant requested the designations be changed to a Comprehensive Plan designation of Public (P) from General Commercial (GC).  David Christenson, Mount Vernon- representing the property owner. Expressed support for the change in designation.  Paul Hollander, Lynden- owns property next to the site. Expressed opposition to the designation change.  Walt Meagher, Anacortes- Expressed support for the change in designation.  Dale Ragan, Mount Vernon- Expressed support for the change in designation. There being no further comments Mayor Boudreau closed the public hearing. b) Mayor Boudreau opened the public hearing for Barnet; City File No: PL18-034 18370 Cascade St changing the existing designation of Single Family High Density (SF-HI) to General Commercial (GC).  John Semrau, Mount Vernon- representing the owner. Expressed support for the change in designation. There being no further comments Mayor Boudreau closed the public hearing. Mount Vernon City Council December 12, 2018 Page 3 of 4 c) Mayor Boudreau opened the public hearing for Corner 9 Properties LLC; City File No: PL18- 035 located on Fraser Avenue near the intersection of Blackburn Road and South La Venture Road requesting a change in existing designation from Single-Family Medium Density (SF- MED) to Multi-Family Low Density (MF-LO).  Ana Nelson, Anacortes- Expressed support for the change in designation. There being no further comments Mayor Boudreau closed the public hearing. Councilmember Lindquist moved to approve Ordinance 3769 with 3B language, amending the Comprehensive Plan mapping to rezone the four outlined properties. Motion seconded by Councilmember Molenaar. Motion carried 7-0. B. EMS Briefing: Fire Chief Brice presented Council with an update on the EMS hiring process. C. Public Hearing- Technology Fee Ordinance: Mr. Phillips presented Council with information regarding the proposed ordinance to revise certain fees based on the approved 2019 City Budget. Mayor Boudreau opened the public hearing There being no comments Mayor Boudreau closed the public hearing. Councilmember Beaton moved to approve Ordinance 3770 increasing technology fees for building, engineering, fire and certain planning use permits. Motion seconded by Councilmember Lindquist. Motion carried 7-0. D. Approval of Agreement with BERK Consulting: Mr. Phillips presented Council with a request to authorize the Mayor to enter into an agreement with BERK Consulting to assist the City with Fire and Park Impact Fee changes. Councilmember Hulst moved to authorize the Mayor to enter into an agreement with BERK Consulting to assist the City with Fire and Park Impact Fee changes. Motion seconded by Councilmember Molenaar. Motion carried 7-0. E. Supplement to the REET I, REET II, Sewer Capital Reserve Fund, Surface Water Utility Fund, Transportation Benefit District Fund, General Fund and Street Department Fund 2018 Budgets: Mr. Volesky presented Council with a request to approve Ordinance 3771 to supplement various funds for capital project expenditures. All listed funds have available funds for these projects. Councilmember Lindquist moved to approve Ordinance 3771 to supplement various funds for capital project expenditures. Motion seconded by Councilmember Beaton. Motion carried 7-0. F. Approval of Agreement with Skagit County for Senior Services: Mr. Volesky presented Council with a request to authorize the Mayor to enter into an agreement with Skagit County for the provision of senior services for the calendar year 2019. Councilmember Hulst moved to authorize the Mayor to enter into an agreement with Skagit County for the provision of senior services for the calendar year 2019. Project Acceptance- Utility Grade Adjustment 2018: Mr. Bell presented Council with a request to accept the work performed by Carman’s Construction LLC, on the 2018 Utility Grade Adjustment contract in the amount of $70,824.03. Councilmember Lindquist moved to accept the work performed by Carman’s Construction LLC, on the 2018 Utility Grade Adjustment contract in the amount of $70,824.03. Motion seconded by Councilmember Beaton. Motion carried 7-0.
