City of Mount Vernon Regular Meeting Minutes February 26, 2020 7:00 p.m. (Police Court Campus) The meeting was called to order by Mayor Boudreau at 7:01 PM. Present: Councilmembers Beaton, Brocksmith, Hudson, Hulst, and Molenaar Excused: Councilmembers Carías, and Moberg Staff Present: Project Development Manager Donovan, City Attorney Rogerson, Parks & Enrichment Director King, Finance Director Volesky, Human Resources Director Keator, Library Director Huffman, Police Chief Cammock, Development Services Director Phillips, Wastewater Manager Duranceau, and City Engineer Bullock Citizens Present: 15 CONSENT AGENDA A. Approval of February 12, 2020 Regular Council Meeting Minutes B. Approval of February 20, 2020 payroll checks numbered 109892 - 109915 direct deposit checks numbered 75578 - 75823, and wire transfers numbered 824 – 828 in the amount of $1,198,188.72 C. Approval of February 26, 2020 Claims numbered 7784, 7787 and 7800 - 8124 in the amount of $1,767,875.57 Councilmember Hulst moved to approve the Consent Agenda items A-C. Motion seconded by Councilmember Molenaar. Motion carried 5-0. REPORTS A. Committees 1. Finance and Parks & Enrichment Services - see Committee minutes for details 2. Development Services - postponed B. Community Comments • Ellen Gamson – Executive Director with the Mount Vernon Downtown Association – Thanked the council for all of their work on Fire Station 1 and the Downtown Parking Structure. She informed the council that more businesses will be opening up in the downtown area in the next quarter and the need for parking will be greater than ever and implored the council to move with alacrity on addressing the parking shortage. • Rich Coleman – Mount Vernon Mobile Resident – Mr. Coleman was living out of his vehicle in the parking lot between W Kincaid St & W Broadway, near the Skagit County Public Defender’s Office, until he received a notice to vacate or be towed. This displaced himself and a number of others living in their vehicles as well. Mr. Coleman assured the council the 911 calls in the area were not related to the homeless living in the parking lot. He doesn’t know what the solution is but that the problem is only going to get worse. C. Council Member Comments • None Mount Vernon City Council February 26, 2020 Page 2 of 6 D. Mayor’s Report: • None E. Committee Agenda Requests • Councilmember Hulst – Expressed his desire to revisit the Downtown & Waterfront Area Master Plan with the Development Services Department. UNFINISHED BUSINESS • None NEW BUSINESS A. Appointment to Mount Vernon Arts Commission: Mr. King requested Council approve the appointment of Daniel Brooks to the Mount Vernon Arts Commission. Councilmember Molenaar moved to approve the appointment of Daniel Brooks to the Mount Vernon Arts Commission. Motion seconded by Councilmember Hulst. Motion carried 5-0. B. Open Record Public Hearing – CDBG 2020 – 2021 Action Plan: Mr. Donovan requested Council open record public hearing to obtain the views of residents and other interested parties on the housing and non-housing community development needs of the City before a draft Community Development Block Grant {CDBG} 2020 – 2021 Action Plan is prepared. Mayor Boudreau opened the open record public hearing. • Melissa Self - advocated for funding on behalf of Community Action of Skagit. They are the main resource for people looking for homes and also work with other non- profits to provide basic and transportation needs to the community. • Teresa Pugh - advocated for funding on behalf of Habitat for Humanity. Funding would be applied toward additional housing. • Tina Tate - advocated for funding on behalf of the Friendship House. Funding would be applied toward additional housing for low income elderly individuals. • Melany Corey - advocated for funding on behalf of Skagit County Affordable Housing. Funding would be applied toward affordable housing and their housing weatherization assistance program. • Judy Dean - advocated for funding on behalf of Home Trust of Skagit. Funding would be used to assist 4 families with the down payments required to purchase their own homes. • Lynn Christopherson - advocated for funding on behalf of Community Action of Skagit. They are currently going through an extensive remodel and would use the funding to assist with infrastructure needs such as drainage, entry, and egress. • TJ Larrick - advocated for funding on behalf of Habitat for Humanity. Mr. Larrick asked council to consider collaborating with Habitat for Humanity when making affordable housing considerations. There being no further comments Mayor Boudreau closed the open record public hearing. • Mr. Donovan requested those advocating for CDBG funding to present a letter of interest stating why they would like the funds and that a draft of the action plan would be put together in the coming weeks. Mount Vernon City Council February 26, 2020 Page 3 of 6 C. NW Clean Air Agency Update: Mark Buford, Executive Director of Northwest Clean Air Agency, updated the Council on his organization’s latest efforts to preserve, protect, and enhance Mount Vernon’s air quality. D. Approval of Agreement – Skagit County Tourism Promotion Area: Mr. Donovan requested Council to authorize the Mayor to enter into an agreement with Skagit County, and each of the cities and towns, in establishing a Tourism Promotion Area. Councilmember Hulst moved to authorize the Mayor to enter into an agreement with Skagit County, and each of the cities and towns, in establishing a Tourism Promotion Area under the authority of Chapter 39.34 RCW. Motion seconded by Councilmember Beaton. Motion carried 5-0. E. Approval of Agreement – Economic Development Alliance of Skagit County: Mr. Volesky requested Council authorize the Mayor to enter into an agreement with the Economic Development Alliance of Skagit County for the calendar year 2020. Councilmember Molenaar moved to authorize the Mayor to enter into an agreement with the Economic Development Alliance of Skagit County for the calendar year 2020. Motion seconded by Councilmember Hulst. Motion carried 5-0. . F. Sole Source Purchase – FLYGT NT-3301 Influent Pumps: Mr. Bullock requested Council approve Resolution 974, authorizing a sole source purchase of three Flygt influent pumps for the Wastewater Treatment Plant. Approval of Interlocal Agreement and Right-of-Way Easement for 3rd & Kincaid Street U-Turn: Mr. Phillips requested Council authorize the Mayor to enter into an interlocal agreement and right-of-way easement with Skagit County for property to be utilized for a U-turn at 3rd and Kincaid Streets. Councilmember Beaton moved to authorize the Mayor to enter into an interlocal agreement and right-of-way easement with Skagit County for property to be utilized for a U-turn at 3rd and Kincaid Streets. Approval of Agreement – Building Inspection Professional Services: Mr. Phillips requested Council authorize the Mayor to enter into an agreement with MTC in the amount of $40,000 for a building inspector. Councilmember Hulst moved to authorize the Mayor to enter into a professional services agreement with Skagit Surveyors & Engineers to provide on-call planning work. Approval of Agreement with Armadillo Design Lab: Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with Armadillo Design Lab to provide design review services for projects required to comply with this portion of the MVMC. Councilmember Molenaar moved to authorize the Mayor to enter into a professional services agreement with Armadillo Design Lab to provide design review services for projects required to comply with this portion of the MVMC. Approval of Agreement with 7K Environmental: Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with 7K Environmental {Kate Knox} to provide critical area monitoring, peer review and related services. Councilmember Hudson moved to authorize the Mayor to enter into a professional services agreement with 7K Environmental {Kate Knox} to provide critical area monitoring, peer review and related services. Approval of Agreement with Transportation Solutions, Inc.: Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with Transportation Solutions, Inc. to provide consultant services related to traffic concurrency applications processed by the department. Councilmember Beaton moved to authorize the Mayor to enter into a professional services agreement with Transportation Solutions, Inc. to provide consultant services related to traffic concurrency applications processed by the department. Lee and Associates, Inc.: Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with L.C. Lee and Associates {Dr. Lyndon Lee} to provide consultant services related to critical areas. Councilmember Hulst moved to authorize the Mayor to enter into a professional services agreement with L.C. Lee and Associates {Dr. Lyndon Lee} to provide consultant services related to critical areas that include: updates to the City’s shoreline mapping, biological opinion implementation and review of development projects. Approval of Agreement with Olbrechts & Associates, PLLC: Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with Olbrechts & Associates, PLLC {Phil Olbrechts, Esq.} to act as the City’s on-call Hearing Examiner. Councilmember Hudson moved to authorize the Mayor to enter into a professional services agreement with Olbrechts & Associates, PLLC {Phil Olbrechts, Esq.} to act as the City’s on-call Hearing Examiner. Motion seconded by Councilmember Beaton. Motion carried 5-0. O. Approval of Agreement with Christian Carlson, AIA: Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with Christian Carlson, AIA, to provide design review services for projects required to comply with this portion of the MVMC. Councilmember Brocksmith moved to authorize the Mayor to enter into a professional services agreement with Christian Carlson, AIA, to provide design review services for projects required to comply with this portion of the MVMC. Motion seconded by Councilmember Hudson. Motion carried 5-0. P. Approval of Agreement with Land Development Engineering & Surveying, Inc. (LDES): Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with Land Development Engineering & Surveying Inc. to provide on-call engineering and surveying services for the City. Councilmember Molenaar moved to authorize the Mayor to enter into a professional services agreement with Land Development Engineering & Surveying Inc. (LDES) to provide on-call engineering and surveying services for the City. Motion seconded by Councilmember Brocksmith. Motion carried 5-0. Q. Approval of Agreement with Urban Forestry (Jim Barborinas): Mr. Phillips requested Council authorize the Mayor to enter into a professional services agreement with Urban Forestry to provide arboricultural services to assist staff in implementation of the Mount Vernon Municipal Code. Councilmember Hulst moved to authorize the Mayor to enter into a professional services agreement with Urban Forestry to provide arboricultural services to assist staff in implementation of the Mount Vernon Municipal Code. Motion seconded by Councilmember Hudson. Motion carried 5-0. R. Executive Session: Collective Bargaining Discussion, per RCW 42.30.140(4)(b). The meeting was convened into executive session at 8:22 p.m. and was estimated to last 15 minutes. Also attending the session were Mr. Rogerson and Ms. Keator.
