Approval of Agreement with Washington State Library: Mr. Huffman requested approval of an agreement with the Washington State Library to provide a Library Services and Technology Act (LSTA), American Rescue Plan Act (ARPA) grant to the City in the amount of $14,935. Councilmember Hulst moved to authorize the Mayor to enter into an agreement with the Washington State Library for a LSTA, ARPA grant in the amount of $14,935. Motion seconded by Councilmember Molenaar. Motion carried 6-0. B. Approval of Agreement with Skagit PUD: Mr. Phillips requested approval of an interlocal agreement with Skagit PUD for the Freeway Drive Improvements project. Councilmember Beaton moved to authorize the Mayor to enter into an interlocal agreement with Skagit PUD for the Freeway Drive Improvements Project. Motion seconded by Councilmember Morales. Motion carried 6-0. C. Approval of Agreement Insituform Technologies, LLC.: Mr. Phillips requested approval of an agreement with Insituform Technologies, LLC. for the 2021 Sanitary and Storm Sewer Lining project in the amount of $695,293.47. Motion seconded by Councilmember Morales. Motion carried 6-0. D. Approval of Agreement with The Clean Team: Ms. Berner requested approval of the fourth amendment to agreement 3919 with The Clean Team for janitorial services in public restrooms. The amendment extends the term and compensation through December 2021. Councilmember Molenaar moved to authorize the Mayor to enter into the fourth amendment to agreement 3919 with The Clean Team for janitorial services in public restrooms. Motion seconded by Councilmember Beaton. Motion carried 6-0. E. Approval of Street Closure Request: The request was withdrawn. F. Approval of Agreement with Skagit County: Chief Cammock requested approval of an interlocal agreement with Skagit County to establish Criminal Justice Information System Management Control for Spillman Services. Spillman is a records management system shared by all law enforcement agencies in Skagit County and managed by Skagit County. Councilmember Hulst moved to authorize the Mayor to enter into an interlocal agreement with Skagit County to establish Criminal Justice Information System Management Control. Motion seconded by Councilmember Beaton. Motion carried 6-0. G. Approval of Agreement with NoaNet: Mr. Kleppe requested approval of a fiber licensing and operating agreement with NoaNet to provide ISP services. Councilmember Molenaar moved to authorize the Mayor to enter into an agreement with NoaNet for fiber licensing and operation. Motion seconded by Councilmember Brocksmith. Motion carried 6-0. The meeting was adjourned into Executive Session at 7:25 p.m. for a period of thirty minutes to discuss with legal counsel matters relating to the consideration of the minimum price of real estate which would be offered for sale or lease when public knowledge of the discussion is likely to result in decreased price and to discuss matters pertaining to collective bargaining. (required action – motion) (staff contact – Kim Kleppe) COMMITTEE MEETINGS Public Works and Library 6:00 p.m. Next Ordinance 3837 Next Resolution 1001 AGENDA ITEM: A DATE: October 13, 2021 TO: Mayor Boudreau and City Council FROM: Isaac Huffman, Library Director SUBJECT: INTERLOCAL AGREEMENT WITH THE WASHINGTON STATE LIBRARY RECOMMENDED ACTION: Staff recommends that Council authorize the Mayor to enter into an Interlocal Agreement with Washington State Library. INTRODUCTION/BACKGROUND: This year the Library Commons Project was awarded a $14,935 Library Services and Technology Act (LSTA) American Rescue Plan Act (ARPA) grant. The goal of this grant is to support required changes to the library due to the COVID-19 pandemic. Because the grant has specific use requirements, an interlocal agreement between the State of Washington and the City of Mount Vernon is necessary. A similar interlocal agreement was signed as part of CARES funding in 2020 but was below the threshold for Council approval. FINDINGS/CONCLUSIONS: The terms of this agreement align with similar interlocal agreements for receiving funding. RECOMMENDATION: Staff recommends approval of the interlocal agreement with the Washington State Library to receive LSTA ARPA funds. ATTACHED: LSTA ARPA Agreement with the Washington State Library AGENDA ITEM: B DATE: October 13, 2021 TO: Mayor Boudreau and City Council FROM: Chris Phillips, Acting Public Works Director SUBJECT: INTERLOCAL COOPERATIVE AGREEMENT BETWEEN CITY OF MOUNT VERNON AND SKAGIT PUD - FREEWAY DRIVE IMPROVEMENTS RECOMMENDED ACTION: Authorize Mayor to execute an Interlocal Cooperative Agreement with Skagit PUD to share resources to incorporate duplicative redevelopment frontage improvements into the City’s Freeway Drive Improvements Project. INTRODUCTION/BACKGROUND: Skagit PUD has been engaged in a proposed redevelopment of their administration office and other site facilities at 1415 Freeway Drive. This PUD redevelopment project included frontage improvement requirements to establish curb, gutter, sidewalk, drainage, and restoration along Freeway Drive within the project limits of the City’s Freeway Drive Improvements Project between Cameron Way and College Way. These frontage improvement elements are largely duplicative of the sidewalk and drainage improvements planned for the larger City project and combining these efforts is advantageous to both the City and the PUD. FINDINGS/CONCLUSIONS: As the City began to design the street improvements on Freeway Drive, initial coordination with the PUD in the design phase found that combining efforts and incorporating the PUD frontage improvements along PUD property as a single project would gain a substantial economy of scale, prevent design discontinuities from separate efforts, and reduce construction conflicts. It was determined the best way to do this was for PUD to contribute the value of their frontage improvement scope, on an invoice basis, to the City through an interlocal agreement similar to the Fir Street paving interlocal agreement executed earlier this year. The Skagit PUD fair share contribution is $209,000. RECOMMENDATION: Staff recommends a motion to authorize the Mayor to execute an Interlocal Agreement with Skagit PUD to cooperatively share resources to construct frontage sidewalk and drainage improvements as part of the Freeway Drive Improvements Project with a fair share contribution from Skagit PUD in the amount of $209,000. ATTACHED: Draft City/Skagit PUD Interlocal Agreement AGENDA ITEM: C DATE: October 13, 2021 TO: Mayor Boudreau and City Council FROM: Chris Phillips, Acting Public Works Director SUBJECT: AWARD OF BID FOR PROJECT # SS-2021-003: 2021 SANITARY AND STORM SEWER LINING RECOMMENDED ACTION: Staff recommends a motion be made by Council to award the 2021 Sanitary and Storm Sewer Lining Project to Insituform Technologies, LLC for the bid amount of $695,293.47. INTRODUCTION/BACKGROUND: On August 25, 2021, bids were opened and read for the 2021 Sanitary and Storm Sewer Lining project. The project includes lining approximately 9,444 feet of sanitary sewer pipe and approximately 2,073 feet of storm sewer pipe with a cured in place pipe (CIPP) liner system. A total of 2 bids were received and considered. FINDINGS/CONCLUSIONS: After reviewing the bids, staff determined that the bid submitted by Insituform Technologies for $695,293.47 was the lowest bid from a responsible bidder per the contract and per RCW 39.04.010 and RCW 39.04.350. RECOMMENDATION: Staff recommends Council award the construction bid for the 2021 Sanitary and Storm Sewer Lining Project to Insituform Technologies, LLC for the bid amount of $695,293.47. ATTACHED: Bid Tabulation AGENDA ITEM: D DATE: October 13, 2021 TO: Mayor Boudreau and City Council FROM: Jennifer Berner, Parks and Enrichment Services Director SUBJECT: THE CLEAN TEAM AGREEMENT AMENDMENT RECOMMENDED ACTION: Staff recommends Council authorize the Mayor to sign the amendment to the agreement extending the term through December 2021. INTRODUCTION/BACKGROUND: The Clean Team was hired in 2020, during staff cutbacks related to COVID, to assist with the cleaning and sanitizing of City owned public restrooms. FINDINGS/CONCLUSIONS: With the assistance of The Clean Team, public restrooms have been available for public use. With current staffing levels and workload, utilizing The Clean Team expertise to assist with janitorial services has freed up department staff for other park, trail, and facility maintenance. RECOMMENDATION: Staff recommends extending the agreement with The Clean Team through December 2021. ATTACHED: Amendment to The Clean Team Agreement. AGENDA ITEM: E City of MOUNT VERNON DATE: October 13, 2021 TO: Mayor Boudreau and City Council FROM: Jennifer Berner, Parks and Enrichment Services Director SUBJECT: STREET CLOSURE REQUEST - MVHS HOMECOMING RECOMMENDED ACTION: Staff recommends Council approve the Street Closure Request for the 2021 Mount Vernon High School Homecoming Parade. INTRODUCTION/BACKGROUND: The Mount Vernon High School's Homecoming Parade will be held on Friday October 22, 2021 at 1:00pm. FINDINGS/CONCLUSIONS: This parade will encourage student participation in school activities and school spirit. It will bring community members together safely through a community event that contributes to fulfilling the mission of the City to promote Mount Vernon as a wonderful place to come, visit, do business, and live. RECOMMENDATION: Staff recommends the temporary closure of South 1st Street and Cleveland Avenue to accommodate the 2021 Mount Vernon High School Homecoming Parade. ATTACHED: Street Closure Request AGENDA ITEM: F DATE: October 13, 2021 TO: Mayor Boudreau and City Council FROM: Chief Cammock SUBJECT: INTERLOCAL AGREEMENT WITH SKAGIT COUNTY RECOMMENDED ACTION: Staff recommends a motion to approve an Interlocal Agreement with Skagit County to establish Criminal Justice Information System Management Control. INTRODUCTION/BACKGROUND: This is a standard agreement between Police and Skagit County IS department for Spillman services, which is a Records Management system and is a shared system between all Law Enforcement agencies in Skagit County. FINDINGS/CONCLUSIONS: The current agreement is expired. A valid agreement is required by the state and there are two open audits regarding the ACCESS system, pending approval of this updated agreement. The ACCESS system is used by law enforcement for queries into state and national databases, entry of warrants, protection orders, stolen vehicles, articles, query of probation, Department of Licensing information, and more. RECOMMENDATION: Staff recommends approval of an Interlocal Agreement with Skagit County for management control of the Criminal Justice System. ATTACHED: Interlocal Agreement for Management Control Agreement AGENDA ITEM: G DATE: October 13, 2021 TO: Mayor Boudreau and City Council FROM: Kim Kleppe, IS Director SUBJECT: FIBER LICENSE AND OPERATING AGREEMENT RECOMMENDED ACTION: Staff recommends that Council authorize the Mayor to execute a Fiber Optic and Operating License Agreement with NoaNet. INTRODUCTION/BACKGROUND: -The City has agreements with 5 providers currently. - Council has previously authorized fiber license agreements similar to the attached. - This agreement will allow NoaNet to provide ISP services to the City of Mount Vernon fiber customers. FINDINGS/CONCLUSIONS: -NoaNet has already been providing Dark Fiber Services in the city of Mount Vernon. -NoaNet is a public-benefit wholesale telecommunications organization that supplies solutions and resources for all aspects of broadband and telecom projects to serve Washington State. -NoaNet was formed by Public Utility Districts (PUDs) in Washington State with the mission to bring high-speed telecommunication services to unserved and underserved communities.
