(required action – motion) (staff contact – William Bullock) COMMITTEE MEETING Public Works and Library 6:00 p.m. Next Ordinance 3871 Next Resolution 1041  AGENDA ITEM: A DATE: July 12, 2023 TO: Mayor Boudreau and City Council FROM: William Bullock, PE – City Engineer SUBJECT: FREEWAY DRIVE IMPROVEMENTS PROJECT: AMENDMENT NO. 3 WITH PBS ENGINEERING AND ENVIRONMENTAL, INC. RECOMMENDED ACTION: Staff recommends amending the Professional Services Agreement with PBS Engineering and Environmental (PBS) to cover scope changes required to finalize construction management during the Freeway Drive Improvements Project. INTRODUCTION/BACKGROUND: Throughout the construction of the Freeway Drive project, there were an inordinate number of change requests made by the contractor, several were determined to be unacceptable and rejected, through the duration of the project. This level of change requests from the contractor increased the amount of administration to document, research, and respond to each request including additional inspection time to track such activities. Part of the inspection cost increase was due in part to weather related project duration increases as well, such as the 2021 flood event. FINDINGS/CONCLUSIONS: This amendment represents a true up of construction management costs that required additional effort and exceeded the limit of the original professional services contract. This serves to fully compensate PBS for these services to complete construction. Contract Amendment No. 3 adds $58,070 to the current contract for a new contract total of $542,814. RECOMMENDATION: Motion to authorize the Mayor to execute contract Amendment No. 3 with PBS Engineering and Environmental, Inc., to provide the additional construction management services required to finalize construction of the Freeway Drive Improvements Project for a new total contract amount not to exceed $542,814.
