City of Mountain View Minutes Environmental Planning Commission Wednesday, January 20, 2021 7:00 PM Video Conference with No Physical Meeting Location This meeting was conducted in accordance with State of California Executive Order N-29-20, dated March 17, 2020. All members of the Environmental Planning Commission participated in the meeting by video conference, with no physical meeting location. 1. CALL TO ORDER Vice Chair Cranston called the meeting of the Environmental Planning Commission (EPC) to order at 7:02 p.m. 2. ROLL CALL Present 7- Commissioner Margaret Capriles, Commissioner Hank Dempsey, Commissioner Preeti Hehmeyer, Commissioner Kammy Lo, Commissioner Allie Schmiesing, Commissioner Joyce Yin and Vice Chair Bill Cranston 3. MINUTES APPROVAL Vice Chair Cranston opened the floor at 7:03 p.m. for public testimony asking if anyone from the public wished to speak. No members of the public wished to speak. Public testimony concluded at 7:03 p.m. The Environmental Planning Commission considered the minutes in one motion. MOTION- MS - Hehmeyer / Lo - That the Environmental Planning Commission approve the minutes of November 18, 2020, and December 2, 2020. The motion passed on the following vote: Yes: 7- Commissioner Capriles, Commissioner Dempsey, Commissioner Hehmeyer, Commissioner Schmiesing, Commissioner Yin, Commissioner Lo and Vice Chair Cranston 4. ORAL COMMUNICATIONS FROM THE PUBLIC Vice Chair Cranston opened the floor at 7:05 p.m. to public testimony asking if anyone from the public wished to speak on anything not on the agenda. No members of the public wished to speak. Public testimony concluded at 7:06 p.m. 5. PUBLIC HEARING 5.1 Density Bonus Ordinance City of Mountain View Page 1 Environmental Planning Minutes January 20, 2021 Commission Assistant Planner Anna Salvador gave an oral presentation and answered questions raised by the EPC. Principal Planner Eric Anderson, and Assistant City Attorney Nicole Wright, answered questions raised by the EPC. Vice Chair Cranston opened the floor at 7:38 p.m. to public testimony, asking if anyone from the public wished to speak on this item. SPEAKING FROM THE FLOOR: Dennis Martin, Building Industry Association of the Bay Area Alex Nunez Emily Ann Ramos, Mountain View YIMBY Public testimony concluded at 7:47 p.m. The EPC deliberated on this item. Motion - M/S Capriles / Hehmeyer - That the Environmental Planning Commission: Adopt a Resolution Recommending the City Council Adopt an ordinance to repeal, in its entirety, Division 11 of Article IV of Chapter 36 of the Mountain View City Code and Add a new Division 8 of Article XVI of Chapter 36 of the Mountain View City Code Related to Density Bonus; with modifications to 36.45.75 (g) to specify for developments that do not provide a sufficient number of affordable units to qualify for a density bonus. The motion passed by the following vote: Yes: 7- Commissioner Capriles, Commissioner Dempsey, Commissioner Hehmeyer, Commissioner Schmiesing, Commissioner Yin, Commissioner Lo and Vice Chair Cranston 6. NEW BUSINESS 6.1 Election of Environmental Planning Commission (EPC) Chair and Vice Chair for 2021 Election of the EPC Chair Commissioner Schmiesing nominated Vice Chair Cranston for Chair. Vice Chair Cranston opened the floor at 8:00 p.m. to public testimony, asking if anyone from the public wished to speak on this item. No members of the public wished to speak. Public testimony concluded at 8:00 p.m. MOTION - M / S Schmiesing / Lo - That the EPC elect Vice Chair Cranston to Chair. The motion passed on the following vote: Yes: 7- Commissioner Capriles, Commissioner Dempsey, Commissioner Hehmeyer, Commissioner Schmiesing, Commissioner Yin, Commissioner Lo and Vice Chair Cranston City of Mountain View Page 2 Environmental Planning Minutes January 20, 2021 Commission Election of Environmental Planning Vice Chair Election of the EPC Vice Chair Commissioner Capriles nominated Commissioner Lo for Vice Chair. Chair Cranston opened the floor at 8:03 p.m. to public testimony, asking if anyone from the public wished to speak on this item. No members of the public wished to speak. Public testimony concluded at 8:04 p.m. MOTION - M / S - Capriles / Yin - That the EPC elect Commissioner Lo to Vice Chair. The motion passed on the following vote: Yes: 7- Commissioner Capriles, Commissioner Dempsey, Commissioner Hehmeyer, Commissioner Schmiesing, Commissioner Yin, Commissioner Lo and Vice Chair Cranston 7. COMMISSION/STAFF ANNOUNCEMENTS, UPDATES, REQUESTS, AND COMMITTEE REPORTS The Commission welcomed Commissioner Dempsey to the EPC. Principal Planner Eric Anderson provided an update on the upcoming agenda for the February 3, 2021 EPC meeting. Commissioner Hehmeyer inquired about the League of California Cities going virtual this year for training. Chair Cranston requested R3 Zoning updates. 8. The Environmental Planning Commission may consider and act on items listed on the agenda in any order and thus those interested in an item listed on the agenda are advised to be present throughout the meeting. It is the policy of the Environmental Planning Commission that all evening meetings of the Commission, including Study Sessions, be adjourned no later than 10:00 p.m., which time is referred to as the normal time of adjournment. No new item of business shall be taken up by the Commission after 10:00 p.m. unless the Commission has determined by majority vote to set aside this policy. In the event it appears that the entire agenda cannot be completed by the normal time of adjournment, the Commission may take up and act upon the more pressing agenda items. Anyone wishing to address the Commission on a nonagenda item may do so during the Oral Communications portion of the agenda. Speakers are allowed to speak one time on any number of topics for up to three minutes. An individual speaker shall have up to 3 minutes to address the Commission. For any agenda item or for Oral Communications on nonagenda items, if there appears to be a large number of speakers, the Chair may reduce speaking time to no less than 1.5 minutes per speaker unless there is an objection from Commission by majority vote. Pursuant to Government Code Section 54954.3(b)(1), at least twice the allotted speaking time will be provided to a member of the public who utilizes a translator.
