June 13, 2019 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, June 13, 2019, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade The following representatives of the City were also present: Craig Tindall, City Manager Adam Tucker, City Attorney David Ives, Deputy City Attorney Melissa Wright, City Recorder/ Finance Director Darren Gore, Assistant City Manager/ Utility Enterprise Gary Whitaker, Assistant City Manager/ Development and Coordination Erin Tucker, Budget Director Donald Anthony, Planning Director Linda Gilbert, Director of City Schools Matthew Blomeley, Assistant Planning Director Mr. Smotherman commenced the meeting with a prayer and led those present with the Pledge of Allegiance. The Consent Agenda was presented to the Council for approval: 1. VA Golf Course Lease Renewal (Golf) 2. FY 2019 City Manager Approved Budget Amendments (Finance) 3. Professional Services Agreements with Tennis Instructors (Parks & Recreation) (Insert letters from Golf Department, Finance Department, and Parks & Recreation Department here.) Mr. Shacklett made a motion to approve the Consent Agenda. Mr. Martin seconded the motion and all members of the Council voted “Aye”. The following letter from the Budget Director was presented to the Council: (Insert letter dated June 13, 2019 here with regards to FY 20 Budget Changes.) Mrs. Erin Tucker, Budget Director, presented the amended Fiscal Year 2019-2020 Budget proposal which included decreasing the proposed Solid Waste fee increase from $10.00 per month to $7.50 per month, decreasing the proposed property tax rate increase from $1.3194 to $1.2894, and changes to the General Fund to balance the budget. Mr. Smotherman made a motion to approve the amended FY 2019-2020 Budget. Mr. Wade seconded the motion and all members of the Council voted “Aye”. June 13, 2019 Page 2 An ordinance, entitled “ORDINANCE 19-O-13, providing for the levy and collection of a tax for the year 2019 upon all property, real, personal, and mixed, within the City of Murfreesboro that is now taxable under the laws and Constitution of the State of Tennessee and the Charter of said City, and for the interest and costs to be added to such taxes after certain dates,” which had been amended by staff and approved by Council on June 12, 2019, was read to the Council and offered for passage on second and final reading upon motion made by Mr. Wade, seconded by Mr. Smotherman. Upon roll call said ordinance, as amended, was passed on second and final reading by the following vote: Aye: Madelyn Scales Harris Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: Rick LaLance Said ordinance so passed on second and final reading is as follows: (Insert ORDINANCE 19-O-13 here.) An ordinance, entitled “ORDINANCE 19-O-12 adopting a budget and appropriations ordinance providing for appropriations out of the general and special funds of the City of Murfreesboro, Tennessee, of certain sums to defray the current, necessary and special expenses of said City for the Fiscal Year 2019-2020, and for other purposes,” which had been amended by staff and approved by Council on June 12, 2019, was read to the Council and offered for passage on second and final reading upon motion made by Mr. Smotherman, seconded by Mr. Wade. Upon roll call said ordinance was passed on second and final reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Said ordinance so passed on second and final reading is as follows: (Insert ORDINANCE 19-O-12 here.) The Mayor requested that staff research and see if there is an option or a way to freeze property tax if you are 65 years or older and have lived at your property for more than twenty years, and a potential code violation improvement property tax reduction program. June 13, 2019 Page 3 The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 13, 2019 here with regards to scheduling public hearings for annexation plan of services, annexation petition, and zoning for 3.1 acres along Shelbyville Pike; zoning for 20.06 acres along New Salem Highway and south of Middle Tennessee Boulevard; zoning for 13.04 and 1.95 acres along New Salem Highway; and annexation plan of services, annexation petition, and zoning for 85.6 and 83 acres respectively along Lee Lane.) The following RESOLUTION 19-R-PH-20 was read to the Council and offered for adoption upon motion made by Mr. LaLance, seconded by Mr. Smotherman. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 19-R-PH-20 here to schedule a public hearing for July 25, 2019 to consider (1) adoption of a Plan of Services for and annexation of 3.1 acres and (2) zoning of approximately 3.1 acres along Shelbyville Pike to Commercial Highway (CH) District which have been proposed to be annexed to the City of Murfreesboro, Tennessee, [2019-504] & [2019-411]; Douglas Dales and Five Star Joint Venture, applicants.) The following RESOLUTION 19-R-PH-21 was read to the Council and offered for adoption upon motion made by Mr. LaLance, seconded by Mr. Smotherman. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 19-R-PH-21 here to schedule a public hearing for July 25, 2019 for a proposed amendment of the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, constituting a part of said Ordinance, as heretofore amended and as now in force and effect, so as to consider a proposed amendment to rezone approximately 20.06 acres located east of New Salem Highway and south of Middle Tennessee Boulevard from Heavy Industrial (H-I) District to Light Industrial (L-I) District [2019-413]; Newton and James Molloy Families, applicants.) The following RESOLUTION 19-R-PH-22 was read to the Council and offered for adoption upon motion made by Mr. LaLance, seconded by Mr. Smotherman. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris June 13, 2019 Page 4 Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 19-R-PH-22 here to schedule a public hearing for July 25, 2019 for a proposed amendment of the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, constituting a part of said Ordinance, as heretofore amended and as now in force and effect, so as to consider a proposed amendment to rezone an area located along New Salem Highway, approximately 13.04 acres from General Office (OG) District and Residential Multi-Family Sixteen (RM-16) District to Single-Family Attached, Suburban Townhouse (RS-A Type 2) District and approximately 1.95 acres from Single-Family Residential Fifteen (RS-15) District to Single-Family Residential Six (RS-6) District [2019-412]; Tim McClure, applicant.) The following RESOLUTION 19-R-PH-23 was read to the Council and offered for adoption upon motion made by Mr. LaLance, seconded by Mr. Smotherman. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 19-R-PH-23 here to schedule a public hearing for July 25, 2019 to consider (1) adoption of a Plan of Services for and annexation of 85.6 acres and (2) zoning of approximately 83 acres along Lee Lane to Heavy Industrial (H-I) District which have been proposed to be annexed to the City of Murfreesboro, Tennessee, [2019-505] & [2019-414]; James Jernigan, Virginia Jernigan, and Brian Berryman, applicants.) The following letter from the Director of City Schools was presented to the Council: (Insert letter dated June 13, 2019 here with regards to Salem Elementary Interactive Panels, Document Cameras, TVs and Projectors.) Dr. Linda Gilbert, Director of City Schools, presented the recommendation of the School System to approve the purchase of interactive panels, document cameras, TVs, and projectors from Beacon Technologies for $277,326. Mr. Shacklett made a motion to approve the equipment purchase for Salem Elementary School. Mr. Martin seconded the motion and all members of the Council voted “Aye”. The following letter from the City Recorder/Finance Director was presented to the Council: (Insert letter dated June 13, 2019 here with regards to Beer Permit Applications for Som Tum-Thai, 3138-C S. Church St.; Yoki Buffet, 1145 N.W. Broad St. and a Special Event Permits for Middle TN Museum of Natural History June 13, 2019 Page 5 for multiple events at 816 Old Salem Rd.) Mr. Wade made a motion to approve a Beer Permit for Som Tum-Thai, 3138-C South Church Street (Ownership Change) and Yoki Buffet, 1145 North West Broad Street (Ownership Change), subject to all building and codes inspections being met, and approval for Special Event Permits for Middle Tennessee Museum of Natural History on 7/27/19, 8/24/19, 9/21/19, and 10/13/19 at 816 Old Salem Road. Mr. LaLance seconded the motion and all members of the Council voted “Aye”. Upon recommendation of Mayor McFarland, Mr. Shacklett made a motion to reappoint Mr. Kent Syler to the Greenway Projects Committee (term ending June 30, 2022) and Mr. Eddie Miller and Dr. Linda Gilbert to the Parks and Recreation Commission (terms ending June 30, 2022). Additionally, Mr. Shacklett made a motion to appoint Dr. Wendy Beckman as Ex-Officio for MTSU to the Airport Commission to replace Dr. Ron Ferrara who has retired. Mr. Wade seconded the motion and all members of the Council voted “Aye”. The Finance Director announced that there were not any statements to be considered. Mr. Craig Tindall, City Manager, discussed with Council the upcoming plans for economic development in FY20 and introduced Mr. Jim Colson, Economic Development Consultant. Mr. Colson gave a presentation on the current economic situation of the Country, the region, and the City, the potential the City has to use smart economic development to expand its revenue base and answered questions from Council.
