June 27, 2019 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in regular session at its regular meeting place in the Council Chambers at City Hall at 7:00 p.m. on Thursday, June 27, 2019, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Council Member Rick LaLance was absent and excused from this session. The following representatives of the City were also present: Craig Tindall, City Manager Adam Tucker, City Attorney Melissa Wright, City Recorder/ Finance Director Darren Gore, Assistant City Manager/ Utility Enterprise Sam Huddleston, Executive Director Development Services Mike Browning, Public Information Director Greg McKnight, Development Projects Director Donald Anthony, Planning Director Mark Foulks, Chief of Fire and Rescue Robert Holtz, Building and Codes Director Mr. Wade commenced the meeting with a prayer and Austin Wilkes of St. Rose Troop 398 led those present with the Pledge of Allegiance. Mayor McFarland recognized Mrs. Liene Biddix, a member of the City Tax and Finance Department, who was sworn in today as an American Citizen. He also announced that Charlie Daniels was given the key to the City today for his help in opening the Veteran Center at MTSU. The Consent Agenda was presented to the Council for approval: 1. Annual Tennessee Airport Maintenance Grant (Airport) 2. Revision to Employee Handbook Section 4007 - Workers’ Compensation Policy and Procedures (Human Resources) 3. Master License Agreement Regarding Use of City Right of Way – United Communications (Legal) 4. Approval of Contract for Administration of Workers’ Compensation Claims Arising before July 1, 2019 (Legal) 5. Second Amendment to the Contract between the City of Murfreesboro and Rehrig Pacific Company Roll-Out Containers (Solid Waste) 6. Purchase of a Dump Truck with Snowplow (Street) 7. Contract with TDOT for FY20 Operating Assistance (Transportation) (Insert letters from Airport, Human Resources, Legal (2), Solid Waste, Street, and Transportation Departments here.) Mr. Shacklett made a motion to approve the Consent Agenda. Mr. Martin seconded the motion and all members of the Council present voted “Aye”. June 27, 2019 Page 2 The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 27, 2019 here regarding Zoning Ordinance Amendment: G-I General Industrial.) Mr. Donald Anthony, Planning Director, presented to Council the unanimous recommendation of the Planning Commission to amend the Zoning Ordinance to create the G-I (General Industrial) zone, pending a public hearing. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendment to the Zoning Ordinance step forward to the podium. Mr. Keith Jones, 127 Tenby Drive, supported the amendment to the Zoning Ordinance stating that he believed this would be a good way for the Planning Department to make sure industrial districts didn’t end up right next to homes. There was no one else present who wished to speak for or against the proposed amendment to the Zoning Ordinance and, after ample time had been given, Mayor McFarland declared the public hearing closed. Council questioned Mr. Anthony regarding the potential inclusion of lumber storage and metal fabrication to the General Industrial District zoning. An ordinance, amended to include lumber storage and metal fabrication, entitled “ORDINANCE 19-O-14 amending the Murfreesboro City Code, Appendix A-Zoning, Section 9, Standards for Special Use Permits; Section 13, Planned Development Regulations; Section 14, Districts Established; Section 18, Regulations of General Applicability; Section 22, Industrial Districts; Section 24, Overlay District Regulations; Section 25, Temporary and Accessory Structures and Uses; Chart 5, Required Loading Spaces by Use and Zoning District; Section 27, Landscaping and Screening; Chart 1 and Chart 1 Endnotes, Uses Permitted by Zoning District; Chart 2 and Chart 2 Endnotes, Minimum Lot Requirements, Minimum Yard Requirements, and Land Use Intensity Ratios; Table 1, Adjacent and Proposed Districts; and Table 2, Buffer Zone Requirements; pertaining to industrial zoning districts; City of Murfreesboro Planning Department, applicant [2019-803],” was read to the Council and offered for passage on first reading upon motion made by Mr. Martin, seconded by Mr. Wade. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None June 27, 2019 Page 3 The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 27, 2019 here regarding amendment to the Sign Ordinance to allow institutional group assembly uses to be eligible for PSO zoning.) Mr. Robert Holtz, Building and Codes Director, presented to Council the unanimous recommendation of the Planning Commission to amend the Sign Ordinance to allow institutional group assembly uses of at least twenty acres to be eligible to make application for PSO zoning, pending a public hearing. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendment to the Sign Ordinance step forward to the podium. There was no one present who wished to speak for or against the proposed amendment to the Sign Ordinance and, after ample time had been given, Mayor McFarland declared the public hearing closed. An ordinance, entitled “ORDINANCE 19-O-15 amending Murfreesboro City Code, Appendix A, Section 24, Article V, dealing with planned signage overlay; City of Murfreesboro Building and Codes Department, applicant [2019-806],” was read to the Council and offered for passage on first reading upon motion made by Mr. Smotherman, seconded by Mr. Wade. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 27, 2019 here regarding Sign Ordinance Amendment: Building Entry Signs, Banners, and Institutional Group Assembly Uses.) Mr. Robert Holtz, Building and Codes Director, presented to Council the unanimous recommendation of the Planning Commission to amend the Sign Ordinance to provide for signage for institutional group assembly uses located on at least five acres of land, pending a public hearing. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendment to the Sign Ordinance step forward to the podium. June 27, 2019 Page 4 There was no one present who wished to speak for or against the proposed amendment to the Sign Ordinance and, after ample time had been given, Mayor McFarland declared the public hearing closed. An ordinance, entitled “ORDINANCE 19-O-16 amending Murfreesboro City Code, Chapter 25.2-Signs, Sections 25.2-2, 25.2-25, and 25.2-26, dealing with building entry signs, pendants, institutional group assemblies; City of Murfreesboro Building and Codes Department, applicant [2019-805],” was read to the Council and offered for passage on first reading upon motion made by Mr. Shacklett, seconded by Mr. Wade. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None The following letter from the Airport Manger was presented to the Council: (Insert letter dated June 27, 2019 here with regards to Airport Economic Development Grant.) Mr. Daren Gore, Assistant City Manager of Utility Enterprise, presented the recommendation for the Council to approve the $2 million Airport Economic Development (AED) Grant from the Tennessee Aeronautics Division to be used for the South Terminal Development Project. Mr. Smotherman made a motion to approve the AED Grant. Mr. Wade seconded the motion and all members of the Council present voted “Aye”. The following letter from the Project Development Director was presented to the Council: (Insert letter dated June 27, 2019 here with regards to Murfreesboro Municipal Airport Terminal-Change Order No. 1.) Mr. Greg McKnight, Project Development Director, presented the Council with the recommendation to approve Murfreesboro Municipal Airport Terminal Change Order No. 1 with Smith Design/Build Corp., Inc. in the amount of $81,231. Mr. Martin made a motion to approve Change Order No 1. Mr. Wade seconded the motion and all members of the Council present voted “Aye”. The following letter from the Chief of Fire and Rescue was presented to the Council: (Insert letter dated June 27, 2019 here with regards to approval of proposal for purchase of Aerial Ladder Truck.) June 27, 2019 Page 5 Mr. Mark Foulks, Chief of Fire and Rescue, presented the Council with the recommendation to approve the 90% pre-payment proposal and enter a contract with Sutphen Corporation for a 75-foot mid-mount aerial ladder truck totaling $995,149. Mr. Shacklett made a motion to approve the contract with Sutphen Corporation. Mr. Martin seconded the motion and all members of the Council present voted “Aye”. The following letter from the City Recorder/Finance Director was presented to the Council: (Insert letter dated June 27, 2019 here with regards to Beer Permit Applications for Seafood Sensation, 123 SE Broad Street, and Cocina Express, 2089 Lascassas Pike.) Mr. Wade made a motion to approve Beer Permits for Seafood Sensation, 123 South East Broad Street (Ownership Change) and Cocina Express, 2089 Lascassas Pike (New Location), subject to all building and codes inspections being met. Mr. Smotherman seconded the motion and all members of the Council present voted “Aye”. Upon recommendation of Mayor McFarland, Mr. Wade made a motion to reappoint Mr. Ken Halliburton (term expires June 30, 2022) to the Board of Zoning Appeals; reappoint Ms. Jennifer Garland (term expires June 30, 2024) to the Historic Zoning Commission; and reappoint Ms. Kathy Jones (term expires June 30, 2022) to the Planning Commission. Mr. Shacklett seconded the motion and all members of the Council present voted “Aye”. The Finance Director announced that there were not any statements to be considered. Mr. Martin requested staff explain the funding of the Airport Terminal and the grant received for additional Airport construction.
