The City Council of the City of Murfreesboro, Rutherford County, Tennessee, met in
regular session at its regular meeting place in the Council Chambers at City Hall at 7:00
p.m. on Thursday, August 22, 2019, with Mayor Shane McFarland present and presiding and
with the following Council Members present and in attendance, to wit:

Mr. Martin commenced the meeting with a prayer and led those present with the
Pledge of Allegiance.
Mayor McFarland and Chief Mark Foulks introduced Assistant Commissioner Gary
Farley and Program Director Jeff Elliot of the State Fire and Rescue Department who
recognized the Murfreesboro Fire and Rescue Department for having the most contact hours
with the State Fire Academy of any career department.
Mr. Greg Tucker, Rutherford County Historian, gave a presentation on the history of
capital punishment in Murfreesboro and raised the question of whether Sam Davis was
executed or perhaps murdered.
The Consent Agenda was presented to the Council for approval:

Mr. Smotherman made a motion to approve the Consent Agenda, Mr. Wade
seconded the motion and all members of the Council present voted “Aye”.
The following letter from the Assistant Planning Director was presented to the
Council:

Mayor McFarland announced that the next item on the agenda is to conduct a public
hearing, pursuant to RESOLUTION 19-R-PH-29 adopted by the City Council on July 18,
2019, to consider a proposed amendment to rezone approximately 0.4 acres along North
Maple Street and West Lokey Avenue from Residential Duplex (RD) District to Planned
Residential Development (PRD) District (Maple Key Townhomes PRD); Buford Powell,
applicant [2019-418]. Notice of said public hearing was published in the August 6, 2019
issue of the local newspaper as follows:

Mr. Donald Anthony, Planning Director, presented the recommendation of the
Planning Commission to rezone approximately 0.4 acres located along North Maple Street
and West Lokey Avenue, pending a public hearing. Mr. Clyde Rountree, Huddleston-Steele
Engineering, presented the proposed plans for the project, a planned residential
development entitled “Maple Key Townhomes”.
Mayor McFarland then declared the public hearing open and invited those present
who wished to speak for or against the proposed rezoning step forward to the podium.
There was no one present who wished to speak for or against the proposed rezoning
and, after ample time had been given, Mayor McFarland declared the public hearing closed.
Mr. LaLance expressed his concern with the proposed development potentially
hindering the possible future road improvements to Lokey Avenue and asked staff to
investigate the matter before the ordinance came before Council on second reading.
An ordinance, entitled “ORDINANCE 19-OZ-29 amending the Zoning Ordinance and
the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now
in force and effect, to rezone approximately 0.4 acres along North Maple Street and West
Lokey Avenue from Residential Duplex (RD) District to Planned Residential Development
(PRD) District (Maple Key Townhomes PRD); Buford Powell, applicant [2019-418],” was
read to the Council and offered for passage on first reading upon motion made by Mr.

Mayor McFarland announced that the next item on the agenda is to conduct a public
hearing, pursuant to RESOLUTION 19-R-PH-30 adopted by the City Council on July 18,
2019, to consider a proposed amendment to rezone approximately 13.9 acres along North
Tennessee Boulevard from Commercial Fringe (CF) District to Planned Residential
Development (PRD) District (Brookwood Point PRD); Ole South Properties, Inc., applicant
[2019-419]. Notice of said public hearing was published in the August 6, 2019 issue of the

Mr. Donald Anthony, Planning Director, presented the unanimous recommendation of
the Planning Commission to rezone approximately 13.9 acres located along North
Tennessee Boulevard, pending a public hearing. Mr. Matt Taylor, SEC, presented the
proposed plans for the project, a planned residential development entitled “Brookwood
Point”.
Mr. LaLance was concerned with the possibility of the townhomes in the project
being bought and used as rental properties. Mr. Taylor assured him that the price point of
the townhomes tended to deter the townhomes being bought for rental properties.
Mayor McFarland then declared the public hearing open and invited those present
who wished to speak for or against the proposed rezoning step forward to the podium.
There was no one present who wished to speak for or against the proposed rezoning
and, after ample time had been given, Mayor McFarland declared the public hearing closed.
An ordinance, entitled “ORDINANCE 19-OZ-30 amending the Zoning Ordinance and
the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now
in force and effect, to rezone approximately 13.9 acres along North Tennessee Boulevard
from Commercial Fringe (CF) District to Planned Residential Development (PRD) District

Mayor McFarland announced that the next item on the agenda is to conduct a public
hearing, pursuant to RESOLUTION 19-R-PH-27 adopted by the City Council on July 18,
2019, to consider (1) adoption of a Plan of Services for and annexation of 18.2 acres and
(2) zoning of approximately 11.01 acres along Florence Road to Planned Residential
Development (PRD) District which have been proposed to be annexed to the City of
Murfreesboro, Tennessee; Saraswat Family Trust and Alcorn Properties, LLC, applicants
[2019-506 and 2019-420]. Notice of said public hearing was published in the August 6,
2019 issue of the local newspaper as follows:

Mr. Matthew Blomeley, Assistant Planning Director, presented the unanimous
recommendation of the Planning Commission to approve the Plan of Services and requested
annexation and zoning, pending public hearings.
Mayor McFarland then declared the public hearing open and invited those present
who wished to speak for or against the proposed Plan of Services and annexation for
approximately 18.2 acres located along Florence Road step forward to the podium.
Mr. Joseph Plummer, 304 Franklin Heights Drive, the father of a resident at 422
Burks Drive, opposed the proposed Plan of Services and annexation, stating that he has
concerns with the project regarding the increased potential for flooding it will bring which
will lead to increased flood insurance for the surrounding residents.
There was no one else present who wished to speak for or against the proposed Plan
of Services and annexation and, after ample time had been given, Mayor McFarland
declared the public hearing closed.
Mr. Matt Taylor, SEC, answered questions from Council regarding what preventative
measures were being taken to deal with the increased traffic from the proposed
development in the area and to decrease the risk of flooding to the areas surrounding the
proposed development.
The following RESOLUTION 19-R-PS-27 was read to the Council and offered for
adoption upon motion made by Mr. Martin, seconded by Mr. Wade. Upon roll call said

Northfield Boulevard and Sulphur Springs Road from Single-Family Residential Ten (RS-10)
District to Planned Commercial Development (PCD) District (Sanders Corner PCD); Henry

Mr. Matthew Blomeley, Assistant Planning Director, presented the unanimous
recommendation of the Planning Commission to rezone approximately 2.56 acres located
along West Northfield Boulevard and Sulphur Springs Road, pending a public hearing. Mr.
Clyde Rountree, Huddleston-Steele Engineering, presented the proposed plans for the
project, a planned commercial development entitled “Sanders Corner”.
Mayor McFarland then declared the public hearing open and invited those present
who wished to speak for or against the proposed rezoning step forward to the podium.
Mr. Ted Sullivan, 1215 Sulphur Springs Road, opposed the proposed rezoning,
stating that he had concerns with a convenience store that could be open twenty-four hours
a day being developed so close to private residences; that the buffer zones are not large
enough; and this development will bring increased traffic to the current residents.
There was no one else present who wished to speak for or against the proposed
rezoning and, after ample time had been given, Mayor McFarland declared the public
hearing closed.
Mayor McFarland announced that the increased traffic the proposed project could
bring to the area concerned him, and he would like the vote on the ordinance deferred until
staff and the developers could research the traffic issue more thoroughly.
An ordinance, entitled “ORDINANCE 19-OZ-26 amending the Zoning Ordinance and
the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now
in force and effect, to rezone approximately 2.56 acres along West Northfield Boulevard and
Sulphur Springs Road from Single-Family Residential Ten (RS-10) District to Planned
Commercial Development (PCD) District (Sanders Corner PCD); Henry and Linda Brendle,
applicants [2019-439],” was read to the Council and was deferred on first reading upon
motion made by Mr. Smotherman, seconded by Mr. LaLance. Upon roll call said motion to

Mr. LaLance made a motion to defer the vote on the Beer Permit for Murfreesboro
Axe until the City Attorney could research and determine if the City had a legal duty or
obligation to prohibit the sale of alcohol at an axe throwing establishment. Mr. Martin
seconded the motion and all members of Council present voted “Aye”.
Mr. LaLance made a motion to approve Beer Permits for Boro Quick Stop, 3208
Memorial Boulevard (Ownership Change) and Super Discounts Tobacco & Bear, 2568 South
Church Street, Suite B (Ownership Change), subject to all building and codes inspections
being met. Mr. Martin seconded the motion and all members of the Council present voted
“Aye”.
Under other business, the following letter from the Human Resources Director was
presented to the Council:
(Insert letter dated August 22, 2019 here with regards to approval
for the purchase of performance evaluation software.)
Ms. Pam Russell, Human Resources Director, presented the recommendation of the
Human Resources Department to approve the purchase of NEOGOV Performance Software
to conduct employee performance evaluations to assist the Human Resources Department
in automating the review process and analyze data to identify skill gaps plus optimize
employee development. Ms. Russell stated that the cost for set-up, installation and training
is $31,500 with an annual fee of $25,000 and renewal cost increase of no more than 5%.
Mr. Wade made a motion to approve the purchase of the NEOGOV Performance
Software. Mr. Martin seconded the motion and all members of the Council present voted
“Aye” except Mr. Smotherman who voted “Nay”.
There being no further business, Mayor McFarland adjourned this meeting at 9:21
p.m.
