June 18, 2020 The City Council of the City of Murfreesboro, Rutherford County, Tennessee, consistent with the Governor’s order, members of the City Council are participating by electronic means as has been determined necessary to protect public health, safety, and welfare in light of the coronavirus pandemic at 6:00 p.m. on Thursday, June 18, 2020, with Mayor Shane McFarland present and presiding and with the following Council Members present and in attendance, to wit: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Vice-Mayor Scales Harris and City Attorney Adam Tucker participated telephonically at this meeting. The following representatives of the City were also present: Craig Tindall, City Manager Adam Tucker, City Attorney Melissa Wright, City Recorder/ Finance Director Gary Whitaker, Assistant City Manager Darren Gore, Assistant City Manager Chris Griffith, Executive Director/ Public Infrastructure/City Engineer Raymond Hillis, Executive Director/ Public Works Sam Huddleston, Executive Director/ Development Services Angela Jackson, Executive Director/ Community Services David Ives, Deputy City Attorney Greg McKnight, Planning Director Robert Holtz, Building and Codes Director Ralph Ringstaff, Interim Director of Schools Matthew Blomeley, Assistant Planning Director Gary Anderson, Assistant Superintendent of Schools Joshua Miller, Administrative Assistant Vice-Mayor Scales Harris commenced the meeting with a prayer followed by Mayor McFarland leading the Pledge of Allegiance. The Consent Agenda was presented to the Council for approval: 1. FY 2020 Budget Amendments (Finance) 2. Amendments to PSAs for Tennis Instructors (Parks & Recreation) 3. Amendment to Grant Contract between GNRC and City (Parks & Recreation) 4. Mandatory Referral for Abandonment of Water Line Easement along West Northfield Boulevard (Planning) 5. Contract Extension – Annual Firing Range Membership (Police) 6. Contract Approval for Vehicle Equipment Purchase (Police) 7. Contract Extension - Laundry and Dry-Cleaner Services (Police/MFRD) 8. Contract with TDOT for Improve Act Funds (Transportation) 9. Contract Amendment with TripSpark for System Supply and Support Agreement (Transportation) June 18, 2020 Page 2 (Insert letters from Parks & Recreation (2), Planning, Police (2), MFRD, & Transportation (2) here.) Mayor McFarland announced that Item No. 1 on the Consent Agenda, Fiscal Year 2020 Budget Amendments, was to be pulled and heard under new business as RESOLUTION 20-R-11. Mr. Smotherman made a motion to approve the amended Consent Agenda. Mr. LaLance seconded the motion and all members of the Council voted “Aye”. The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 18, 2020 here regarding rezoning approximately 1.44 acres located at the northeast corner of Gold Valley Drive and North Rutherford Boulevard [2019-435].) An ordinance, entitled “ORDINANCE 20-OZ-14 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to rezone approximately 1.44 acres located at the northeast corner of Gold Valley Drive and North Rutherford Boulevard from Planned Commercial Development (PCD) District to Planned Residential Development (PRD) District (Rutherford Corner PRD); Masterson Homes, Inc., applicant [2019-435],” which passed first reading on June 4, 2020, was read to the Council and offered for passage on second and final reading upon motion made by Mr. Wade, seconded by Mr. Martin. Upon roll call said ordinance was passed on second and final reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Said ordinance so passed on second and final reading is as follows: (Insert ORDINANCE 20-OZ-14 here.) The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 18, 2020 regarding rezoning approximately 30 acres located along North Thompson Lane, West College Street, and West Northfield Boulevard [2020-403].) An ordinance, entitled “ORDINANCE 20-OZ-13 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect to zone approximately 30 acres along North Thompson Lane, West June 18, 2020 Page 3 College Street, and West Northfield Boulevard as Planned Signage Overlay (PSO) District; New Vision Baptist Church, applicant [2020-403],” which passed first reading on June 4, 2020, was read to the Council and offered for passage on second and final reading upon motion made by Mr. LaLance, seconded by Mr. Shacklett. Upon roll call said ordinance was passed on second and final reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None Said ordinance so passed on second and final reading is as follows: (Insert ORDINANCE 20-OZ-13 here.) The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 18, 2020 here with regards to amending the Westlawn PUD for approximately 10.5 acres located along Veterans Parkway and Shores Road [2020-404].) Mayor McFarland announced that the next item on the agenda is to conduct a public hearing, pursuant to RESOLUTION 20-R-PH-17 adopted by the City Council on May 21, 2020, to consider a proposed amendment to approximately 10.5 acres in the Planned Unit Development (PUD) District (Westlawn PUD) located along Veterans Parkway; Saint Thomas Rutherford, applicant [2020-404]. Notice of said public hearing was published in the June 2, 2020 issue of the local newspaper as follows: (Insert notice here.) Mr. Matthew Blomeley, Assistant Planning Director, presented the recommendation of the Planning Commission to approve the rezoning and introduced Mr. Gordon Ferguson, St. Thomas Rutherford Hospital, and Mr. David Hendrickson, Ragan-Smith Associates, Inc., who each gave a brief presentation of the proposed plans for the development. Mayor McFarland then declared the public hearing open and invited those present who wished to speak for or against the proposed amendment of approximately 10.5 acres in the Planned Unit Development (PUD) District (Westlawn PUD) located along Veterans Parkway, step forward to the podium. There was no one present who wished to speak for or against the proposed amendment and, after ample time had been given, Mayor McFarland declared the public hearing closed. June 18, 2020 Page 4 An ordinance, entitled “ORDINANCE 20-OZ-17 amending the Zoning Ordinance and the Zoning Map of the City of Murfreesboro, Tennessee, as heretofore amended and as now in force and effect, to amend the conditions applicable to approximately 10.5 acres in the Planned Unit Development (PUD) District (Westlawn PUD) located along Veterans Parkway; Saint Thomas Rutherford, applicant [2020-404],” was read to the Council and offered for passage on first reading upon motion made by Mr. Wade, seconded by Mr. Smotherman. Upon roll call said ordinance was passed on first reading by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None The following letter from the Assistant Planning Director was presented to the Council: (Insert letter dated June 18, 2020 here with regards to scheduling public hearings for rezoning along South Maney Avenue (Maney Station PUD) and expanding the uses permitted for property along North Thompson Lane (North Thompson Place PUD/Gateway Village.) The following RESOLUTION 20-R-PH-20 was read to the Council and offered for adoption upon motion made by Mr. Smotherman, seconded by Mr. Shacklett. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 20-R-PH-20 here to schedule a public hearing for July 23, 2020 to consider a proposed amendment to rezone approximately 0.47 acres along South Maney Avenue, north of East Castle Street, from Highway Commercial (CH) District and City Core Overlay (CCO) to Planned Unit Development (PUD) District (Maney Station PUD) and City Core Overlay (CCO); Saint Thomas Rutherford, applicant [2020-408].) The following RESOLUTION 20-R-PH-21 was read to the Council and offered for adoption upon motion made by Mr. Smotherman, seconded by Mr. Shacklett. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance June 18, 2020 Page 5 Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 20-R-PH-21 here to schedule a public hearing for July 23, 2020 to consider a proposed amendment to approximately 5.09 acres in the North Thompson Place Planned Unit Development (PUD) District (also known as Gateway Village) located along North Thompson Lane; Swanson Development, LP, applicant [2020-406].) The following letter from the Assistant Superintendent of Schools was presented to the Council: (Insert letter dated June 18, 2020 here with regards to Fiscal Year 2020 Budget Amendments.) The following RESOLUTION 20-R-11 was read to the Council and offered for adoption upon motion made by Mr. Shacklett, seconded by Mr. Martin. Upon roll call said resolution was adopted by the following vote: Aye: Madelyn Scales Harris Rick LaLance Ronnie Martin Bill Shacklett Eddie Smotherman Kirt Wade Shane McFarland Nay: None (Insert RESOLUTION 20-R-11 here amending the 2019-2020 Murfreesboro City Schools Budget (2nd Amendment).) The following letter from the Parks and Recreation Director was presented to the Council: (Insert letter dated June 18, 2020 here regarding employment of Kennedy Ryann Martin as lifeguard for Murfreesboro Parks & Recreation Department.) Mrs. Angela Jackson, Executive Director of Community Services, presented the request to approve the employment of Kennedy Ryann Martin, daughter of Council Member Ronnie Martin, as a lifeguard for the Murfreesboro Parks & Recreation Department. Vice-Mayor Scales Harris made a motion to approve the employment of Kennedy Ryann Martin. Mr. LaLance seconded the motion and all members of the Council voted “Aye” except Mr. Martin who voted “Abstain”. The following letter from the Executive Director of Public Works was presented to the Council: June 18, 2020 Page 6 (Insert letter dated June 18, 2020 here with regards to approval of State Maintenance Contract for FY 2020-2021.) Mr. Raymond Hillis, Executive Director of Public Works, presented the request of the Street Department to approve the Fiscal Year 2020-2021 State Maintenance Contract with TDOT which has a maximum reimbursement amount of $341,261. Mr. Shacklett made a motion to approve the State Maintenance Contract with TDOT for Fiscal Year 2020-2021. Vice-Mayor Scales Harris seconded the motion and all members of the Council voted “Aye”. The following letter from the City Recorder/Finance Director was presented to the Council: (Insert letter dated June 18, 2020 here with regards to Beer Permit Application for Los Barriles Mexican Grill at 2395 New Salem Highway, Suite J.) Mr. LaLance made a motion to approve the Beer Permit for Los Barriles Mexican Grill, 2395 New Salem Highway, Suite J (New Location). Mr. Martin seconded the motion and all members of the Council voted “Aye”. Mayor McFarland announced that the appointment to the Rutherford County Library System Board of Directors was to be deferred from this meeting and heard at a later time. Upon recommendation of Mayor McFarland, Mr. LaLance made a motion to reappoint Mr. Jason Schmitt (term expires April 30, 2023) to the Cable Television Commission; reappoint Mr. Tim Tipps (term expires June 30, 2023) and Mr. Davis Young (term expires June 30, 2023) to the Board of Zoning Appeals; reappoint Mr. Gilbert Backlund (term expires June 30, 2025), Ms. Deborah Belcher (term expires June 30, 2025), Mr. Bill Jakes (term expires June 30, 2025) and Ms. Marimae White (term expires June 30, 2025) to the Historic Zoning Commission; and reappoint Ms. Jennifer Garland (term expires June 30, 2023) and Mr. Warren Russell (term expires June 30, 2023) to the Planning Commission. Mr. Wade seconded the motion and all members of the Council voted “Aye”. The following statement was presented to the Council with the recommendation of the City Manager and City Recorder/Finance Director that its payment be approved: From General Fund: Motlow State Community College $ 31,200.00 Mr. Shacklett made a motion to approve payment of the statement as recommended by the City Manager and City Recorder/Finance Director. Mr. Martin seconded the motion and all members of the Council voted “Aye”.
