Election of Chair and Vice-Chair for 2015-16. 6. Adjourn. MURFREESBORO PLANNING COMMISSION STAFF COMMENTS, PAGE 1 JULY 8, 2015 3.a. Asbury Road and Florence Road [2015-712] right of way abandonment request for 2.4 acres of Asbury Road right-of-way and 0.21 acres of Florence Road right-of-way, Mr. Kevin Waldron applicant. At its June 3rd meeting, the Planning Commission held a public hearing on the abandonment of right-of-way on both Asbury Road and Florence Road. The subject area consists of excess right-of-way that remains after the relocation of Asbury Road in conjunction with the construction of Thistle Downs, Section 4. It also consists of excess right-of-way that was left over after the reconstruction of Florence Road several years ago. The excess rights-of-way along both streets are adjacent to the Thistle Downs Subdivision, and the developer of Thistle Downs has requested that these rights-of-way be abandoned and transferred to him. At the public hearing, the Planning Commission heard from several neighbors who reside on Asbury Road speak in opposition to the right-of-way abandonment request. After the public hearing, the matter was deferred so that Staff could further research the various issues that were discussed and report back to the Planning Commission with additional information. Mr. Sam Huddleston, the City’s Environmental Engineer, has written a report to provide the Planning Commission with some additional background on the situation. Mr. Huddleston presented his report to the Planning Commission at its June 17th regular meeting under “Staff Reports and Other Business.” No action was taken at that meeting. The report has been included in this agenda packet as well for the Planning Commission’s reference. The Planning Commission will need to once again discuss this matter and decide whether or not to approve the request. It is customary for the Planning Commission to place conditions on the approval of a right-of-way abandonment, relative to the transfer of the property. The attached right-of-way abandonment study recommends a number of necessary actions prior to the transfer of the property. In this case, however, many of the recommended actions associated with the transfer of the excess rights-of-way are still being determined. With that being said, Staff recommends that the Planning Commission consider the request as is without conditions. The primary question at hand is whether or not the right-of-way still serves a public purpose as a right-of-way and needs to be retained as such. If the request is approved, then it will be forwarded on to the City Council for action. In summary: AT&T Officials from AT&T indicated that they will need a 20’x 20’ easement at the south corner of Asbury Road and Florence Road next to the existing sign easement for future cabinet placement. Murfreesboro Electric Department (MED) An e-mail received from Mr. Chris Barns states that MED would like to maintain an electric easement on the west side of Florence Road where MED’s/MTEMC’s joint pole line is located. Murfreesboro Water and Sewer Department MWSD does not have water or sewer in this area. MWSD is not opposed to the abandonment of this right of way. The easement area will need to be 15’ feet on each side of the existing water line for a total of 30’ feet. Engineering Department Sam Huddleston has the following comments regarding the right of way abandonment. For the ROW to be abandoned along existing Florence Road including a portion of what is now Asbury Road. 1. Reserve the necessary electric easements for the existing electric facility. 2. Reserve sewer easement for the existing sewer line 3. Reserve a slope easement where needed for the existing Florence Road. 4. Confirm that no other utility easements are needed to be reserved by checking the Florence Road reconstruction plans. 5. Submit construction plans for approval of the City Engineer to modify pavement markings in Florence Road at Asbury Road which should be completed prior to abandonment of the ROW. 6. Submit construction plans for approval of the City Engineer to remove pavement along the intersection of existing Florence Road and existing Asbury Road which should be completed prior to abandonment of the ROW. Some pavement removal will be necessary to provide adequate separation from the Florence Road roadway to remain. A pedestrian corridor on the shoulder of Florence Road should be maintained from the end of sidewalk to the Florence Road bridge over Interstate 24. 7. Submit construction plans for approval of the City Engineer to modify guardrail along Florence Road at Asbury Road which should be completed prior to abandonment of the ROW. The guardrail should be extended parallel to Florence Road in the area where Asbury Road pavement will be removed. Excess guardrail should be salvaged and returned to the City of Murfreesboro Street Division. Submit construction plans for approval of the City Engineer to modify pavement markings in Florence Road at Asbury Road which should be completed prior to abandonment of the ROW. For the Asbury Road ROW between Florence Road and relocated Asbury Road 1. Reserve electric easements necessary for the existing facility. Confirm with electric facility owner how to provide access to the existing poles in Asbury Road ROW. 2. Reserve drainage easements as may be necessary to support public roadway and private site drainage routing to the I-24 drainage system (outfall) 3. Submit construction plans for approval of the City Engineer to modify pavement and add pavement markings and signage at Asbury and relocated Asbury. This should include removal of pavement along relocated Asbury, restoration of vegetation, adding edge lines, adding signage for the curve (curve signs) adding signage to the approach to the curve (chevron or arrow), and reduction in the perception of the continuation of the existing Asbury Road roadway for southbound drivers. This work should be completed prior to abandonment of the ROW. Traffic Department Mr. Dana Richardson does not have any concerns with closing this portion right of way. A remediation plan should be created that outlines timeframes and responsibilities of abandonment between parties before official abandonment documents are executed. Ram Balachandran suggests maintaining a good clear zone (minimum 20’ feet from the edge of pavement) similar to the east side of Florence Road due to the overhead bridge structure. Police Department The right of way abandonment will not affect the Murfreesboro Police Department. Solid Waste Department The Solid Waste Department will not be affected by the closure of this right of way. Rezoning application [2015-417] for approximately 5.9 acres located along North Thompson Lane and Medical Center Parkway to be rezoned from PUD to MU, Judy Beaty applicant. The subject property is located along the west side of North Thompson Lane and north of Medical Center Parkway. The requested area is a tract of the undeveloped property which is a portion of the Parkway Plaza PUD (2008-412) and is located within the GDO-1. The properties to the north, east and south are zoned L-I (Light Industrial District) & GDO-1. The properties to the east are zoned MU (Mixed Use District). This property was zoned from L-I to PUD in 2008 with a specific plan for development. The PUD identified 3 areas for development- Lot 1 for a Walgreens and a commercial center and Lot 2 as mixed use commercial/residential. The Walgreens was constructed soon after the rezoning effort. Construction also began for the commercial center however it was not completed. Several years later a different developer purchased the unfinished center and completed its construction. Lot 2 is remains undeveloped. The applicants desire to rezone the property to MU to allow the development of a commercial retail center which will include a Marti & Liz shoe store. The current PUD identifies this area as Lot 2 and permits a 3 story office/residential condos with a maximum 45,000 square feet. Some of the uses permitted in the current PUD are as follows: bank, beauty shop, clothing store, restaurants, retail shops, personal service establishments, offices, and residential. The MU district also permits these uses. The two other parcels included in this PUD have developed as specified in the Planned Development. Staff has included the entire PUD in the area including the Walgreens (1.6 acres) and the commercial center (1.4 acres) to be studied for rezoning to MU as removing the requested area would affect the entire PUD. The MU district permits the existing development by right and would not create a non-conforming use. The existing lots conform to minimum lot standards for the MU district. Staff has communicated with the owners of the existing commercial center who are not opposed to the MU district. The current PUD allows exceptions to design requirements on page 12 (exhibit included). They are as follows: 1. The minimum separation between parking/access areas and adjacent property lines. 2. The maximum building height of 35 feet. 3. A lesser landscape buffer along the adjacent property lines. Two of the exceptions listed would no longer applicable. Florence Road [2015-713] right of way abandonment request for 0.12 acres of Florence Road right-of-way, Mr. Gary Houk and Chad Chaudhaury applicants. The subject property is located along the southwest side of Northwest Broad Street. It consists of excess right-of-way from the realignment of Florence Road. Prior to the early 2000s, Florence Road intersected with Northwest Broad Street at an approximately 45-degree angle. In the early 2000s, it was realigned so that it intersected with Northwest Broad Street at a 90-degree angle. In the process, the intersection was shifted to the west. As a result, a remnant sliver of the old Florence Road right-of-way remains at its previous intersection with Northwest Broad Street. The subject right-of-way is bordered on its southwest side by the railroad right-of-way. It is also located in between City Limits Liquor (5353 Northwest Broad Street) and Florence Station Market (5409 Northwest Broad Street). It essentially now serves these two properties as a private access drive. Both adjacent property owners have requested that this right-of-way be formally abandoned, so that it can be transferred to them. Included in the agenda materials is a right-of-way abandonment study completed by the Planning Staff. An exhibit from the applicants’ engineer depicting the requested area has also been included in the agenda packet. The exhibit proposes that the subject right- of-way be divided along the existing center line of the right-of-way. This will result in a very skewed adjoining property line between the two properties. Staff would encourage the property owners to revise this exhibit so that the right-of- way is divided up in a manner to “square up” the property lines to the extent possible. As a point of information, the owner of the Florence Station Market has also submitted a site plan to the Planning Department for a bathroom addition on the southeast side of the building. While the requested right-of-way abandonment requires action by the Planning Commission and City Council, the proposed bathroom addition is small enough to qualify for an administrative staff-level review. If the Planning Commission approves this right-of-way abandonment request, Staff recommends the following conditions of approval: 1) Utility and drainage easements, as needed, must be retained prior to the abandonment of the right-of-way. 2) The applicants must provide a legal description, an exhibit, and any other documentation necessary for the preparation of the required legal documents. 3) All legal documents are subject to the approval of the City Attorney. The Planning Commission will need to conduct a public hearing, after which it will need to discuss the matter and decide whether or not to approve the request. If the request is approved, then it will be forwarded on to the City Council for action.
