Dev’t Services 1. Call to order. Chair Kathy Jones called the meeting to order at 6:00 p.m. 2. Determination of a quorum. Chair Kathy Jones determined that a quorum was present. 3. Approve minutes of the July 13, 2022, Planning Commission meeting. Ms. Jami Averwater moved to approve the minutes of the July 13, 2022 Planning Commission meeting; the motion was seconded by Mr. Chase Salas and carried by the following vote: Aye: Kathy Jones Ken Halliburton Jami Averwater Rick LaLance Warren Russell Chase Salas Shawn Wright Nay: None 1  MINUTES OF THE MURFREESBORO PLANNING COMMISSION AUGUST 3, 2022 4. Public Hearings and Recommendations to City Council: Zoning Ordinance amendment [2022-804] regarding amendments to Chart 3 pertaining to parking space and aisle design requirements, City of Murfreesboro Planning Department applicant. Mr. Gabriel Moore presented the Staff Comments regarding this item, a copy of which is maintained in the permanent files of the Planning Department and is incorporated into these Minutes by reference. Chair Kathy Jones opened the public hearing. No one came forward to speak for or against the Zoning Ordinance amendment; therefore, Chair Kathy Jones closed the public hearing. There being no further discussion, Vice-Chairman Ken Halliburton moved to approve the Zoning Ordinance amendment subject to all staff comments; the motion was seconded by Ms. Jami Averwater and carried by the following vote: Aye: Kathy Jones Ken Halliburton Jami Averwater Rick LaLance Warren Russell Chase Salas Shawn Wright Nay: None Zoning application [2022-415] for approximately 89.2 acres located along Veterans Parkway, Blackman Road, and Lyle McDonald Court to be zoned GDO-1 (in addition to the existing CH and CF zoning), City of Murfreesboro Administration Department applicant. Ms. Rush said that City Administration has been in contact with the property owners to answer their questions and concerns. Mr. Matthew Blomeley stated for clarification, the map provided in the agenda packet for this proposal is an outdated map. However, the map that was used for the public hearing notices and legal newspaper advertisement had been the correct updated map. Chair Kathy Jones opened the public hearing. 1. Mr. Donald McDonald, 2104 Blackman Road – voiced his concerns regarding the need for traffic signalization at Veterans Parkway and I-840. 2. Mr. Steve Szyper, 1425 Stokesly Drive – asked that a safety barrier be placed between his neighborhood and the proposed commercial property when developed. He requested that a traffic signal be placed at Blackman Road and Veterans Parkway. There being no one else to speak, Chair Kathy Jones closed the public hearing. Mr. Matthew Blomeley explained that any development would have to meet GDO design standards and use restrictions. In addition, the Planning Commission could place additional conditions of approval during site plan to mitigate any potential negative impact on the adjacent residential uses. Mr. Sam Huddleston came forward to address the traffic concerns. There being no further discussion, Mr. Chase Salas moved to approve the zoning application subject to all staff comments; the motion was seconded by Mr. Warren Russell and carried by the following vote: Aye: Kathy Jones Ken Halliburton 3  MINUTES OF THE MURFREESBORO PLANNING COMMISSION AUGUST 3, 2022 Jami Averwater Rick LaLance Warren Russell Chase Salas Shawn Wright Nay: None Zoning application [2022-414] to remove the GDO-4 zoning on approximately 31.6 acres located along Medical Center Parkway between Northwest Broad Street and Memorial Boulevard, City of Murfreesboro Administration Department applicant. Ms. Margaret Ann Green presented the Staff Comments regarding this item, a copy of which is maintained in the permanent files of the Planning Department and is incorporated into these Minutes by reference. Chair Kathy Jones opened the public hearing. 1. Ms. Jody Powers, 810 NW Broad Street – is in favor of removing the GDO-4 zoning in this area. She is a nonprofit business owner at Jackson Heights Plaza, and the GDO-4 zoning has been a hardship to update an older building due to all the requirements. There being no one else to speak, Chair Kathy Jones closed the public hearing. The Planning Commission began discussing the proposal making known they were not in favor removing the GDO-4 zoning and that they preferred a different middle ground solution, if possible. Ms. Margaret Ann Green presented the Staff Comments regarding this item, a copy of which is maintained in the permanent files of the Planning Department and is incorporated into these Minutes by reference. Mr. Sam Huddleston came forward to provide additional information regarding the request. Chair Kathy Jones opened the public hearing. No one came forward to speak for or against the matter; therefore, Chair Kathy Jones closed the public hearing. Staff Reports and Other Business: Mr. David Ives gave an update on the annexation of the Ferrari property on Highway 99. He stated that the Rutherford County Planning and Public Works Committee considered 6  MINUTES OF THE MURFREESBORO PLANNING COMMISSION AUGUST 3, 2022 the City’s request for approval of an interlocal agreement, which is required for a non- contiguous annexation, but the request failed due to no motion being made.
