1. Call to order.
Chair Kathy Jones called the meeting to order at 6:00 p.m.
2. Determination of a quorum.
Chair Kathy Jones determined that a quorum was present.
3. Public Comments.
Chair Kathy Jones announced three individuals signed up to speak regarding Item 6.D. -
Mandatory Referral [2024-714] to consider the abandonment of a portion of a drainage
easement located on property along Gresham Lane, Civil Infrastructure Associates on
behalf of Hensley Group applicant.
1. Mr. John Marshall, 119 Nutcracker Ct., Eagleville, TN – serves as Chair of the
Rutherford County Conservation Board. This board oversees the Lane Agri-Park
facilities and properties. He expressed concerns regarding the potential drainage

impact on the Agripark from the subject development. He requested that this item
be deferred until they receive the report from the third-party engineer to know all
the potential impacts.
2. Mr. Michael Shirley, 5089 Lytle Creek Road, Murfreesboro, TN – serves as
Vice-Chairman of the Rutherford County Conservation Board. He expressed
concerns regarding the potential drainage impact on the Agripark from the subject
development.
3. Mr. Pettus Read, 11795 Mt. Pleasant Road, Rockvale TN – serves as Rutherford
County Commissioner and Chairman of Rutherford County Planning Commission
and Chairman of the County Advisory Council, which works with projects at Lane
Agri-Park Community Center. He expressed concerns regarding the potential
drainage impact on the Agripark from the subject development. He requested that
this item be deferred until they receive the report from the third-party engineer to
know all the potential impacts.
4. Approve minutes of the May 15, 2024 Planning Commission meeting.
Mr. Shawn Wright made a motion to approve the minutes of the May 15, 2024 Planning
Commission meeting; the motion was seconded by Ms. Jami Averwater and carried by the
following vote:

5. Public Hearings and Recommendations to Council
Annexation petition and plan of services [2024-505] for approximately 10.33 acres
located at 3061 and 3071 New Salem Highway, Phillip and Tammy Dodd and Corner
Stone Free Will Baptist Church applicants. Mr. Richard Donovan presented the Staff
Comments regarding this item, a copy of which is maintained in the permanent files of the
Planning Department and is incorporated into these Minutes by reference.
Chair Kathy Jones opened the public hearing. No one came forward to speak for or against
the annexation petition and plan of services; therefore, Chair Kathy Jones closed the public
hearing.
There being no further discussion, Vice-Chairman Ken Halliburton moved approve the
annexation petition and plan of services subject to all staff comments; the motion was
seconded by Mr. Shawn Wright and carried by the following vote:

Consideration of [2024-S-101] City of Murfreesboro Greenways, Blueways, and
Bikeways Master Plan, City of Murfreesboro Parks and Recreation Department
applicant. Ms. Rachel Singer, Assistant Director for Murfreesboro Parks and Recreation
Department, presented the Staff Comments regarding this item, a copy of which is

maintained in the permanent files of the Planning Department and is incorporated into these
Minutes by reference.
Mr. Kevin Tilbury, consultant with Kimley-Horn, provided a brief presentation from the
proposed master plan.
Chair Kathy Jones opened the public hearing. No one came forward to speak for or against
the City of Murfreesboro Greenways, Blueways, and Bikeways Master Plan; therefore,
Chair Kathy Jones closed the public hearing.
There being no further discussion, Mr. Shawn Wright moved to adopt the City of
Murfreesboro Greenways, Blueways, and Bikeways Master Plan; the motion was seconded
by Ms. Jami Averwater and carried by the following vote:

6. Staff Reports and Other Business:
Mandatory Referral [2024-710] to consider the abandonment of a portion of a
landscape buffer easement located on property along Wilkinson Pike, Ragan Smith
Associates applicant. Mr. Brad Barbee presented the Staff Comments regarding this item,
a copy of which is maintained in the permanent files of the Planning Department and is
incorporated into these Minutes by reference.
There being no further discussion Vice-Chairman Ken Halliburton moved to approve the
mandatory referral subject to all staff comments, including the recommended conditions of

approval listed in the staff report; the motion was seconded by Mr. Shawn Wright and
carried by the following vote:

detention pond easement located on property along Trust Drive, SEC, Inc. applicant.

Minutes by reference.
There being no further discussion Mr. Shawn Wright moved to approve the mandatory
referral subject to all staff comments, including the recommended conditions of approval
listed in the staff report; the motion was seconded by Ms. Jami Averwater and carried by

located on property along South Bilbro Avenue, SEC, Inc. applicant. Mr. Joel Aguilera
presented the Staff Comments regarding this item, a copy of which is maintained in the
permanent files of the Planning Department and is incorporated into these Minutes by
reference.
Mr. John Miner (design engineer) with SEC was in attendance representing the application.
There being no further discussion Mr. Bryan Prince moved to approve the mandatory
referral subject to all staff comments, including the recommended conditions of approval
listed in the staff report; the motion was seconded by Vice-Chairman Ken Halliburton and
carried by the following vote:

Ms. Katie Noel, Project Engineer, elaborated on the proposed drainage improvements
proposed with the subject development.
The Planning Commission then asked Ms. Noel additional questions about the drainage.

Mr. Nathan Melson (design engineer) was in attendance representing the application and
provided the Planning Commission with additional information on the drainage.
Mr. Shawn Wright requested this item to be deferred.
Mr. Roman Hankins provided some guidance on a potential deferral.
There being no further discussion Mr. Shawn Wright moved to defer this mandatory
referral for thirty days; the motion was seconded by Mr. Bryan Prince and carried by the
following vote:
