CS1. Conference with Legal Counsel - Existing Litigation
The City Council will conduct a closed session, pursuant to Government Code section
54956.9(d)(1), to confer with legal counsel regarding 1 litigation case to which the City
is a party. The title of such litigation is as follows: Procko v Murrieta; Case Number
5:22-cv-00005-JGB-SP; District Court of the Southern District of California.
CS2. Conference with Legal Counsel - Existing Litigation
The City Council will conduct a closed session with the City Manager, Assistant City
Managers, the Administrative Services Director and the City Attorney, pursuant to
Government Code section 54956.95(b), to consider the following worker's
compensation claim(s): McMahon v. City of Murrieta (claim no. ADJ11234941,
ADJ15188503).
CS3. Conference with Legal Counsel – Existing Litigation
The City Council will conduct a closed session, pursuant to Government Code section
54956.9(d)(1), to confer with legal counsel regarding litigation to which the City is a
party. The title of such litigation is as follows: City of Grants Pass vs. Johnson, et al;
Case Number20-35752, 20-35881; United States Supreme Court.

Governing Body CCB Reports is the opportunity for the City Council to provide a brief report
on conferences, seminars, and Commission, Committees, and/or Boards meeting attendance.
Reports shall not exceed three minutes. The City Clerk will use the computerized timer.
PUBLIC COMMENTS
At this time any person may address the governing bodies on any subject pertaining to City
business, which does not relate to any item listed on the printed agenda. Normally no action
may be considered or taken by the governing bodies on any matter not listed on the agenda .
Each speaker will be limited to three minutes.
CONSENT CALENDAR - APPROVAL OF ITEMS 1 – 9
All matters listed on the Consent Calendar are to be considered routine by the governing
bodies, and will be enacted by one motion in the form listed. There will be no discussion of
these items unless, before the governing body votes on the motion to adopt, specific items
are removed from the Consent Calendar for separate motions.
1. Waive Reading of All Ordinance Adoptions on the Agenda and Read by Title Only
Recommended Action:
Waive reading, by title only, of all Ordinances and Resolutions. Said Ordinances and
Resolutions which appear on the public agenda shall be determined to have been read by title
and further reading waived.

Recommended Action:
Approve the minutes of the January 16, 2024, City Council Regular Meeting.

3. Check Register December 2023
Recommended Action:
Adopt Resolution No. 24-4723 entitled: A Resolution of the City Council of the City of Murrieta,
California, Ratifying the Check Register for the Month of December 2023 in the amount of
$3,304,744.95 (Check Numbers 157498-157872).
4. Monthly Investment Transaction Report for December 2023
Recommended Action:
Receive and file the Monthly Investment Transaction Report for December 2023.
5. Treasurer’s Report - Quarter 2 of Fiscal Year 2023/24
Recommended Action:
Receive the Fiscal Year 2023/24 Treasurer’s Reports for Quarter 2 (October - December
2023).
6. Assembly Bill 481 - Military Equipment Policy
Recommended Action:
Receive, review and file the annual military equipment report; and
Approve the renewal of Ordinance No. 577-22 and adopt the findings therein.
7. Tobacco Law Enforcement Grant
Recommended Action:
Adopt Resolution No. 24-4724 entitled: A Resolution of the City Council of the City of Murrieta,
California, Authorizing the City Manager to Accept Grant Funding from the State of California
Department of Justice (DOJ), Office of Attorney General to Implement Strategies to Reduce
Underage Tobacco Use in an Amount not to Exceed $134,061; Agreeing to the Terms of that
Grant by Authorizing the City Manager to Sign the Attached DOJ Memorandum of
Understanding and Increasing the Police Department’s Revenue and Expense Budget by the
Actual Amount Awarded over the next three Fiscal Years as Follows: FY 2023/24 $44,687, FY
2024/25 $44,687, and FY 2025/26 $44,687.
8. Acceptance of Public Improvements in Parcel Map 37442
Recommended Action:
Accept the Public Improvements in Parcel Map 37442 located east of Antelope Road, south of
Baxter Road; and
Direct the Department of Public Works to perform continued maintenance on the
aforementioned public improvements in conformity with the City of Murrieta’s maintenance
standard.

9. Notice of Completion of Murrieta Hot Springs Road and Hancock Avenue Pavement
Rehabilitation Project, and Murrieta Hot Springs Road and Madison Avenue Median
Improvement Project
Recommended Action:
Accept the improvements for the Murrieta Hot Springs Road and Hancock Avenue Pavement
Rehabilitation project, Capital Improvement Plan (CIP) No. 8043, as complete;
Accept the improvements for the Murrieta Hot Springs Road and Madison Avenue Median
Improvement project, CIP No. 13028, as complete; and
Direct the City Clerk to record a Notice of Completion and release bonds in accordance with
State law and City ordinances; and release any remaining retention from CIP No. 8043 and
CIP No. 13028 in accordance with State law and City ordinances.
