THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, December 5, 2018 Council of the Municipality of Murrysville held a Regular Voting Meeting on Wednesday, December 5, 2018, at 7:00 p.m. in the Municipal Building. Present at the meeting were Council members Toni Brockway, Dayne Dice, Jamie Lee Korns, Josh Lorenz, Tony Spadaro, and Carl Stepanovich. Also present were Mayor Synan, and Chief Administrator, James Morrison. Councilman Loren Kase and Solicitor George Kotjarapoglus were absent. MAYOR SYNAN RECOGNIZES THE FRANKLIN REGIONAL WPIAL SOCCER CHAMPIONS Mayor Synan stated that he is proud to welcome the Franklin Regional Men’s WPIAL Soccer Champion team. Team members present or who had pre-season awards were Auston Kranick, who was also First Team All-State, Matt Kimmich, Justin Ledonne, Jeremy Lucas, Riley Kerr, Isaac Gamow, Blake Cooper, Luke Kimmich, Zach Johnson, Andy Pettazzi, Connor Hudson, Anthony DiFalco, Nolan Scholz, and Coach of the Year Rand Hudson. The Mayor presented a certificate in recognition of being the first to earn the title of WPIAL AAA Champions. The team had a final record of 20-1-1, outscoring their opponents by a total of 85- 7, becoming Section 4 AAA champions and advancing to the PIAA state semi-finals. This Municipality is proud of their accomplishments. The many hours of practice, teamwork, and dedication have not gone unnoticed and were well-worth the rewards of a successful season. The Municipality thanks the team and coach for proudly representing Franklin Regional High School and Murrysville. Mayor Synan was then presented a medal from the team that they had received at the Finals. MAYOR’S 2018 COMMUNITY SERVICE AWARD PRESENTED TO WILLIAM YANT Mayor Synan presented William Yant with the Mayor’s 2018 Community Service Award. Mr. Yant has been the Emergency Management Coordinator for thirty-nine years and has decided to move on to possible retirement. Mr. Yant started with the Emergency Management in 1979. He isn’t just your regular citizen. Mr. Yant has been on the Franklin Rescue 4, which evolved into Murrysville Medic One, since 1972. He has been a First Responder, EMT, EMTP, paramedic, chief, president and trustee. In addition he has been a Murrysville Volunteer Fireman at Station 20 since 1975. Mr. Yant has also served on Council for four years, from 1992-1996 and is currently on the Murrysville Planning Commission. Mr. Yant stated that Emergency Management has come a long way since 1979 when FEMA required every municipality to have an Emergency Management Coordinator. What Emergency Management basically does is tie together all of the emergency services; fire, police, EMS, community health services, and surrounding communities’ equipment to work together. Mr. Yant noted that Emergency Services in the state of Pennsylvania are in trouble. In 1980 there were 350,000 volunteers involved in fire services or EMS services. Today there are only 38,000, which is a loss of about 98% of them. One reason is that the training level has gotten to the point where it has become a load they can’t handle between work, training, fighting fires, etc. Then there is the cost. Training is expensive and fundraising takes so much time. In this town there are only about 35-40% of the people who support the fund drives of these organizations. They need help. Their only compensation is the personal satisfaction that they have helped someone. Mr. Yant stated that residents can help by contacting their Congressmen and local politicians. There are some programs and bills going through the state of Pennsylvania right now for funding. It costs about $3,000 to suit up a fireman plus costs for his gear costs another $4-$5,000. The costs are not paid for by taxes; they are paid for by the firemen and through fund raising. You can write a check to help support these programs or pay the $45 for an ambulance subscription. Somewhere, some time, some day, someone you know is going to need their help. When you do need their help, you are going to want the best trained, best equipped, best funded and most dedicated volunteers to show up at your door. REGULAR VOTING MEETING AGENDA ROLL CALL/VOTING ORDER: Toni Brockway, Carl Stepanovich, Josh Lorenz, Tony Spadaro, Dayne Dice, Jamie Lee Korns, Loren Kase - absent, and Mayor Synan. PLEDGE OF ALLEGIANCE: Mr. Lorenz led the audience in the Pledge of Allegiance. UNISTED AMENDMENTS: There were no unlisted amendments to the agenda. Mrs. Lee Korns moved to approve agenda as set forth. Ms. Brockway seconded. All present voted aye. Motion approved. CONSENT ITEMS: A. Approval of November 21, 2018, Council Meeting Minutes Mr. Stepanovich moved to approve the consent calendar items. Mr. Spadaro seconded. All present voted aye. Motion approved. MAYOR’S COMMENTS: Mayor Synan noted that the Murrysville Night of Lights will be Friday, December 7th, from 6:00-8:00 p.m. at Town Square and First United Methodist Church. This is a fun, family event. There will be the tree lighting, Santa, games, hot chocolate and cookies, and lots more. Make sure you register for the Gingerbread House Contest. Contact Amy at the Murrysville Recreation Department, extension 131 for more information. As presented earlier, Franklin Regional claimed the WPIAL AAA title Men’s Soccer Championship. The Franklin Regional Superintendent of Schools, Gennaro Piraino, Jr., received the 2019 Pennsylvania Superintendent of the Year award. Congratulations Dr. Piraino. U.S. Army Sgt. Jason Mitchell McClary of Washington Township was injured by a roadside bomb blast in Eastern Afghanistan. As a result of his injuries, Sgt. McClary has succumbed. McClary who gave all so that we might live with freedom. CHIEF ADMINISTRATOR’S COMMENTS: The Planning Commission had a public hearing last night on the Titan Well application. The proposed conditional use and site plan are going well. The pads are to be located near the intersection of Bollinger and Hilty Roads. The Zoning Hearing Board met on the 29th of November to discuss a challenge to the Oil and Gas Ordinance. The Zoning Hearing Board will reconvene January 24th. The Municipality today made a conditional offer to Officer Samantha Malik. If she passes her physical and physiological exam, Officer Malik will be sworn in as Murrysville’s first female officer. If Council is interested in taking a tour of an unconventional well site, there will be an opportunity on December 13 from 1:00-3:00 p.m. at the Poseidon Well in Penn Township. Robert Bell’s last day was today and he is headed for South Carolina. William Paiano is here this evening and the Mayor will be making a recommendation later in the meeting for Director of Public Works. Rory Hogan is also here this evening and will be promoted to Public Works Foreman. Notice was received from the Franklin Township Sewage Authority that it is proposing a rate increase of 27%. The FTMSA is required to give 60 days’ notice to Council prior to the rate increase. If all goes well, Lyons Run Road will be open tomorrow. COMMUNITY INPUT: Mr. Lorenz stated that this is the opportunity for the Murrysville community to discuss anything they’d like as long as it is three minutes or less. Joan Kearns, 4997 Longview Court: Mrs. Kearns stated that she was sorry that she didn’t get to wish Bob Bell well before he left this morning. Mr. Bell was at the Municipality for forty years and she has been here for forty three years. Knowing Bob, she knows that he has trained his personnel very well and the residents of Murrysville can take comfort in knowing that Bill Paiano has stepped into some very big shoes, and will do a phenomenal job and that Bill will train his replacement equally as well as Bob has trained him. Thank you Bill for assuming the director position and to the new road foreman. Good luck. LIAISON COMMENTS AND COMMITTEE REPORTS: Ms. Brockway: Nothing to report from the Library Board. Mrs. Lee Korns: Nothing to report from the Pension Plan Committee. vmp THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, December 5, 2018 Mr. Stepanovich: The Environmental Advisory Committee met. A tour of a well site will be held from 1:00- 3:00 p.m. on December 13. Council is invited and asked to let Scott Hilty know so he can get a headcount. The EAC final meeting this year will be on December 20th since the 25th is Christmas. Mr. Spadaro: The Planning Commission met last night. A minor subdivision was discussed for the Franklin Estates Plan; 102 acres zoned B and R-2 zoning. The developer wants to continue to build and develop that area. After advertising, the developer will come back for a vote from the Planning Commission on some issues that had come up. This is the area south of Route 22 behind Berlin Farm Road. There was discussion regarding the Titan Well Pad including presentations. There were a lot of issues not resolved yet and some conditions will need changed. The Titan Well Pad will be discussed again at the next meeting. WORKSHOP ITEMS ADMINISTRATION: None ENGINEERING: None COMMUNITY DEVELOPMENT: 11.A. Discussion of S-9-18, Cassol Family Trust Plan (Fusting subdivision), Route 22/Manor/Wilson intersections, 3-lot subdivision, B and R-3 zoning Ray Gusty showed a drawing of the Fusting subdivision. The applicant, Bushy Run Investments, would like to purchase all of parcel one which is zoned B, five acres out of parcel two, which is zoned R-3, and all of parcel 3 which is zoned R-3. This is a total of approximately 51 acres out of 75 acres of the property. The lot sizes have not been identified yet. The properties will be a mixed-use development. The applicant had an advisory meeting with the Planning Commission. The use would be for retail, office space, a chain restaurant, and DNA – Dedicated Nursing Associates was looking for corporate office space, which would be in parcel one. Townhouses would be in parcel three along with a small parklet. Mr. Lorenz noted that this plan has already gone thru Planning and will be brought back to Council’s next meeting for a vote. PUBLIC WORKS AND PARKS: None COUNCIL ACTION ITEMS ADMINISTRATION: 13.A. Consider authorization to advertise Ordinance No. 1000-18, the 2019 Tax Ordinance Mrs. Lee Korns made a motion for authorization to advertise Ordinance No. 1000-18, the 2019 Tax Ordinance. Ms. Brockway seconded. vmp THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, December 5, 2018 Mr. Morrison stated that there is no tax increase and the rate will remain at 12.5 mills. Upon a roll call vote: Ms. Brockway - yes, Mr. Stepanovich - yes, Mr. Lorenz – yes, Mr. Spadaro – yes, Mr. Dice – yes, and Mrs. Lee Korns - yes. Motion approved. 13.B. Consider authorization to advertise Ordinance No. 1001-18, the Salary Ordinance Ms. Brockway made a motion to authorize advertising of Ordinance No. 1001-18, the 2019 Salary Ordinance. Mr. Spadaro seconded. Mr. Morrison noted that this establishes the salary ranges and the personnel count for the various positions in the municipality. The police salaries have not been set yet because we are still in negotiations. Upon a roll call vote: Ms. Brockway - yes, Mr. Stepanovich - yes, Mr. Lorenz – yes, Mr. Spadaro – yes, Mr. Dice – yes, and Mrs. Lee Korns - yes. Motion approved. 13.C. Consider authorization to advertise Ordinance No. 1002-18, an ordinance establishing the employee contribution rate for the Uniform Pension Plan for 2019 Mr. Spadaro made a motion for authorization to advertise Ordinance No.1002-18, an ordinance establishing the employee contribution rate for the Uniform Pension Plan for 2019 at five (5)%. Mr. Stepanovich seconded. Mr. Morrison stated that this establishes the contribution rate for the police personnel to the police pension fund. This is an annual process. Upon a roll call vote: Ms. Brockway - yes, Mr. Stepanovich - yes, Mr. Lorenz – yes, Mr. Spadaro – yes, Mr. Dice – yes, and Mrs. Lee Korns - yes. Motion approved. 13.D. Consider the appointment of William Paiano as Director of Public Works Ms. Brockway made a motion to consider the appointment of William Paiano as Director of Public Works. Mrs. Lee Korns seconded. Mr. Morrison stated that this is the Mayor’s appointment by code based on the recommendation of the Chief Administrator and the consent of Council. Mayor Synan noted that Mr. Paiano will do a great job. His dedication to the community is further enhanced by his twenty-five years as being a Volunteer Fireman in this community. Upon a roll call vote: Ms. Brockway - yes, Mr. Stepanovich - yes, Mr. Lorenz – yes, Mr. Spadaro – yes, Mr. Dice – yes, and Mrs. Lee Korns - yes. Motion approved. 13.E. Consider approving the amendments to the 2018 Operating Budget Mrs. Lee Korns made a motion to approve the amendments to the 2018 Operating Budget. Ms. Brockway vmp THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday, December 5, 2018 seconded. Mr. Morrison noted that Ms. Heming outlined the proposed amendments at Council’s last meeting. By moving revenues within the general fund and expenditures within the general fund, there was a net zero change in the bottom line. Upon a roll call vote: Ms. Brockway - yes, Mr. Stepanovich - yes, Mr. Lorenz – yes, Mr. Spadaro – yes, Mr. Dice – yes, and Mrs. Lee Korns - yes. Motion approved. 13.F. Consider the acceptance of Bret Rankin’s resignation from the Planning Commission effective December 31, 2018 Ms. Brockway made a motion to consider the acceptance of Bret Rankin’s resignation from the Planning Commission effective December 31, 2018. Mrs. Lee Korns seconded. Mr. Morrison stated that Mr. Rankin submitted his resignation and will be missed. He was a fresh face on the Planning Commission. His business is growing and his family is growing, so he had to make a choice. Mr. Morrison will send a letter of thanks to Mr. Rankin. Upon a roll call vote: Ms. Brockway - yes, Mr. Stepanovich - yes, Mr. Lorenz – yes, Mr. Spadaro – yes, Mr. Dice – yes, and Mrs. Lee Korns - yes. Motion approved. COMMUNITY DEVELOPMENT: 14.A. Consider approval of S-8-18, Kish Residence, Foxwood Court, 3-lot minor subdivision, R-2 zoning Mrs. Lee Korns made a motion to consider approval of S-8-18, Kish Residence, Foxwood Court, 3-lot minor subdivision, R-2 zoning. Mr. Stepanovich seconded. Mr. Lorenz noted that this was a workshop item at Council’s last meeting. A number of conditions were listed in the staff briefing. Mr. Lorenz asked the applicant, who was in the audience, if the conditions set forth were accepted. Mrs. Kish answered yes, that the conditions were accepted. Upon a roll call vote: Ms. Brockway - yes, Mr. Stepanovich - yes, Mr. Lorenz – abstained (because he has represented the Applicants), Mr. Spadaro - yes, Mr. Dice – yes, and Mrs. Lee Korns - yes. Motion approved. ENGINEERING: None PUBLIC WORKS AND PARKS: None OLD BUSINESS: None NEW BUSINESS: Mr. Morrison asked if Council would like to start the interview process for the Boards and Commissions right before the next Council meeting. The interviews will be conducted in the Board Room with all Council members that are available to attend. EXECUTIVE SESSION: Council adjourned to an Executive Session at 7:52 p.m. regarding a personnel issue. No action coming out of this session was anticipated.
