THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday July 5, 2023 The Council of the Municipality of Murrysville held a Regular Voting Meeting on Wednesday, July 5, 2023, at 7:00 p.m. in the Municipal Building. Present at the meeting were Council members Dayne Dice, Jamie Lee Korns, Jason Lemak, Jamie Lingg, Mac McKenna, Tony Spadaro, Carl Stepanovich, and Mayor Synan. Also, present were Chief Administrator, Michael Nestico, and Solicitor, Wes Long. REGULAR VOTING MEETING AGENDA ROLL CALL/VOTING ORDER: Tony Spadaro, Jamie Lingg, Jason Lemak, Mac McKenna, Dayne Dice, Carl Stepanovich, and Mayor Synan. Jamie Lee Korns arrived just after the Mayor’s Comments. PLEDGE OF ALLEGIANCE: Council President, Dayne Dice led the audience in the Pledge of Allegiance. UNISTED AMENDMENTS: None CONSENT CALENDAR ITEMS: 4.A. Approval of June 21, 2023, Council Meeting Minutes. Mr. Lemak made a motion to approve the June 21, 2023 Council Meeting Minutes. Mr. Stepanovich seconded. All those present voted aye. Motion approved. MAYOR’S COMMENTS: Mayor Synan presented the following slides and announcements: Pioneer for a Day will be presented by the Murrysville Historical Society at the Sampson-Clark Toll House and School House for ages 8-12 on July 11th from 9 a.m. – 3 p.m. Fee is $50. Tuesdays at Townsend will be July 11th with live entertainment by The James Stamps-Richard Parker Trio from 6:30 – 8:00 p.m. Food and beverages will be available from WPF Concessions and Allusion Brewing. Townsend Park is located at 130 Townsend Park Court. Any cancellations will be posted on Facebook and our website www.murrysvilleparecreation.com. Murrysville Farmer’s Market is Thursdays 3pm – 7pm June thru September at the Murrysville Fire Department parking lot, 3235 Sardis Road. CHIEF ADMINISTRATOR’S COMMENTS: None COMMUNITY INPUT: None LIAISON COMMENTS AND COMMITTEE REPORTS: Mr. Lemak: The Library meets on July 20th. Their website has all of the activities going on this summer. Mr. Stepanovich: The Planning Commission meets next Tuesday. Mr. McKenna: Parks and Recreation met last week at Kovalczik Park where the new baseball field is located. Tuesdays at Townsend will be the next event. Mr. Dice: FTMSA meets later this month. WORKSHOP ITEMS ADMINISTRATION: None ENGINEERING: None COMMUNITY DEVELOPMENT: None PUBLIC WORKS AND PARKS: None COUNCIL ACTION ITEMS ADMINISTRATION: 13.A. Authorize staff to solicit bids for the lease of oil and gas rights for approximately 234.60 acres of municipally owned property, Duff Park, at tax map numbers 49-14-00-0-071, 49-14-00-0-072, 49-14-00-0- 070, 49-14-00-0-167, 49-14-00-0-168, 49-14-05-0-101, and 49-14-00-0-135. Solicitor, Wes Long recommended that this be put on hold. This would be for the development of Utica sands underneath Duff Park. Many of the parcels that comprise Duff Park were acquired thru DCNR grant funding. There is a covenant in each one of the deeds where grant funding was used, which indicates that we cannot grant any surface or subsurface property interests to any individual or entity. In order to do so, you would need DCNR approval. He has spoken to representatives from the DCNR and they are requesting more information on that issue. Everything will resolve itself. There have also been inquiries made to the approximate amount of revenues that the Municipality would derive from that leasing. The revenues may have to be earmarked for other recreational purposes. This would be only for the Utica, not the Marcellus, which is undevelopable. Dr. Lee Korns made a motion to table 13.A. and 13.B. Mrs. Lingg seconded. All those present voted aye. Advertise Ordinance No. 1077-23, an ordinance accepting a lease for oil and gas rights for approximately 234.60 acres of municipally owned property, Duff Park, at tax map numbers 49-14-00-0-071 (154.10 acres), 49-14-00-0-072 (1.40 acres), 49-14-00-0-070 (9.00 acres), 49-14-00-0-167 (48.61 acres), 49- 14-00-0-168 (14.59 acres), 49-14-05-0-101 (4.40 acres), and 49-14-00-0-135 (2.50 acres). Authorize renewal of the cyber insurance with Travelers in the amount of $6,240 for the fiscal year of August 2023 to July 2024. Dr. Lee Korns made a motion to authorize renewal of the cyber insurance with Travelers in the amount of $6,240 for the fiscal year of August 2023 to July 2024. Mrs. Lingg seconded. Mr. Nestico noted that this is an annual occurrence to renew the cyber insurance with the Municipality. All those present voted aye. Motion approved. 13.D. Authorize advertisement for auction bids through Municibid for the sale of five (5) used police vehicles. Mr. Stepanovich made a motion to authorize advertisement for auction bids through Municibid for the sale of five (5) used police vehicles. Mr. Spadaro seconded. Mr. Nestico stated that it was found to be more efficient to sell the five vehicles in one lot and there are some interested buyers for the lot of vehicles. Mr. Dice asked approximately how many police vehicles the Municipality has. Mr. Nestico checked on that and said there were around 20 vehicles. All those present voted aye. Motion approved. COMMUNITY DEVELOPMENT: 14.A. Authorize demolition of a dangerous structure located at 6283 Old William Penn Highway bearing tax map number 49-16-14-0-103. Mr. Spadaro made a motion to authorize demolition of a dangerous structure located at 6283 Old William Penn Highway bearing tax map number 49-16-14-0-103. Mr. Lemak seconded. Mr. Nestico stated that this property was discussed at the last meeting’s Public Hearing. Council at that time made a motion to declare it a dangerous structure and are now asking Council to authorize demolition to the structure according to the Demolition Ordinance of 2021. By authorizing the demolition staff would then take steps to put the demolition out to bid. This property is up for Judicial Sale this coming Friday. If the property is sold, that would be a positive as there would be someone to approach addressing the concerns of repairing the structure or demolishing it. Mr. Dice noted that he was contacted by FTMSA that if the property is demolished, just make sure we coordinate with them to cap the tap because it does have public sewage. Mr. McKenna asked that if we demolish the structure and then someone purchases the property, would they have to reimburse the demolition cost? Mr. Nestico answered yes that the property would be liened and they would be responsible for that. But it does depend on how the property is sold. All those present voted aye. Motion approved. vmp -3- THE MUNICIPALITY OF MURRYSVILLE Regular Voting Meeting – Wednesday July 5, 2023 14.B. Advertise Ordinance No. 1076-23, an ordinance adding Chapter 219 to the Code of the Municipality of Murrysville to regulate short term rental units within the municipality and establish penalties for violations. Mrs. Lingg suggested that this be tabled until the next meeting. She had requested some information on parcel sizes within the community starting with one acre and going up every half acre that we are waiting on from the County. It is prudent for us to spend more time looking at what we have existing in the community before institute a new ordinance. Mr. Nestico stated that they did reach out to the County and they are working on compiling a spreadsheet of all the parcels in the community and their acreage. Mrs. Lingg made a motion to table 14.B. to the July 19 agenda. Dr. Lee Korns seconded. All those present voted aye. Motion approved. ENGINEERING: None PUBLIC WORKS AND PARKS: None OLD BUSINESS: None NEW BUSINESS: None EXECUTIVE SESSION: Property/Contract Matters Dr. Lee Korns made a motion to adjourn to the executive session. Mr. McKenna seconded. All those present voted aye. Motion approved. There was no action anticipated coming out of the meeting.
