AGENDA REVIEW AND SUPPLEMENTAL REPORTS: Deputy City Clerk Carranza reported the following supplemental items: Item 5.A.: PowerPoint presentation by city staff; Memo from Community Development Director with attached letter from William W. Thompson, Trammell Crow Residential, regarding submission of a revised Alternative Equivalent Proposal. Items 5.B. and 7.A.: PowerPoint presentations by staff. 3. PUBLIC COMMENT: James Hinton, resident - commented on various issues including concern over a recent School Board incident, the negative aspects portrayed by the artwork at the Hatt Building outdoor fountain, and concerns regarding the Medical Marijuana ordinance. 4. Mayor Techel pulled item 4.G. for discussion. A motion was made by Councilmember Mott, seconded by Councilmember Gentry, to approve the Consent Agenda with the exception of items 4.F. and 4.G., which were pulled for discussion. Councilmember Mott recused from the vote on item 4.H. based on his ownership of real property within 500 feet of the project boundaries (per FPPC Regulation Section 18702.2). The motion carried by the following vote: Aye: 5- Gentry, Mott, Sedgley, Inman, and Techel 4.A. 1100-2017 City Council Meeting Minutes Approved the September 5, 2017 Special and Regular City Council Meeting Minutes. 4.B. 1099-2017 Community Facilities District No. 2017-1 (Gasser Soscol Gateway) Approved the second reading and final passage, and adopted O2017-013 levying special taxes within the “City of Napa Community Facilities District No. 2017-1 (Gasser Soscol Gateway)”; and determining that the actions authorized by this ordinance were adequately analyzed by previous CEQA actions. Enactment No: O2017-013 4.C. 1095-2017 Monthly Budget and Investment Statement Received and filed the Monthly Budget and Investment Statement as of July 31, 2017. 4.D. 1092-2017 Records Retention Schedule for Human Resources, Information Technology, Public Works and Finance Program Files Indexes: Retention Schedule Adopted Resolution R2017-130 authorizing an Amendment to the City’s Records Retention Schedule by revising the retention period for Human Resources, Information Technology, Public Works, and Finance files. Enactment No: R2017-130 4.E. 1074-2017 Construction Inspection/Management Services Approved agreements with: 1) Harris & Associates, Inc., 2) Vali Cooper & Associates, Inc., and 3) WSP USA, Inc. for on-call Construction Inspection/Management Services, each in an amount not to exceed $500,000 with a duration of 36 months, and authorize the Public Works Director to execute the agreements on behalf of the City. Human Resources Director Darlene Colaso reviewed the staff report and provided clarification on the recommended action and proposed changes. Council questions and discussion ensued. A motion was made by Councilmember Gentry, seconded by Councilmember Mott, to adopt Resolution R2017-131 amending the City Classification Plan by Revising the Classification Specification of Assistant City Manager for Development Services, Adopting the Classification and Salary Range of Deputy City Manager, and Abolishing the Classification of Assistant to the City Manager.The motion carried by the following vote: Aye: 5- Gentry, Mott, Sedgley, Inman, and Techel Enactment No: R2017-131 4.G. 1085-2017 Stormwater System Service Assessment Reimbursement Indexes: Stormwater Pulled for discussion. Assistant City Manager Nancy Weiss and Finance Director Brian Cochran provided background and timeline of the reimbursement process to the rate payers. Public Works Director Jack LaRochelle explained how the error was discovered. With the approval of this item, city staff would be be issuing approxmiately 22,000 checks over the next few months. A motion was made by Councilmember Gentry, seconded by Councilmember Sedgley, to adopt Resolution R2017-132 authorizing the Finance Director to issue reimbursements for the Fiscal Year 2016/17 Stormwater System Service Assessment in the amount of $409,783.37, and authorizing a budget appropriation. The motion carried by the following vote: Aye: 5- Gentry, Mott, Sedgley, Inman, and Techel Enactment No: R2017-132 CITY OF NAPA Page 3 Printed on 10/5/2017 CITY COUNCIL MEETING MINUTES - Final September 19, 2017 4.H. 1093-2017 First & Second Street Roundabouts along California Boulevard Additional Fund Reallocation for Right of Way Acquisition Indexes: Roundabout Councilmember Mott recused A motion was made by Vice Mayor Inman, Seconded by Councilmember Sedgley to adopt Resolution R2017-133 authorizing a budget reallocation necessary for the acquisition of real property needed for the State Route 29 Northbound First Street Ramps and California Boulevard Roundabouts Project (City Project No. ST14PW02), and determining that the actions authorized by this resolution were adequately analyzed by a previous CEQA action. ADMINISTRATIVE REPORTS: 5.A. 1097-2017 Napa Creek Condos Affordable Housing Alternative Equivalent Proposal Community Development Director Rick Tooker provided staff report and reviewed the applicant's Alternative Equivalent proposal. Will Thompson with Trammell Crow thanked the council and staff for their attention to this project. Mr. Thompson gave brief history of the project and listed the capital improvement projects that will be included. Mayor called for public comment; there was none. Council discussion ensued. A motion was made by Councilmember Gentry, seconded by Councilmember Sedgley, to: 1. Determine the Applicant's proposal to pay $720,000 will further affordable housing opportunities in the City to an equal or greater extent than constructing eight affordable units with the Napa Creek Condos Project; and 2. Authorize the Director to find that the Applicant will have satisfied mitigation of the Project's affordable housing impacts by payment of the $720,000 prior to issuance of a biulding permit on the Project site. Council questions and discussion ensued. The report was received and filed. Receive and file the Fourth Quarter Report without financials for Fiscal Year 2016-17. 6. CONSENT HEARINGS: 6.A. 1069-2017 CDBG Program Consolidated Annual Performance Evaluation Report (CAPER) 2016-2017 Indexes: CAPER Mayor Techel announed the item and called for public testimony; there being none, the hearing was opened and closed without comment. A motion was made by Councilmember Gentry, seconded by Councilmember Mott to adopt a Resolution R2017-134 authorizing approval of the CDBG Fiscal Year 2016-2017 Consolidated Annual Performance Evaluation Report (the "CAPER") with the addition of public hearing comments and authorizing staff to submit the report to HUD. PUBLIC HEARINGS/APPEALS: 7.A. 1056-2017 Design Review Permit Process for Multi-Family Projects Senior Planner Michael Walker provided staff report. Council discussion and questions ensued. Community Development Director Rick Tooker provided additional clarification to Council. Mayor Techel called for public testimony; no one came forward. A motion was made by Councilmember Mott, seconded by Councilmember Sedgley to close the public testimony portion of the hearing. The motion was unanimously carried. Lengthy discussion and individual Council comments and questions ensued. Further clarification was provided by staff. A motion was made by Councilmember Gentry, seconded by Vice Mayor Inman to approve the first reading and introduction of an ordinance amending Napa Municipal Code Section 17.62.050 "Design Review Permits" with amendments (1) to allow Community Development Director approval of Multi-Family projects with up to 10 units, and (2) to allow Planning Commission approval of Multi-Family projects of 11 to 30 units regarding procedures for processing Multi-Family Projects, and determining that the actions authorized by this Ordinance are not subject to CEQA. PUBLIC HEARINGS/APPEALS: CITY OF NAPA Page 7 Printed on 10/5/2017 CITY COUNCIL MEETING MINUTES - Final September 19, 2017 15.A. 749-2017 Manzanita Family Apartments 51-unit multi-family apartments at 2951 Soscol Avenue Senior Planner Karlo Felix provided staff report. Katie Fisher, speaking on behalf of applicant, Satellite Affordable Housing Associates (SAHA), provided an overview of the project. Glen Simmons with Dahlin Group Architects reviewed the project design. Mayor Techel opened public testimony. Larry Kromann, resident and President of Calistoga Affordable Housing, spoke in support of the project. With an aging population in Napa County he would like to see provisions for Senior Housing, which is also low income. Recommends more storage onsite for the project. Grania Lindberg, representing the Napa Housing Coalition, spoke in support of the project. Sue Kessler, resident, voiced conern with regard to increased traffic and pedestrian safety. Supports the design of the project, not the location or tenant mix. Requested a thorough traffic midigation study. Resident of Petri Lane also voiced concern with regard to traffic. Christine H., resident, spoke in support of the project. Jenn G., resident, spoke in support of the project. A motion was made by Vice Mayor Inman, seconded by Councilmember Segley to close the public tesimony portion of the hearing. The motion was unanimously carried. Lengthy discussion and individual Council comments ensued regarding the overal project, traffic concerns, proposed signal lights, on-site storage and the tennant application process. Vice Mayor Inman pointed out the positive and unique features of the project to include bicycle parking, community room, laundry facility, mulitple trash drops and a third floor terrace. A motion was made by Councilmember Gentry, seconded by Vice Mayor Inman, to adopt Resolution R2017-135 approving a Design Review Permit and Density Bonus for a 51-unit multi-family affordable apartment development on 1.85 acres at 2951 Soscol Avenue, and determining that the actions authorized by this resolution are exempt from CEQA. ADMINISTRATIVE REPORTS: 16.A. 853-2017 Water Rate Structure and Proposed Rate Update Procedures Water General Manager Joy Eldredge gave staff report detailing what it entails to provide quality water twenty-four hours a day, seven days a week. The report included water rates cost of service, how water rates are used, why rate changes are necessary, how the rates are calculated and what the proposed rates are. The proposed rates are still significantly lower than the Bay Area average monthly water cost for a single-family residential with Napa at $49 per month compared to the average of $69 per month. Potable water, which is critical to basic needs, remains the lowest among monthly household utilities in Napa. Mayor Techel called for public comment. Frank Thompson, resident and advocate for senior citizens who are retired, spoke in opposition and voiced his concern about the effect the increase will have on those with a low, fixed income. Bernie Narvaez, resident, asked if there is any financial help available for veterans or low income families? Bob Frances, resident, voiced concern that the rate increase will have a larger effect on those using the least amount of water and who are on a fixed income; especially the elderly. He understands that costs need to be met, but it appears that large water users and commercial users benefit the most as they can pass the cost along. The public comment period ended. Lengthy discussion and individual Council comments ensued regarding assistance for those on a fixed income, details on the RateShare Discount Program, the implementation timeline of the increase, pricing structure and continued conservation efforts. A motion was made by Councilmember Sedgley, seconded by Vice Mayor Inman, to authorize City Staff to Provide Written Notice by Mail of the Proposed Update to Water Rates in Compliance with all Requirements of State Law, and Schedule a Public Hearing to Consider Adoption of Updated Water Rates on November 7, 2017, at 6:30 pm. COMMENTS BY COUNCIL OR CITY MANAGER: Councilmember Sedgley attended the League of California Cities Annual Conference. He shared an interesting voucher program that City of Seattle offers in regards to funding candidate campaigns. Councilmember Gentry also attended the League of California Cities Annual Conference. She stated that she shared a meal with staff from Contra Costa County and they were impressed with Napa's water rates; theirs are much higher. 18.
