MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING OCTOBER 6, 2009 1. Mayor Robert Mezzo called the meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: RESIDENTS: 8 T. K. Mayor Mezzo led in the Pledge of Allegiance to the Flag. 3. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the minutes of the regular meeting of September 1, 2009 and the special meetings of August 24, 2009, September 8, 2009 and September 21, 2009 each member having received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of September, each member having received copies for review. 5. Motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:05p.m. for discussion on the following: Real Estate (Renewal and Modification to the Naugatuck Day Care Lease with the Borough of Naugatuck and discussion/possible action on Jesse Camille’s), Personnel (possible Engineer, Assessor and Street Superintendent positions), Collective Bargaining (UPSEU), Pending Litigation/Pending Claim inviting in Attorney Fitzpatrick and Ed Carter. Motion was rescinded -2- Minutes - Board of Mayor and Burgesses Regular Meeting - October 6, 2009 VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:06p.m. for discussion on the following: Real Estate (Renewal and Modification to the Naugatuck Day Care Lease with the Borough of Naugatuck), Personnel (possible Engineer, Assessor and Street Superintendent positions), Collective Bargaining (UPSEU), Pending Litigation/Pending Claim inviting in Attorney Fitzpatrick and Ed Carter. Mayor Mezzo reconvened the meeting at 7:30 p.m. 6. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Mezzo to enter into and execute an employment agreement between the Borough of Naugatuck and Simon Robert Wake for the position of Assessor. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to enter into and execute an employment agreement between the Borough of Naugatuck and Wayne Zirolli for the position of Borough Engineer. Public Comment Mayoral Aide Ed Carter announced the following events taking place in the month of October: Naugatuck High School Marching Band will host the “Thunder in the Valley” Band Competition on October 10th, the Mayor’s Breakfast honoring Jim Goggin will be held on October 15th and our State Representatives will be holding office hours along with a coat drive at the Whittemore Library on October 17th . Residents spoke about the Board of Education budget situation and the need to clean the brook on Rubber Avenue. -3- Minutes - Board of Mayor and Burgesses Regular Meeting - October 6, 2009 8. Burgess Comments/Sub-Committee Reports Burgess Kuczenski relayed concerns residents have with Borough vehicles not having identifying markings on the side of the vehicle. Burgess Ciacciarella said blight was the main concern at his quarterly meeting. October 10th is clean up day in Union City and he thanked Coca Cola and Yofarms for their donation of refreshments for the volunteers. Burgess Neth said he has received more phone calls this past month regarding the Board of Education than any other issue over the past ten years. People are upset and embarrassed. They are asking for the resignations of Board of Education members. Burgess Woodfield suggested Burgesses visit residents at Glendale Center. Deputy Mayor Rossi said her phone has been ringing off the hook about the Board of Education. Other towns’ residents are questioning the lack of accountability. She said she is concerned about the learning environment for the students. Deputy Mayor Rossi wants to be on the record as having read the following Connecticut State Statute 10-222: "Expenditures by the board of education shall not exceed the appropriation made by the municipality, with such money as may be received from other sources for school purposes. If any occasion arises whereby additional funds are needed by such board, the chairman of such board shall notify the board of finance, board of selectmen or appropriating authority, as the case may be, and shall submit a request for additional funds in the same manner as is provided for departments, boards or agencies of the municipality and no additional funds shall be expended unless such supplemental appropriation shall be granted and no supplemental expenditures shall be made in excess of those granted through the appropriating authority". Mayor Mezzo said the hiring of Wayne McAllister at the Board of Education is a step in the right direction. He said the teachers bargained in good faith along with other unions. He does not feel blame should be placed; however, someone is accountable and it should have been publicly addressed. Burgess Burns thanked the Mayor for fulfilling his request to have the flag at half-mast in observance of the 9/11 tragedy. He is happy the graffiti wall is gone. Burgess Fragoso said Inland Wetlands Commissioner Mary Davis is being honored by the Southwest Conservation District. She congratulated the Fire Department for their collaborative rescue effort with Beacon Falls. Burgess Scully thinks it is excellent Wayne McAllister is working with the Board of Education. He feels that Wayne should be number two under the superintendent. He questioned the funding of the Parcel C clean up. Burgess Campbell congratulated both Fire Departments for the rope rescue effort. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the reappointment of Patrick Corbett, (D) 48 Tracyann Court, Naugatuck, CT 06770 as a regular member of the Golf Commission, term to expire June 2, 2012. 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of John Ford, (U) 22 Nichols Road, Naugatuck, CT 06770 as a regular member of the Street Commission, term to expire July 1, 2014. 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Katherine Gabrielson, (D) 157 Heritage Drive, Naugatuck, CT 06770 as an alternate member of the Planning Commission, term to expire November 1, 2013. 12. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid for “Town Wide Sidewalk Replacement Program” to D&P Construction, 25 West Wind Road, Trumbull, CT 06611 in the amount of $94,870., as recommended by James Stewart, Director of Public Works. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for “Winter Salt for Snow and Ice Control” to Morton Salt, 123 N. Wacker Drive, Chicago, IL 60606-1743 in the amount of $66.64 per ton of rock salt delivered, as recommended by James Stewart, Director of Public Works. 14. VOTED: Unanimously on a motion by Burgess Scully and seconded by Burgess Neth to add to the agenda a motion to approve the bid for “Winter Salt for Snow and Ice Control” for Ice B’ Gone. 15. VOTED: Unanimously on a motion by Burgess Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for “Winter Salt for Snow and Ice Control” for Ice B’ Gone to International Salt, 655 Northern Boulevard, Clarks Summit, PA 18411 in the amount of $90.18 per ton of Ice B’ Gone delivered, as recommended by James Stewart, Director of Public Works. -5- Minutes - Board of Mayor and Burgesses Regular Meeting - October 6, 2009 16. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for “Winter Sand for Snow and Ice Control” to H. I. Stone & Son Inc., 313 Main Street North, Southbury, CT 06488 in the amount of $11.74 per ton delivered, as recommended by James Stewart, Director of Public Works. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for “Roofing Replacement Santa’s Village” to Allerton Development Inc., P.O. Box 1171, Naugatuck, CT 06770 in the amount of $11,800. subject to the transfer of the required funding by the Finance Board, as recommended by James Stewart, Director of Public Works. 18. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses adopt the following resolution authorizing Mayor Robert Mezzo to sign the agreement for the Federal grant for the construction of the Rubber Avenue Bridge project, as recommended by James Stewart, Director of Public Works: RESOLVED, that Robert A. Mezzo, Mayor, be, and hereby is, authorized to sign the agreement entitled: “Agreement between the State of Connecticut and the Borough of Naugatuck for the construction, inspection and maintenance of the rehabilitation of Rubber Avenue Bridge (Bridge No. 03713) utilizing federal funds under the American Recovery and Reinvestment Act of 2009 Public Law 111-5 (hereinafter (“Act”)”. Burgess Comments/Sub-Committee Reports Burgess Kuczenski told residents to voice their concerns regarding the Board of Education budget at the Board of Education meetings. Burgess Ciacciarella said the Zoning Commission is working on town wide zone changes. He attended the WPCA meeting and said the study on the water issues is almost complete. There was some discussion regarding a sewer usage fee. Burgess Woodfield said everyone should be careful who to blame over the Board of Education budget. He said it is not the teachers fault but the Board of Education. -18- Minutes - Board of Mayor and Burgesses Regular Meeting - October 6, 2009 Deputy Mayor Rossi thanked the Elks Lodge for their dedication and observance of Patriots Week and the Boy Scouts Troop for their hard work during the Harvest Moon Festival. She encouraged the Burgesses to attend the TRIAD fashion show this month. The Deputy Mayor brought to everyone’s attention the petition that is circulating about social security. (Deputy Mayor Rossi’s comments are attached as submitted.) Burgess Fragoso reminded everyone it was Fire Prevention Week. A company contacted the Fire Department asking if they can put a twenty foot taller tower on the Eastside Fire Station. The company will pay the Borough for allowing them to do so and the Fire Department is requesting the money go into their budget instead of the General Fund. She thanked the following people for their involvement with the Farmers Market: the Farmers for believing in Naugatuck, the Park Department and Park Commission, Senior Center Director Harvey Frydman and the senior volunteers, and everyone who supported the farmers with their business. Burgess Scully said he would like the Riverwalk to get started in the spring. He spoke about the Davis Street water issue and the need to fix the situation. Mayor Mezzo said on October 19th at 7p.m. is a presentation/public forum regarding the St. Mary’s Hospital proposal to be held at the Historical Society. 22.
