MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING JANUARY 5, 2010 1. Mayor Robert Mezzo called the meeting to order at 6:00 p.m. with the following in attendance: BURGESSES: RESIDENTS: Eight T. K. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the monthly reports of December. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth to recess to Executive Session at 6:01p.m. for discussion on the following: Real Estate (Jesse Camille’s and DOT Property), Personnel/Collective Bargaining (Recreational Director) Personnel (Street Superintendent) inviting in Attorney N. Mayor Mezzo reconvened the meeting at 7:00 p.m.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – January 5, 2010 6. The following motions emanated from Executive Session. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to enter into an Employment Agreement between the Borough of Naugatuck and Robert Roland for the position of Street Superintendent. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute a quit claim deed transferring the interest of the Borough of Naugatuck to a 2186 sq. ft. parcel of land which is described on Schedule A attached hereto to Peter Chrzanowski in consideration of the sum of $6000.00 subject only to approval of the Planning Commission as required by the Connecticut General Statute. Schedule A Description All that certain real property, situated in the Borough of Naugatuck, County of New Haven and State of Connecticut, being more particularly shown and designated as “formerly Bridge Street” on a certain map entitled “Map Prepared for Peter Chrzanowski, North Main Street, Naugatuck, Conn.” dated November 27, 2007, scale 1” = 10”, prepared by R.J. Desrosiers & Associated, which map has not been filed for record in the Naugatuck Town Clerk’s Office. Said premises are more particularly bounded and described as follows: NORTHERLY: by land now or formerly of the State of Connecticut, 30.42 feet; EASTERLY: by North Main Street, 43.00 feet; SOUTHERLY: by land now or formerly of Peter Chrzanowski, 45.53 feet; and WESTERLY: by land now or formerly of the State of Connecticut, 45.58 feet 7. Public Comment Residents spoke on the following issues: • for and against the new snow plow/dump truck • garbage on Carroll Street • the elimination of municipal trash removal for multi-rental properties • the work being done on Parcel C  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – January 5, 2010 8. Burgess Comments/Sub-Committee Reports Burgess Kuczenski reported there will be a Senior Health Clinic on January 14th and a Free Tax Service on January 21st at the Senior Center. Burgess Ciacciarella stated the unemployment rate in Connecticut is high. He said Southbury has a hiring freeze and suggested we consider it. He said an ordinance for Union City should be discussed in February. He reminded everyone about the fundraising efforts for the Prospect Street School playground. Burgess Neth questioned the Street Commission’s authority to institute a policy without coming before the Borough Board. He wondered if the thirty day time frame was too short to give people adequate time to make alternate plans for trash removal. He feels it is an embarrassment to the Borough when an employee is accused of breaking the law and we pay them to be out on administrative leave until the accusation is resolved. Burgess Woodfield wonders how a garbage truck driver will determine how many units are in a building and how many bags of trash to pick up. Deputy Mayor Rossi thanked the Park, Police and Fire Departments along with everyone who contributed to a successful tree lighting ceremony she attended with her family. Mayor Mezzo said the Street Commission has the authority under the charter to determine policy. They decided to enforce a rule already on the books. He said the owner on Carroll Street has been cited by the Health Department. He also stated the issue with two and three family homes being affected is because the owners’ combined them on a deed for tax benefits so now those homes become five family homes and therefore are affected by the new trash policy. Burgess Burns welcomed back Mayor Mezzo and Deputy Mayor Rossi from their holiday vacation with their families. Burgess Fragoso believes private road homes should not have trash pick up. She acknowledged the generosity of Dan Whitman toward needy families. She said there was an eighteen percent increase in social services provided in the Borough. Burgess Scully said he will miss Viva Brockman-Harris and Bob Reilly who recently passed away. Burgess Campbell said he is in favor of the purchase of the new snow plow/dump truck because the men need the proper equipment to do their job. 9. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the appointment of Pamela Ruccio, 70 Fairview Avenue, Naugatuck, CT 06770 as a regular member of the UPSEU and Chapter 90 Pension Board, filling the vacancy of Janet Gallant, indefinite term.  -4- Minutes – Board of Mayor and Burgesses – Regular Meeting – January 5, 2010 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Ciacciarella that the Board of Mayor and Burgesses approve the appointment of Anthony Malone, 81 Coen Street, Naugatuck, CT 06770 as a regular member of the Board of Education and AFSCME Pension Board filling the vacancy of Christopher Ford, indefinite term. 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Sarah Poynton, 29 Olive Street, Naugatuck, CT 06770 as a regular member of the Board of Education and AFSCME Pension Board filling the vacancy of Carl Herb, indefinite term. 12. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Ronald Merancy, (D) 1074 Andrew Mountain Road, Naugatuck, CT 06770 as a regular member of the Water Pollution Control Authority term to expire February 1, 2015. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the reappointment of Rimas Balsys, (R) 33 Phoenix Ave, Naugatuck, CT 06770 as a regular member of the Water Pollution Control Authority term to expire February 1, 2015. 14. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the appointment of Patrick Mallane, (D) 105 Field Street, Naugatuck, CT 06770 as a regular member of the Water Pollution Control Authority, filling the unexpired term of Robert Villano, term to expire February 1, 2012. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for “The Rehabilitation of Bridge #03713 Located at Rubber Avenue over Long Meadow Pond Brook” to Dayton Construction Company Inc., 146 Bunker Hill Road, Watertown, CT 06795 in the amount of $824,710. bid award is subject to State DOT approval and submission of required contract documentation as recommended by James Stewart, Director of Public Works.  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – January 5, 2010 16. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution authorizing Mayor Robert Mezzo to sign an agreement to join the preliminary efforts by the Capitol Region Council of Governments to form a new Solid Waste Authority entitled the “Central Connecticut Solid Waste Authority” as recommended by James Stewart, Director of Public Works and Sheila Baummer, Recycling Coordinator: WHEREAS, the municipalities constituting the Mid-Connecticut Project have been researching solutions for long-term solid waste disposal when their contract with the Connecticut Resources Recovery Authority expires in 2012; and WHEREAS, other municipalities in the Council of Governments of the Central Naugatuck Valley and elsewhere have expressed interest in joining efforts with the Mid-Connecticut Project municipalities to find long-term solid waste disposal solutions; and WHEREAS, the Capitol Region Council of Governments has performed a regional solid waste options analysis and successfully tested the presence of alternatives in the private market through a Request for Information for Integrated Regional Solid Waste Management Services covering Transfer, Transportation, Disposal and Processing/ Recycling Services; and WHEREAS, the Capitol Region Council of Governments Executive Committee has authorized CRCOG staff to facilitate the forming of a solid waste management authority to represent municipalities interested in conducting an RFP and negotiating for long-term solid waste disposal services; and WHEREAS, the Borough of Naugatuck has expressed preliminary interest in taking part in the solid waste authority formed by the Capitol Region Council of Governments, the “Central Connecticut Solid Waste Authority”, NOW, THEREFORE BE IT RESOLVED that the Borough of Naugatuck Board of Mayor and Burgesses does hereby preliminarily endorse the above referenced Central Connecticut Solid Waste Authority and authorizes Mayor Robert A. Mezzo to sign all necessary agreements and take all necessary actions to allow the Borough to pay a fee of $500 to help defray the professional fees necessary to draft a model ordinance which the Borough would then adopt if it decided to become a member of the Authority, as well as other costs of creating the Authority. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Tax Collector Jim Goggin to add solicitation on Borough tax bills requesting donations for the WWI Monument Restoration Project. 18. The following motion was tabled until next month: Motion by Burgess that the Board of Mayor and Burgesses authorize the Mayor to enter into the following Memorandum of Understanding between the Borough of Naugatuck and the Greater Waterbury Transit District Board of Directors for a municipal grant program for seniors and disabled demand responsive transportation: The Greater Waterbury Transit District member municipality, Borough of Naugatuck, enters into an agreement with the Greater Waterbury Transit District Board of Directors to jointly apply for the Municipal Grant Program for Senior and Disabled Demand Responsive Transportation (CGS 13b-38bb) FY 2011 (starting July 1, 2010 and ending June 30, 2011) from the Connecticut Department of Transportation. This Matching Grant Program is not intended to replace funds previously spent by municipalities on transporting the elderly or persons with disabilities. This program is intended to expand a coordinated transportation system for the elderly and persons with disabilities. The maximum amount each municipality can receive is based on two parts: 1.) The 2000 U.S. Census count of people 60 years and older in the municipality relative to the state’s population of people 60 years or older is 50%, and 2.) The municipality’s square acreage relative to the state’s total square acreage is 50%. The municipality agrees to provide the Connecticut Department of Transportation with financial records of expenditures on transportation for the elderly and disabled and documentation of the level of ridership and hours of service, when requested to do so.  -7- Minutes – Board of Mayor and Burgesses – Regular Meeting – January 5, 2010 The eight Greater Waterbury Transit District member municipalities will apply to the Municipal Grant Program for Senior and Disabled Demand Responsive Transportation (CGS 13b-38bb) as a group to provide coordinated transportation. These eight municipalities are Cheshire, Middlebury, Naugatuck, Prospect, Thomaston, Waterbury, Watertown and Wolcott. The Greater Waterbury Transit District will administer the grant, providing additional and coordinated transportation services to the elderly (60 years and older) and to persons with disabilities within the Greater Waterbury Transit District area. The grant will be used to cover administrative cost and operational cost relative to this program. The Greater Waterbury Transit District will coordinate with the municipal senior transportation service to perform this program. The Greater Waterbury Transit District will be responsible for required reporting information. The Greater Waterbury Transit District will be the recipient of the grant and will disburse the grant. The Greater Waterbury Transit District will be responsible for negotiating operational service or services. The Greater Waterbury Transit District administrative cost includes but is not limited to, office supplies and equipment, utilities, outreach, bookkeeper, auditor, travel, liability insurance, and meetings. The Greater Waterbury Transit District will provide operational policies and procedures for this program. 19. Motion by Deputy Mayor Rossi and seconded by Burgess Fragoso that the Board of Mayor and Burgesses refer to the Joint Boards of Mayor and Burgesses and Finance Board a transfer request of $20,350. from Contingency to HRD, Community Services as recommended by Wayne McAllister, Controller. Public Comment Residents spoke on the following issues: • a plan to stop the skateboarders from damaging the WWI Monument • garbage on the streets and underneath the bridge • a resident acknowledged the nurses at Western Avenue and Central Avenue schools for helping to distribute items to needy families 22. Burgess Comments/Sub-Committee Reports Burgess Campbell said the grant HRD lost helped fund the operational costs to run the department. The HRD bus service does not duplicate the service being provided by the Senior Center. Burgess Fragoso said the Census is very important for Naugatuck. It determines how much money will be given to our town. They are looking for bilingual committee members. She thanked Ed Carter for the brick walkway idea at the high school. Burgess Burns told Ed Carter he did a great job. He also acknowledged the Fire Department for their outstanding team work. Mayor Mezzo said Ed did a phenomenal job at the tree lighting ceremony. Deputy Mayor Rossi said the contaminate removal on Parcel C has been halted due to the weather conditions. She congratulated Anne Butler on her retirement. She said the Carriage House Account Committee has decided to spend $5000. by purchasing a sliding office window, pool cues, a digital camera, an LCD HDTV and a bingo machine. (Deputy Mayor Rossi’s comments are attached as submitted.) Burgess Woodfield asked if Wayne looked at the accounting for HRD. Burgess Ciacciarella said the odor study report went to the DEP. The Plan of Conservation and Development is going to be updated for 2011. He received a call from a resident who got a warning for not shoveling. The Explorers group is no longer available to shovel for the elderly and disabled. He said Chief Edson is working on another plan to help those residents.  -12- Minutes – Board of Mayor and Burgesses Regular Meeting – January 5, 2010 Burgess Kuczenski congratulated Ed for the brick walkway idea. 23.
