REVISED MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING MARCH 2, 2010 1. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Kuczenski that the Board of Mayor and Burgesses approve the minutes of the regular meeting of February 2, 2010 and the special meetings of February 17, 2010 and February 22, 2010. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the monthly reports of February. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth to recess to Executive Session at 6:01 p.m. for discussion on the following: Collective Bargaining (Dispatchers, AFSCME/Public Works) inviting in Human Resource Director J. Deschesnes and Public Works Director J. Stewart. Mayor Mezzo reconvened the meeting at 7:00 p.m. 6. The following motion emanated from Executive Session.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – March 2, 2010 VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to sign a Collective Bargaining Agreement by and between the Borough of Naugatuck and the United Public Service Employees Union Local 424 Unit 15B Naugatuck Police 911 Dispatchers July 1, 2007 through June 30, 2010. The following motion was tabled. 7. Motion by that the Board of Mayor and Burgesses recess to Retirement Board at p.m. 8. Public Comment Residents spoke on the following issues: • The new multi home trash policy • Flooding issues • Trash drop-off policy 9. Burgess Comments/Sub-Committee Reports Burgess Ciacciarella held his quarterly meeting. He commended the Police Chief and the entire Police Department for stepping up their presence in Union City. Deputy Mayor Rossi congratulated the recipients of the Exchange Club Community Champions, the United Way Volunteer of Year and the Elk of the Year. She gave kudos to the Police Department for promoting drug and bullying awareness. She acknowledged the large turn out of girls from the Girl Scouts Organization. The Deputy Mayor finds it alarming that there is a possible subcommittee looking into resolving the Cherry Street situation by eminent domain. Mayor Mezzo said Deputy Mayor Rossi was referring to a study regarding the Nettleton Avenue area and Cherry Street area situations. The solutions are difficult. One solution is to take properties by eminent domain and the other solution is a 4.4 million dollar price tag to resolve the problem. Burgess Burns congratulated the Girl Scouts. He said the Cherry Street flooding situation is an old problem and it’s time to finally address it. Burgess Fragoso welcomed the Girl Scouts. She thanked the Mothers and the leaders. She implored everyone to attend the weekly budget hearings. Burgess Scully commented on the Parcel C development and Mr. Conroy. Burgess Campbell spoke about the Cherry Street flooding. 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses designate the week of March 7, 2010 as Girl Scout Week with the following Proclamation:  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – March 2, 2010 WHEREAS, March 12, 2010 marks the 98th anniversary of Girl Scouts of the USA, founded by Juliette Gordon Low in 1912 in Savannah, Georgia; and WHEREAS, throughout its distinguished history, Girl Scouting has inspired millions of girls and women with the highest ideals of courage, confidence, and character; and WHEREAS, through the Girl Scout leadership experience girls develop the skills and lessons that will serve them a lifetime so that they may contribute to their communities; and WHEREAS, Girl Scouting takes an active role in increasing girls’ awareness of the opportunities available to them today in math, science, sports, technology and other fields that can expand their horizons; and WHEREAS, more than 3 million current Girl Scout members nationwide will be celebrating 98 years of this American tradition, with nearly 50 million women who are former Girl Scouts and living proof of the impact of this amazing movement; NOW, THEREFORE, I, Mayor Robert A. Mezzo, do hereby applaud the commitment Girl Scouting has made to support the leadership development of America’s girls and proudly proclaim the week of March 7, 2010 as Girl Scout Week. 11. Mayor Mezzo reappointed Cary Lennon, 348 Hillside Avenue, Naugatuck, CT 06770 as a regular member of the Building Code Board of Appeals, term to expire March 1, 2015. 12. Mayor Mezzo reappointed Alberto A. Janeiro, 101 Marbern Lane, Naugatuck, CT 06770 as a regular member of the Building Code Board of Appeals, term to expire March 6, 2012. 13. Mayor Mezzo appointed Vincent Cascella, 84 Gail Drive, Naugatuck, CT 06770 as a regular member of the Building Code Board of Appeals, filling the expired term of Raymond Donnelly, term to expire September 1, 2014. 14. Mayor Mezzo appointed Robert Schmidt, 68 Radnor Avenue, Naugatuck, CT 06770 as a regular member of the Building Code Board of Appeals, filling the expired term of Anthony Smith, term to expire March 4, 2013.  -4- Minutes – Board of Mayor and Burgesses Regular Meeting – March 2, 2010 15. Mayor Mezzo appointed Peter Meleschnig, 76 East Waterbury Road, Naugatuck, CT 06770 as a regular member of the Building Code Board of Appeals, filling the expired term of Earl Lindgren, term to expire August 1, 2011. 16. Mayor Mezzo appointed Carlos Antunes, 154 Cliff Street, Naugatuck, CT 06770 as an alternate member of the Building Code Board of Appeals, term to expire March 2, 2015. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Campbell that the Board of Mayor and Burgesses add to the agenda the appointment of Elma Solomon to the Park Commission. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Campbell that the Board of Mayor and Burgesses approve the appointment of Elma Solomon (D), 228 Crestwood Drive, Naugatuck, CT 06770 as a regular member of the Park Commission, filling the unexpired term of Joseph Healy, term to expire September 1, 2012. 19. Linda Ramos and BJ Forlenzo, members of the Blight and Beautification Council, gave a brief presentation on the subcommittees’ progress since the Council’s formation in August. A blight ordinance is near completion. 20 VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses designate March 11, 2010 as World Kidney Day with the following Proclamation: WHEREAS, Nephrologica, Inc. (The World’s Leading Kidney Network) and other organizations nationwide are recognizing kidney disease on this day and every second Thursday in March thereafter; and WHEREAS, of the estimated 20 million people, or 1 in 9 adults, with chronic kidney disease, an additional 20 million are at risk for developing chronic kidney disease; and WHEREAS, by calling attention to the importance of education and patient self- empowerment with regard to chronic kidney disease within our city we hope to improve the quality and availability of such information and services; and  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – March 2, 2010 WHEREAS, our future depends on the superiority of quality of care and services; education, advocacy and awareness of chronic kidney disease represent a worthy commitment to current and future patients. NOW, THEREFORE, I, Mayor Robert A. Mezzo of the Borough of Naugatuck do hereby proclaim Thursday, March 11, 2010 and every second Thursday in March thereafter, as World Kidney Day in the Borough of Naugatuck and call upon all citizens to observe the day with appropriate programs and activities, furthermore, I encourage the citizens of Naugatuck to seek counsel and input from any person or group, such as Nephrologica, Inc. with knowledge and expertise in matters concerning chronic kidney disease. 21. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the bid for the “2010 Town Wide CCTV Stormwater Drainage Inspection Program” to New England Pipe Cleaning Company Division Heitkamp, Inc., 99 Callender Road, Watertown, CT, 06795 in the amount of $20,732.41, as recommended by James Stewart, Director of Public Works. 22. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution and charter revision to Article IV, Officers and Employees, Division 1 Generally, Secs. 2-141 – 2-150 Reserved: WHEREAS, the Borough of Naugatuck (the “Borough”) may establish one or more trust funds to hold and invest contributions and assets of the Borough’s retiree employee health and life systems pursuant to Section 7-450(a) of the General Statutes of Connecticut (the “Statute”); and WHEREAS, the Borough authorized such trust by ordinance adopted on December 1, 2009; and WHEREAS, the Board of Mayor and Burgesses desires to amend such ordinance. NOW, THEREFORE, BE IT RESOLVED that: The Amendment to the Borough’s Code of Ordinances, attached hereto (the “Amendment”), is hereby approved. The Borough Clerk is directed to publish such Amendment at least twice in a newspaper with a circulation in the Borough in accordance with Section 63, subsection 45 of the Charter of the Borough.  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – March 2, 2010 AMENDMENT That Section 2-141 of the Code of Ordinances (the “Code”), Borough of Naugatuck, Connecticut (the “Borough”) is hereby amended to read as follows: §2-141. Retiree Health Care Trusts. A. In accordance with Conn. Gen. Stat. § 7-450(a), the Borough hereby establishes one or more Trust Funds (collectively the “Trusts”) to hold and invest all contributions and assets of the Borough’s retiree health and life benefit plan or plans (the “Plan”). The Board of Mayor and Burgesses of the Borough shall have the authority to amend or terminate the Trusts. B. The Trusts shall be for the purpose of funding current and future post- employment health care and life benefits for eligible retired employees in accordance with the Plan. For purposes of this section, employee shall mean any employee and former employee entitled to participate in the Plan. The Trusts may also be used for the purpose of funding any other post-employment health and life benefit plans as the Borough may establish. C. The Trusts shall be administered by the Trustees (the “Trustees”) appointed pursuant to a trust agreement (the “Trust Agreement”) approved by the Board of Mayor and Burgesses as soon as possible after the enactment of this section. The Trustees shall have such powers and duties as set forth in the Trust Agreement, including directing the investment of the assets of the Trusts and making payments or other disbursements in accordance with the Plan and the terms of the Trusts. D. After the enactment of this section, the Board of Mayor and Burgesses shall appoint a Borough Representative to, among other things, provide all proper instructions and directions to the Trustees regarding disbursements from the Trusts on behalf of the Borough. Public Comment A resident asked when the Street Commission will meet with the Borough Board. 25. Burgess Comments/Sub-Committee Reports Burgess Campbell supports the Mayor on his stand with the Street Department’s decision regarding the new trash policy.  -10- Minutes – Board of Mayor and Burgesses Regular Meeting – March 2, 2010 Burgess Fragoso told everyone the Park Commission will be meeting at Town Hall starting in April. The plan is coming together regarding the Gunntown property. She said a committee is addressing whether duplicate social services are being provided in town. Mayor Mezzo said budget updates are on his blog. He responded to Burgess Scully’s comments on Renaissance Place. He reminded the Board that they retain the rights to approve any deviation of the project. The Mayor said lenders are not lending at the present moment. He stated the Department of Transportation conceptually approves the project. Deputy Mayor Rossi said a lot of ground work is being laid now; therefore when the economy turns around we will be ready to proceed with investors. She commended the entire Blight Council for their hard work and dedication. (Deputy Mayor Rossi’s comments are attached as submitted.) Burgess Neth said the Board needs to analyze whether the lowest bidder should always be chosen. He said Joe Healy is an icon in the Borough and he will be greatly missed on the Park Commission. Burgess Neth said he is working on his own reconfiguration plan for the school system. Burgess Ciacciarella told everyone the group NEON will be hosting a free community dinner on March 20th from 4 to 6pm. He thinks Alex Conroy should come before the Borough Board and give an update on the project. 26.
