MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING APRIL 6, 2010 1. Mayor Robert Mezzo called the meeting to order at 6:03 p.m. with the following in attendance: BURGESSES: RESIDENTS: Fifteen T. K. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the minutes of the regular meeting of March 2, 2010 and the special meetings of March 1, 2010 and March 8, 2010. Each member received copies for review. 4. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the monthly reports of March. Each member received copies for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns to recess to Executive Session at 6:04 p.m. for discussion on the following: Collective Bargaining (AFSCME/Public Works and Health Insurance), Real Estate/Pending Lease (Jesse Camille’s) inviting in Human Resource Director J. Deschesnes. Mayor Mezzo reconvened the meeting at 7:08 p.m. 6. There were no motions emanating from Executive Session.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – April 6, 2010 7. Public Comment Residents spoke on the following issues: • Against closing Salem School • Milling the road by Field Street • Sidewalk lifting in front his residence • Community Passive Park Mayoral Aide Ed Carter said Naugatuck High School graduate Christopher Rivers will be graduating from WestPoint Academy in June. An American flag, donated by the Veteran’s Council, will be flown at the State Capital then given to Christopher upon his graduation. Mr. Carter gave a report on upcoming community events: Veteran’s Council Car Show - April 25th, NHS Greyhound Pride Night - April 28th, Kollege Kapers Show - May 1st, Naugatuck Teen Theater’s Unrinetown – May 7-16th, Naugatuck River Kayak and Canoe Race - May 8th and Naugatuck Duck Day - June 6th. 8. Burgess Comments/Sub-Committee Reports Burgess Ciacciarella said they are in the process of determining if Union City meets the definition for a Neighborhood Revitalization Zone (NZR). He said Union City Clean Up Day is scheduled for May 1st. He does not support the closing of Salem School and is disturbed by the suggestion of it being used as a second Town Hall. Deputy Mayor Rossi said the Hibernians did an excellent job on St. Patrick’s Day. She was asked by the Police Chief to be on a Juvenile Review Board that he and Sergeant Hunt formed. The Deputy Mayor thanked Mayoral Aide Ed Carter for everything he has done with the Pathway of Honor, Pride and Tradition fundraising walk-a-thon. She does not support the closing of Salem School at this time and would like to see Burgess Neth’s proposal. Mayor Mezzo said there will be an Economic Seminar on April 28th from 6:30- 9pm at the Naugatuck Economic Development Corporation Office. He said all union contracts are on the town’s website. The Mayor commended the Public Works Department, Fire and Police Departments and Emergency Management for the fine job during the recent storm. The Mayor said the numbers regarding Salem School are available and have been formulated by the Business Manager/Controller and the Director of Curriculum for the Board of Education. The choices the Board of Education has to make are not going to be good. Burgess Burns commended Jim Stewart and Bob Roland during the recent storm on Cherry Street. Burgess Fragoso said she is concerned every time it rains about the roof at Jesse Camille’s Restaurant. She said in regards to Salem School, we should wait and see the facts and figures and not form an opinion on emotion. She is hoping the Borough will get an increase in Senior Citizens vouchers for the Farmers Market.  -3- Minutes – Board of Mayor and Burgesses Regular Meeting – April 6, 2010 She suggests the Borough reassess the process for addressing water issues in residents’ homes. Burgess Scully said he wishes the Board of Education would slow down. He would like to see local neighborhood schools with grades K-6th and one middle school. Burgess Scully would like Alex Conroy to come before the Borough Board and answer questions. He questioned the status of the David Street water situation. He said Connie Collins, an integral part of the Ancient Order of Hibernians, passed away this past weekend. Burgess Campbell said he is against the closing of any school. 9. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the reappointment of Bachan Chawla, 1087 May Street, Naugatuck, CT 06770 as a regular member of the Naugatuck Valley Health District, term to expire October 1, 2012. 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the reappointment of Mary Connolly, 27 Carolyn Circle, Naugatuck, CT 06770 as a regular member of the Naugatuck Valley Health District, term to expire October 1, 2012. 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the reappointment of Ruth Yachtis, 385 May Street, Naugatuck, CT 06770 as a regular member of the Naugatuck Valley Health District, term to expire March 1, 2013. 12. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Ciacciarella that the Board of Mayor and Burgesses approve the appointment of Margaret Sheehy, 31 Meadowbrook Place, Naugatuck, CT 06770 as a regular member of the Naugatuck Valley Health District, filling the unexpired term of V. Hutman, term to expire June 1, 2010. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the appointment of Sally Brouillet, 205 Osborn Road, Naugatuck, CT 06770 as an alternate member of the Zoning Commission, filling the unexpired term of J. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to execute agreements with Connecticut Light and Power to install and/or repair street lights as recommended time to time by James Stewart, Director of Public Works and Burgess Robert Burns, Street Lights Liaison. 26. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve the bid for the “Roof Repair Replacement – Public Works Garage 510 Rubber Avenue” to Benco, LLC, 3000 South Main Street, Torrington, CT, 06790 in the amount of $21,489.00, as recommended by James Stewart, Director of Public Works. 27. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses adopt the following resolution: RESOLVED, that the Board of Mayor and Burgesses authorize Mayor Robert A. Mezzo to enter into and execute any and all documents necessary to finalize a Memorandum of Understanding between the Borough of Naugatuck and the State of Connecticut Internet Crimes Against Children Task Force to deter, prevent, investigate and prosecute predators who seek to exploit or engage minors in sexual activity through the use of computers, electronic media and the internet. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses adopt the following resolution: BOROUGH OF NAUGATUCK FAIR HOUSING RESOLUTION WHEREAS, all American citizens are afforded a right to full and equal housing opportunities in the neighborhood of their choice; and WHEREAS, State and Federal Fair Housing laws require that all individuals, regardless of race, color, religion, sex, national origin, ancestry, marital status, age  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – April 6, 2010 mental or physical disability, lawful source of income, sexual orientation, familial status, be given equal access to rental and homeownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, the Borough of Naugatuck is committed to upholding these laws, and realizes that these laws must be supplemented by an Affirmative Statement publicly endorsing the right of all people to full and equal housing opportunities in the neighborhood of their choice. NOW THEREFORE, BE IT RESOLVED, that the Borough of Naugatuck hereby endorses a Fair Housing Policy Statement to ensure equal opportunity for all persons to rent, purchase and obtain financing for adequate housing of their choice on a non-discriminatory basis; and BE IT FURTHER RESOLVED, that the Mayor of the Borough of Naugatuck or his/her designated representative is responsible for responding to and assisting any person who alleges to be the victim of an illegal discriminatory housing practice in the Borough of Naugatuck. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses adopt the following Fair Housing Policy Statement: It is the policy of the Borough of Naugatuck to promote fair housing opportunities and to encourage racial and economic integration in all its programs and housing development activities. Programs funded and administered by this Borough of Naugatuck must comply with the provisions of Section 46a-64c of the C.G.S., and with related state and federal laws and regulations that prohibit discriminatory housing practices. The Borough of Naugatuck or any of sub recipient of the Borough of Naugatuck will carry out an affirmative marketing program to attract prospective buyers or tenants of all majority or minority groups, without consideration of race, color, religion, sex, national origin, ancestry, creed, sexual orientation, marital status, lawful source of income, disability, age or because the individual has children in  -7- Minutes – Board of Mayor and Burgesses Regular Meeting – April 6, 2010 all programs and housing development activities funded or administered by the Borough of Naugatuck. The municipality’s Mayor is responsible for the enforcement and implementation of this policy. The Mayor may be reached at 203-720-7009 or BMezzo@naugatuck-ct.gov. Complaints pertaining to discrimination in any program funded or administered by this Borough of Naugatuck may be filed with the Mayor. The municipality’s Grievance Procedure will be utilized in these cases. Complaints also may be filed with the Commission on Human Rights and Opportunity, Special Enforcement Unit, 21 Grand Street, Hartford, CT 06106, Telephone (860) 541-3403. A copy of this policy statement will be given annually to all Borough of Naugatuck employees and they are expected to fully comply with it. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses adopt the following Title VI Equal Opportunity Statement: The Borough of Naugatuck does not discriminate in the provision of services, the administration of its programs, or contractual agreements. The Borough of Naugatuck seeks to fully carry out its responsibilities under the Title VI Regulations. Title VI of the Civil Rights Act of 1964 prohibits discrimination on the grounds of race, color or national origin in programs and activities receiving Federal financial assistance. Title VI provides that No person shall on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any programs covered by the Regulations.  -8- Minutes – Board of Mayor and Burgesses Regular Meeting – April 6, 2010 This policy is effectuated through the methods of administration outlined in the Borough of Naugatuck’s Fair Housing Plan and is fully implemented to ensure compliance by the Borough of Naugatuck, as the recipient, and by sub- recipients. Motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses accept the application submitted at the Public Hearing on March 30, 2010, for the Connecticut Small Cities Community Development Block Recovery Program to be incorporated in the Borough of Naugatuck’s DECD Application for 2010 with the following resolution: WHEREAS, pursuant to Chapter 127c and Part VI of Chapter 130 of Connecticut General Statutes, the Connecticut Department of Economic and Community Development is authorized to extend financial assistance for economic development projects; and WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make an application to the State for $500,000 in order to undertake the Drainage and Related Improvements on Nettleton Avenue and to execute an Assistance Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE Board of Mayor and Burgesses 1. That it is cognizant of the conditions and prerequisites for the state financial assistance imposed by Chapter 127c and Part VI of Chapter 130 of the Connecticut General Statutes 2. That the filing of an application for State financial assistance by Borough of Naugatuck in an amount not to exceed $500,000 is hereby approved and that Mayor Robert A. Mezzo is directed to execute and file such application including a Program Income Reuse Plan, if applicable, with the Connecticut Department of Economic and Community Development, to provide such additional information, to execute such other documents  -9- Minutes – Board of Mayor and Burgesses Regular Meeting – April 6, 2010 as may be required, to execute an Assistance Agreement with the State of Connecticut for State financial assistance if such an agreement is offered, to execute any amendments, decisions, and revisions thereto, carryout project activities, if approved and to act as the authorized representative of Borough of Naugatuck 3. That it hereby adopts or has adopted as its policy to support the following nondiscrimination agreements and warranties required under subsection (a)(1) of Connecticut General Statutes sections 4a-60 and 4a-60a, respectively, as amended by Public Act 07-245 and sections 9(a)(1) and 10(a)(1) of Public Act 07-142 and, and for which purposes the “contractor” is Borough of Naugatuck and “contract” is said Assistance Agreement: The contractor agrees and warrants that in the performance of the contract such contractor will not discriminate or permit discrimination against any person or group of persons on the grounds of race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved, in any manner prohibited by the laws of the United States or of the state of Connecticut. The contractor further agrees to take affirmative action to insure that applicants with job-related qualifications are employed and that employees are treated when employed without regard to their race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation, or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses authorize the Mayor to proceed with whatever procedures are necessary in order to add the also known as name to Division Street as also known as Franklin E. Johnson, Sr. Way. 33. Park Commission Chairman Patrick Wagner, Jay Kuczenski and Attorney Edward Fitzpatrick gave a presentation to the Borough Board regarding the Rules and Regulations for the Gunntown Park and Conservation Area adopted by the Park Commission on March 9, 2010. Commissioner Wagner stated both the Fire and Police Departments have been involved in the planning. The entrance to the property was changed for safety reasons. He gave a general description of some of the changes to the property such as an observation area, information kiosks, benches, and a butterfly area to name a few. Attorney Fitzpatrick reminded the Board that they charged the Park Commission to come back and present a plan. He said there is a possibility it will need to go before the Zoning and Inland Wetlands Commissions for approval. 34. Motion by Deputy Mayor Rossi and seconded by Burgess Fragoso that the Board of Mayor and Burgesses approve the Site Plan entitled “Gunntown Park and Conservation Area”, Engineering Department, Borough of Naugatuck, December 4, 2009, revised to April 1, 2010, Wayne Zirolli L.S. Johnson, Sr. Way 39. Burgess Comments/Sub-Committee Reports Burgess Fragoso said the Street Commission is going to research and study the trash pick-up policy. Burgess Burns said the water fountain on the green needs to be fixed. Deputy Mayor Rossi said the Naugatuck Business Merchants are back on track. She said the Blight and Beautification Council has finalized the blight ordinance and it is now in the hands of Borough Counsel. She said Uniroyal retirees’ are being denied the use of the Naugatuck Visiting Nurses Association by Healthnet. She stated here will be a free dental health clinic at the Senior Center on April 15th.
