AGENDA REGULAR MEETING BOARD OF MAYOR AND BURGESSES SEPTEMBER 7, 2010 1. Mayor Mezzo will call the Regular Meeting to order at p.m. 2. Pledge of Allegiance to the flag. 3. Motion by Burgess that the Board of Mayor and Burgesses approve the minutes of the regular meeting of August 3, 2010 and the special meeting of August 17, 2010. Each member received copies for review. 4. Motion by Burgess that the Board of Mayor and Burgesses approve the monthly reports of August. Each member received copies for review. 5. Motion by Burgess to recess to Executive Session at p.m. for discussion on the following: Personnel (Assessor, Interim Fire Chief, Interim Fire Marshal, Deputy Police Chief) Collective Bargaining (Visiting Nurses) inviting in _______________. Mayor Mezzo will reconvene the meeting at p.m. 6. Discussion/possible action on matters emanating from Executive Session. 7. Public Comment – Open Topic 8. Presentation by the Naugatuck High School Cheerleaders regarding trip to 2011 Gator Bowl in Jacksonville, Florida. 9 Burgess Comments – Open Topic 10. Gunntown Park Update by Attorney Edward Fitzpatrick. 11. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents relative to the Naugatuck Visiting Nurses Association and Health Insurance Providers. ROLL CALL VOTE: 12. Discussion/possible action on the Non-Union Personnel Policy Manual as recommended by Jeannette Deschesnes, Human Resources Director. 13. Motion by Burgess that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for the “David Street Water Service Installation” to RAR Excavating & Building, 1343 Mountain Road, Torrington, CT 06790 in the amount of $54,577. contingent on the allocation of funds from the Five Year Capital Plan Committee as recommended by James Stewart, Public Works Director.  -2- Agenda – Board of Mayor and Burgesses Regular Meeting – September 7, 2010 14. Motion by Burgess that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for the “Timber Parking Lot Rail” to A&M Fence and Guardrail LLC, 50 Schoolground Road, Branford, CT 06405 in the amount of $7,225. as recommended by James Stewart, Public Works Director. 15. Motion by Burgess that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for the “Town Hall Exterior Sealant Replacement” to G.L. Capasso Inc., 34 Lloyd Street, New Haven, CT 06513 in the amount of $17,600. plus an additional $1,000. to maintain parking lot access during working hours as recommended by James Stewart, Public Works Director. 16. Motion by Burgess that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for the “Refuse Cart Lifter” to Sanitary Equipment, P.O. Box 26006, 25 Industry Drive, West Haven, CT 06516 in the amount of $25,800. as recommended by James Stewart, Public Works Director. 17. Motion by Burgess that the Board of Mayor and Burgesses approve the bid and authorize the Mayor to execute all contracts and documents for the “Refuse and Recycling Carts” to Cascade Engineering, 4950 37th Street SE, Grand Rapids, MI 49512 in the amount of $380,375. as recommended by James Stewart, Public Works Director. 18. Motion by Burgess that the Board of Mayor and Burgesses approve the Revised Five Year Capital Improvement Plan as recommended by James Stewart, Public Works Director. 19. Update regarding the Automated Recycling and Refuse Collection Costs and Procedures as recommended by James Stewart, Public Works Director and Sheila Baummer, Refuse and Recycling Coordinator. 20. Motion by Burgess that the Board of Mayor and Burgesses adopt the following resolution: WHEREAS, pursuant to C.G.S Section 32-9cc the Connecticut Department of Economic and Community Development is authorized to extend financial assistance for economic development projects; and WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make an application to the State for $50,000 in order to undertake the Naugatuck Train Station Brownfield Municipal Pilot Project and to execute an Assistance Agreement.  -3- Agenda – Board of Mayor and Burgesses – Regular Meeting – September 7, 2010 NOW, THEREFORE, BE IT RESOLVED by the Board of Mayor and Burgesses 1. That it is cognizant of the conditions and prerequisites for the state financial assistance imposed by C.G.S Section 32-9cc 2. That the filing of an application for State financial assistance by Borough of Naugatuck in an amount not to exceed $50,000 is hereby approved and that Mayor, Robert A. Mezzo is directed to execute and file such application including a Program Income Reuse Plan, if applicable, with the Connecticut Department of Economic and Community Development, to provide such additional information, to execute such other documents as may be required, to execute an Assistance Agreement with the State of Connecticut for State financial assistance if such an agreement is offered, to execute any amendments, decisions, and revisions thereto, carryout project activities, if approved and to act as the authorized representative of Borough of Naugatuck 3. That it hereby adopts or has adopted as its policy to support the following nondiscrimination agreements and warranties required under subsection (a)(1) of Connecticut General Statutes sections 4a-60 and 4a-60a, respectively, as amended by Public Act 07-245 and sections 9(a)(1) and 10(a)(1) of Public Act 07-142 and, and for which purposes the “contractor” is Borough of Naugatuck and “contract” is said Assistance Agreement: The contractor agrees and warrants that in the performance of the contract such contractor will not discriminate or permit discrimination against any person or group of persons on the grounds of race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved, in any manner prohibited by the laws of the United States or of the state of Connecticut. The contractor further agrees to take affirmative action to insure that applicants with job-related qualifications are employed and that employees are treated when employed without regard to their race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation, or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved. The contractor agrees and warrants that in the performance of the contract such contractor will not discriminate or permit discrimination against any person or group of persons on the grounds of sexual orientation, in any manner prohibited by the laws of the United States or of the state of Connecticut, and that employees are treated when employed without regard to their sexual orientation. Motion by Burgess that the Board of Mayor and Burgesses approve the appointment of Kimberly Kiernan, (R) 33 Marbern Lane, Naugatuck, CT 06770 as an alternate member of the Finance Board, filling the expired term of Stephanie Gunnoud, term to expire June 1, 2013. 24. Motion by Burgess that the Board of Mayor and Burgesses approve the reappointment of Charles Marino, (R) 153 Gorman Street, Naugatuck, CT 06770 as a regular member of the Zoning Board of Appeals, term to expire August 1, 2015. 25. Mayor Mezzo shall reappoint Elaine Russell, 71 Osborn Road 5B, Naugatuck, CT 06770 as a regular member of the Naugatuck Housing Authority, term to expire October 1, 2015. 26. Motion by Burgess that the Board of Mayor and Burgesses designate the month of September 2010 as National Alcohol and Drug Addiction Recovery Month in the Borough of Naugatuck. 27. Motion by Burgess that the Board of Mayor and Burgesses join The Leukemia & Lymphoma Society in designating the month of September 2010 as Leukemia, Lymphoma & Myeloma Awareness Month in the Borough of Naugatuck. 28. Motion by Burgess that the Board of Mayor and Burgesses proclaim the week of September 6-12, 2010 as National Patriotism Week in the Borough of Naugatuck. 29. Motion by Burgess that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents relative to CGI Communications as recommended by James Kallipolites, Information Technology Director. 30.
