MINUTES BOARD OF MAYOR AND BURGESSES REGULAR MEETING MAY 3, 2011 1. Mayor Robert Mezzo swore into office newly-elected burgesses Michael Bronko, Robert Burns, Michael Ciacciarella, Catherine Ernsky, Laurie Jackson, Robert Neth, Ronald San Angelo, Patrick Scully and Deputy Mayor Tamath Rossi, Treasurer Judy Anderson, Tax Collector James Goggin and Bailiff Francis Lawlor. 2. Each member received a copy for review. 5. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the monthly reports of April. Each member received copies for review. 6. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth to recess to Executive Session at 6:35 p.m. for discussion on the following: Personnel (Senior Center Director) inviting in Human Resources Director J. Deschesnes.  -2- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2011 Mayor Mezzo reconvened the meeting at 7:06 p.m. 7. The following motions emanated from Executive Session. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to enter into an employment agreement between the Borough of Naugatuck and Harvey Frydman, Senior Center Director. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses recess to the Firemen’s Pension Plan “C” Board at 7:08 p.m. Mayor Mezzo reconvened the meeting at 7:17 p.m. 9. Public Comment Emergency Management Director Fran Dambowsky spoke about each board member’s attributes. He said the board is an excellent combination of individuals. 10. Burgess Comments/Sub-Committee Reports Burgess San Angelo looks forward to working together on the board. Burgess Ernsky thanked everyone for their support and for future guidance on this board. Burgess Bronko thanked the burgesses who were not re-elected for their service to the borough. He congratulated his fellow burgesses and the Mayor. Burgess Neth congratulated everyone especially the new burgesses. He said this is a really good team to move Naugatuck forward. Deputy Mayor Rossi said it was a record low voter turnout and thanked the voters who took the time to vote. She said she is in awe of the complete trust the voters have in her by electing her as deputy mayor. The Deputy Mayor congratulated everyone. Mayor Mezzo said good things are happening in our community. The Mayor said he misses Tony Campbell, Mr. Woodfield, Hank Kuczenski and Mindy Fragoso. He thanked them for their service. Burgess Burns welcomes the new members to the board. He welcomed the new members to the board. Burgess Scully will miss the members who are no longer on the board. Burgess Ciacciarella welcomed the new members and congratulated everyone. He said there is a lot of work to be done. Burgess Jackson thanked all the voters for voting her into office. She looks forward to serving on the board. 11. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the appointment of Leslie Mengacci, 134 Craig Circle, Naugatuck, CT 06770 as a member of the Board of Education and AFSCME Pension Board filling the vacancy of E. Curran, indefinite term. 12. Mayor Mezzo reappointed Robert B. Allen (D), 438 Field Street, Naugatuck, CT 06770 as a regular member of the Fire Commission, term to expire May 1, 2016. 13. Mayor Mezzo reappointed the Law Firm of Fitzpatrick, Mariano & Santos, PC, 203 Church Street, Naugatuck, CT 06770 as Borough Attorneys effective June 1, 2011, term to expire May 31, 2013. 14. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the Temporary Access and Construction Easement for the purpose of drainage repairs to the property of Medine Etemi based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes; in a form approved by Borough Engineer Wayne Zirolli and subject to Land Use approvals. The construction is deemed finished upon certification by the Borough Engineer. 15. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the Temporary Access and Construction Easement for the purpose of drainage repairs to the property of Ian K. and Jennifer R. Umland based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes; in a form approved by Borough Engineer Wayne Zirolli and subject to Land Use approvals. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents for the Permanent Easement from Cosgrove on Warren Avenue based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes; in a form approved by the Borough Attorney and subject to Land Use approvals. 17. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Mezzo to execute all contracts and related documents with Cel-More Investments LLC (Celentano Drive) regarding the acceptance of detention basins and drainage structures on Warren Avenue based on a favorable report from the Planning Commission pursuant to Section 8-24 of the General Statutes; in a form approved by the Borough Attorney and subject to Land Use approvals. 18. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve the bid for the “Site Lighting Upgrades at Oak Terrace” to Pro Energy Lighting LLC, 14 Townline Road Unit D, Wolcott, CT 06716 in the amount of $77,000.00, as recommended by Kevin Knowles, Naugatuck Housing Authority Director. 19. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses authorize Mayor Robert Mezzo to execute all contracts and related documents relative to Electronic Waste Recycling with WE Recycle! LLC, 500 South Broad Street, Meriden, CT 06450 to comply with the State of Connecticut Electronic Recycling Law, Public Act No. 07-189 as recommended by Sheila Baummer, Recycling Coordinator. 20. There was discussion regarding the Borough of Naugatuck’s Municipal Solid Waste disposal contract, to become effective when the existing contract with Connecticut Resources Recovery Authority (CRRA) expires in November, 2012. 21. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses extend the existing Elderly Tax Credit Programs for the 2011-2012 fiscal year.  -5- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2011 22. Discussion/possible action regarding Finance Board Members. Motion tabled 23. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution: WHEREAS, pursuant to the General Statutes of the State of Connecticut, the Connecticut Department of Economic and Community Development is authorized to extend financial assistance for economic development projects; and WHEREAS, it is desirable and in the public interest that the Borough of Naugatuck make an application to the State for $500,000 in order to undertake the Renaissance Place Downtown Naugatuck – Phase I/Parking Garage Design and to execute an Assistance Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE Board of Mayor and Burgesses: 1. That it is cognizant of the conditions and prerequisites for the state financial assistance imposed by the General Statutes of the State of Connecticut. 2. That the filing of an application for State financial assistance by the Borough of Naugatuck in an amount not to exceed $500,000 is hereby approved and that Mayor Robert A. Mezzo is directed to execute and file such application with the Connecticut Department of Economic and Community Development, to provide such additional information, to execute such other documents as may be required, to execute an Assistance Agreement with the State of Connecticut for State financial assistance if such an agreement is offered, to execute any amendments, decisions, and revisions thereto, and to act as the authorized representative of the Borough of Naugatuck. 3. That it adopts or has adopted as its policy to support the following nondiscrimination agreements and warranties provided in subsection (a)(1) of Connecticut General Statutes sections 4a-60 and 4a-60a, respectively, as amended by Public Acts 07-142 and 07-245, and for which purposes the “contractor” is Borough of Naugatuck and “contract” is said Assistance Agreement:  -6- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2011 The contractor agrees and warrants that in the performance of the contract such contractor will not discriminate or permit discrimination against any person or group of persons on the grounds of race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved, in any manner prohibited by the laws of the United States or of the State of Connecticut. The contractor further agrees to take affirmative action to insure that applicants with job-related qualifications are employed and that employees are treated when employed without regard to their race, color, religious creed, age, marital status, national origin, ancestry, sex, mental retardation, or physical disability, including, but not limited to, blindness, unless it is shown by such contractor that such disability prevents performance of the work involved. The contractor agrees and warrants that in the performance of the contract such contractor will not discriminate or permit discrimination against any person or group of persons on the grounds of sexual orientation, in any manner prohibited by the laws of the United States or of the State of Connecticut, and that employees are treated when employed without regard to their sexual orientation. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following resolution: BOROUGH OF NAUGATUCK FAIR HOUSING RESOLUTION WHEREAS, all persons are afforded a right to full and equal housing opportunities in the neighborhood of their choice; and WHEREAS, federal fair housing laws require that all individuals, regardless of race, color, religion, sex, handicap, familial status or national origin, be given equal access to all housing-related opportunities, including rental and  -7- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2011 homeownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, Connecticut fair housing laws require that all individuals, regardless of race, creed, color, national origin, ancestry, sex, marital status, age, lawful source of income, familial status, learning disability, physical or mental disability, sexual orientation, be given equal access to all housing-related opportunities, including rental and home ownership opportunities, and be allowed to make free choices regarding housing location; and WHEREAS, the Borough of Naugatuck is committed to upholding these laws, and realizes that these laws must be supplemented by an Affirmative Statement publicly endorsing the right of all people to full and equal housing opportunities in the neighborhood of their choice. NOW THEREFORE, BE IT RESOLVED, that the Borough of Naugatuck hereby endorses a Fair Housing Policy to ensure equal opportunity for all persons to rent, purchase, obtain financing and enjoy all other housing-related services of their choice on a non-discriminatory basis as provided by state and federal law; and BE IT FURTHER RESOLVED, that the chief executive officer of the Borough of Naugatuck or his designated representative is responsible for responding to and assisting any person who alleges to be the victim of an illegal discriminatory housing practice in the Borough of Naugatuck and for advising such person of the right to file a complaint with the State of Connecticut Commission on Human Rights and Opportunities (CHRO) or the U.S. Department of Housing and Urban Development (HUD) or to seek assistance from the CT Fair Housing Center, legal services, or other fair housing organizations to protect his or her right to equal housing opportunities. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses adopt the following Fair Housing Policy Statement:  -8- Minutes – Board of Mayor and Burgesses Regular Meeting – May 3, 2011 It is the policy of the Borough of Naugatuck to promote fair housing opportunities and to encourage racial and economic integration in all its programs and housing development activities. Programs funded and administered by this Borough of Naugatuck must comply with the provisions of Section 46a-64c of the C.G.S., and with related state and federal laws and regulations that prohibit discriminatory housing practices. The Borough of Naugatuck or any of sub recipient of the Borough of Naugatuck will carry out an affirmative marketing program to attract prospective buyers or tenants of all majority or minority groups, without consideration of race, color, religion, sex, national origin, ancestry, creed, sexual orientation, marital status, lawful source of income, disability, age or because the individual has children in all programs and housing development activities funded or administered by the Borough of Naugatuck. The municipality’s Grievance Procedure will be utilized in these cases. A copy of this policy statement will be given annually to all Borough of Naugatuck employees and they are expected to fully comply with it. The Borough of Naugatuck seeks to fully carry out its responsibilities under the Title VI Regulations. Title VI of the Civil Rights Act of 1964 prohibits discrimination on the grounds of race, color or national origin in programs and activities receiving Federal financial assistance. Title VI provides that no person shall on the grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any programs covered by the Regulations. She wishes all the best to the two little leagues for a great season. The Deputy Mayor welcomes everyone to the board. (Deputy Mayor Rossi’s comments are attached as submitted.) Burgess Neth said he would like to be the liaison to the Park Commission and Finance Board. He said the outgoing members of the borough board were a huge asset to the borough. Burgess Neth said they will be missed. Burgess Bronko thanked the voters who showed up to vote. He wished everyone a Happy Mother’s Day. Burgess Ernsky said thank you. Burgess San Angelo said thank you to everyone for their support. 30.
