REVISED MINUTES SPECIAL MEETING BOARD OF MAYOR AND BURGESSES DECEMBER 28, 2011 1. Mayor Robert A. Mezzo called the special meeting to order at 6:03 p.m. with the following in attendance: BURGESSES: RESIDENTS: T. K. Rossi L. Jackson One M. Bronko R. Neth R. Burns R. San Angelo PRESS: M. Ciacciarella P. Scully, Sr. E. Gugliotti C. Ernsky M. Deziel OTHERS: DEPARTMENT HEADS: Attorney E. Fitzpatrick None A. Bottinick, CRC Chairman Attorney N. W. Hess III, arrived 6:17 p.m. 2. Mayor Mezzo led in the Pledge of Allegiance to the flag. 3. Discussion ensued regarding the Final Draft Report submitted on December 16, 2011 and prepared by the Charter Revision Commission. Each recommendation in the Final Draft Report was voted on below. 4. VOTED: Unanimously on a motion by Burgess Neth and seconded by Burgess Scully that the Board of Mayor and Burgesses approve II. Change in Date of Municipal Election from May to November as recommended by the Charter Revision Commission’s Final Report. On the record: Deputy Mayor Rossi: I feel that it’s incredibly important for the voters to register what their desire is on this but that my vote certainly in no way reflects trying to extend my term. 5. Motion by Burgess Neth and seconded by Deputy Mayor Rossi that the Board of Mayor and Burgesses approve III. Change of Term of Office of the Mayor from two to four years as recommended by the Charter Revision Commission. Burgess Burns and Burgess Scully opposed. Mayor Mezzo abstained. 6. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Burns that the Board of Mayor and Burgesses approve IV. Budget Referendum Process as proposed by the Charter Revision Commission’s Final Draft Report.  -2- Minutes – Board of Mayor and Burgesses – Special Meeting – December 28, 2011 7. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the Charter Revision Commission recommendations in V. Municipal Office Changes. Motion withdrawn. 8. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve V. Municipal Office Changes regarding Office of the Town Clerk as recommended by the Charter Revision Commission. ROLL CALL VOTE: FOR: OPPOSED: ABSTAIN Mayor Mezzo T. K. Rossi None M. Bronko R. Burns M. Ciacciarella L. Jackson C. Ernsky R. San Angelo R. Neth P. Scully Motion tied 5-5-0 Mayor Mezzo made the tie breaking vote – FOR. Motion carried 6-5-0 9. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully that the Board of Mayor and Burgesses approve all the provisions in V. Municipal Office Changes but for below the section for Town Clerk, the recommendations made by the Charter Revision Commission regarding Section 3.11 Jurors, Section 3.12 Board of Public Charities, Section 3.13 Power of Board of Charities and Committees to Compel Attendance and Testimony of Witnesses Etc., Section 3.21 Three Selectmen and Town Clerk to Be Chosen and Section 28 Board of Relief. 10. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the recommendation by the Charter Revision Commission in VI. Elimination of Outdated Language. 11. Motion by Deputy Mayor Rossi and seconded by Burgess Neth that the Board of Mayor and Burgesses approve the recommendations made by the Charter Revision Commission in VII. Bidding Process. ROLL CALL VOTE: FOR: OPPOSED: ABSTAIN M. Bronko Mayor Mezzo None M. Ciacciarella T. K. Rossi C. Ernsky R. Burns L. Jackson R. San Angelo R. Neth P. Scully Motion tied 5-5-0 Mayor Mezzo made the tie breaking vote – OPPOSED. Motion failed 5-6-0  -3- Minutes – Board of Mayor and Burgesses Special Meeting – December 28, 2011 12. VOTED: Unanimously on a motion by Burgess Scully and seconded by Burgess Burns that the Board of Mayor and Burgesses set the date for the approved changes as November 6, 2012 to put forth to the voters. 13. VOTED: Unanimously on a motion by Deputy Mayor Rossi and seconded by Burgess Scully to adjourn the special meeting at 7:25 p.m. A digital recording of this meeting is available in the office of the Borough Clerk for further review.
